The Conditional Use Permit shall not be recorded until all applicable conditions have been substantially completed. 2. The authorized use shall not begin until the Conditional Use Permit is recorded. 3. If the authorized use ceases for more than six months, the Conditional Use Permit shall expire. 4. The Conditional Use Permit is not a building permit and the applicant must apply for and receive approval of required building and sign permits before construction may begin. 5. The building shall meet all building and fire codes. 6. The Fire Chief shall verify the location of all fire hydrants, and may require additional hydrants necessary to preserve the health and safety of the residents. 7. An Encroachment Agreement with Great River Energy shall be provided to the city before a building permit will be issued. Background/Discussion The applicant is requesting a Conditional Use Permit (CUP) to construct an approximately 400 square foot building addition (drive through) on the south side of the existing Panera Bread restaurant. The subject property is zoned Planned Unit Development which requires a CUP for Class I & II Restaurants. Transportation/Circulation The project will provide a drive-thru lane that allows for the stacking of 10 vehicles. This will not interfere with site circulation. The building addition will be attached to the existing structure on the south side resulting in the loss of the six parking spaces immediately adjacent to the existing building. This will not adversely affect the parking on the property. The proposed building materials will be stone brick/concrete masonry units and Exterior Insulation and Finish System (EIFS) aggregate finish which will be complimentary to those on the existing facades. iERE6 ® tt NATURE Signage They are proposing to replace the existing signage on three sides of the building. In addition to updating Panera's current standard logo, 'drive thru' signage will now be included on the east and west elevations. Easement The applicant is working on an Encroachment Agreement for the portion of the proposed addition that lies within the easement noted on the site plans. Applicable Regulation The issuance of a Conditional Use Permit can be ordered only if the use at the proposed location: 1. Will not endanger, injure or detrimentally affect the use and enjoyment of otherpropery in the immediate vicinity or the public health, safety, morals, comfort, convenience or general welfare of the neighborhood or the ciy. The proposed project will not as it is an expansion of an existing use that has been previously permitted. 2. Will be consistent with the comprehensive plan. The project is consistent with the comprehensive plan. 3. Will not impede the normal and orderly development and improvement of surrounding vacant property. The area is fully developed. 4. Will be served adequately by and will not adversely affect essential public facilities and services including streets,police and fire protection, drainage, refuse disposal, water and sewer systems,parks and schools;and will not, in particular, create traffic congestion or interference with traffic on adjacent and neighboring public thoroughfares. The proposed project will not adversely affect essential public facilities and services. 5. Will not involve uses, activities,processes, materials, equipment and conditions of operation that will be detrimental to any persons or property because of excessive traffic, noise, smoke,fumes,glare, odors, dust or vibrations. The proposed project will not involve uses, activities,processes,materials, equipment and conditions of operation that will be detrimental. It might generate slightly more traffic but if will not be excessive. 6. Will not result in the destruction, loss or damage of a natural, scenic or historic feature of major importance. The proposed project will not. 7. Will fully comply with all other requirements of this Code, including any applicable requirements and standards for the issuance of a license or permit to establish and operate the proposed use in the city. The proposed project will comply with all other requirements of the code. The proposed application appears to meet all of the CUP regulations. If denial of such a permit should occur,it shall accompany recommendations or determinations by findings or a report stating how the proposed use does not comply with the standards set forth in Section 30-654. Core States Group,on behalf of Panera, LLC, is requesting a Land Use Application and Site Plan Plan Review. APPLICATION QUESTIONS I. Detailed description/scope of project a. The proposed development would provide a building addition to the existing Panera café referenced above. The building addition would be attached to the existing structure on the south side. This would result in the loss of the six(6)parking spaces immediately adjacent to the building on that same side. b. The proposed addition will be constructed of a comparable/complementary construction as the existing building, including building materials and colors. Signage will be updated to conform to current Panera standards. c. By adding the drive thru, Panera is able to offer an additional convenience to patrons who are on the go/would rather not get out of their vehicles—i.e.,business people grabbing coffee/bagels on their way in to work, mothers with children who don't want to unload the whole crew,workers grabbing lunch while out running errands,etc. d. Construction is anticipated to begin sometime in the spring of 2016,once all applicable permits and approvals have been received. 2. How compatible is it with surrounding properties? a. The addition of this drive thru is compatible with the surrounding properties. This business,as well as the others within the development are primarily commercial(and motor vehicle)oriented type businesses. The drive thru will now be"re-routing"a portion of the existing traffic that already comes to this site. In addition,this traffic can be routed through more efficiently than it does currently. Patrons that currently park, purchase their food, and then leave with their food will now be able to be `in and out' of the site quicker by means of utilizing the drive thru lane. 3. Hours of Operation a. The hours of operation of the facility would remain the same as the existing café(6 AM to 9 PM, Monday through Sunday). 4. Number of Employees a.
