Fitness for a Conditional Use Permit to allow a Reviewed by
fitness facility in the Elk Park Center Planned Unit
Development
Action Requested
Recommend, by motion, approval of the Conditional Use Permit (CUP) request to operate a recreation
facility in the Elk Park Center Planned Unit Development (PUD),with the following conditions:
1. The Conditional Use Permit is not a building permit and the applicant must apply for and
receive approval of all required permits before construction may begin.
2. The applicant must apply for and receive approval of all required sign permits before signage
may be installed.
3. The authorized use shall not begin until the Conditional Use Permit is recorded.
4. If the authorized use ceases for more than six months, the Conditional Use Permit shall
expire.
Background/Discussion
Case No. CU 15-15
The subject property is located within the Elk Park Center PUD which was approved in 1994. The PUD
agreement identifies amusement and recreation uses as a conditional use,requiring a CUP application and
approval from both the Planning Commission and the City Council.
B.R.E.W. Fitness LLC is proposing to open a Farrell's Extreme Body Shaping fitness facility. Their
program focuses on fitness and coaching patrons to live a healthy lifestyle. Farrell's has been a franchise
since 2007 and is seeking to expand their operations to Elk River. The business is family owned with
ownership split equally among four partners.
Building
Plans include a small reception area and a large open workout area. There are also two changing rooms
that include toilets and showers. The addition of showers will trigger additional SAC and WAC fees.
There are no proposed changes to the exterior of the building or site.
Signage
The applicant proposes to install a new sign over the center of the leased space that is 53 inches tall and
12 feet long. The PUD design guidelines limit sign height to 32 inches tall and the proposed sign will
need to be amended to meet the standard.

Parking
The proposed use is 4,800 square feet in size and requires 24 parking spaces per city ordinance (1 space
per 200 square feet of floor area). The parking lot in front of the facility is adequately sized to
accommodate the required parking for the proposed use as well as all other uses in the development.
Hours of Operation
Th4 facility will be open Monday through Friday 5_am,to 8_pm,and Saturdays 5_a,m,to noon. Classes
run approximately 45 minutes and are held throughout the day.
Employees
The applicant is not proposing to hire any employees initially. The business will be operated by two of the
owners and coaches/instructors will be hired as needed.
Applicable Regulation
Conditional Use Permit
The issuance of a Conditional Use Permit can be ordered only if the use at the proposed location:
1. Will not endanger, injure or detrimentally affect the use and enjoyment of other proper in the immediate
vicinity or the public health, safety, morals, comfort, convenience or general welfare of the neighborhood or the city.
The proposed use will not detrimentally affect nearby property as the use fits with the intended
use of the development and is surrounded by other commercial establishments.
2. Will be consistent with the comprehensive plan.
The proposed use fits the highway commercial guidance for the property.
3. Will not impede the normal and orderly development and improvement of surrounding vacant property.
The surrounding area is nearly fully developed,and the proposed use will not affect the
remaining vacant lots.
4. Will be served adequately by and will not adversely affect essential public facilities and services including
streets,police and fire protection, drainage, refuse disposal, water and sewer systems,parks and schools;and
will not, in particular, create traffic congestion or interference with traffic on adjacent and neighboring public
thoroughfares.
The facility will be served by city services, additional SAC and WAC fees may be required to
account for the change in use. There does not appear to be any other potential impacts to
public facilities or services.
5. Will not involve uses, activities, rocesses, materials, equipment and conditions of operation that will be

detrimental to any persons or property because of excessive traffic, noise, smoke,fumes,glare, odors, dust or
vibrations.
The proposed use does not involve hazardous materials or activities that may detrimentally
affect nearby properties or residents.
6. Will not result in the destruction, loss or damage of a natural, scenic or historic feature of major importance.
The facility will be locating in an existing building and the proposal does not include exterior
site modifications that may damage natural or historic features in the area.

7. Will fully comply with all other requirements of this Code, including any applicable requirements and
standards for the issuance of a license or permit to establish and operate the proposed use in the city.
The applicant is required to comply with all other sections of the code and must apply for all
required building permits in addition to the Conditional Use Permit.
If denial of such a permit should occur,it shall accompany recommendations or determinations by
findings or a report stating how the proposed use does not comply with the standards set forth in Section
30-654.
In the review of the standards for CUP as outlined,it appears that the request is consistent with all of
these standards.

franchise has a similar layout as the Dojo Karate which is also located in Elk Park Center, but
has a very different program which is focused to combat obesity and live a healthy lifestyle.
Farrell's eXtreme Bodyshaping became a franchise in 2007, after several years of amazing
transformations led to requests for Farrell's to come to different parts of the country. Farrell's
eXtreme Bodyshaping is looking to improve its reach, transform more people, and to help others
realize the dream of owning their own business. Their motto is "living with POWER and
PURPOSE".
The Farrell's family is made up of real people with real results, from the photos on our website
to the owners of every location. Every franchisee was first a student. Farrell's is committed to
growing quietly and organically.
Farrell's eXtreme Bodyshaping is a results based fitness program for participants of any age,
lifestyle, sex or athletic ability. The program was developed by Lance Farrell—a long-time
taekwondo competitor and teacher—specifically to combat obesity and to help people develop
healthy lifestyle habits by incorporating the fat- burning, strengthening and endurance building
aspects of competitive martial arts training into a course for regular people who aren't interested
in sparring or contact drills.
In 45 minutes a day, six days a week, Farrell's can help you make real changes in your fitness
and overall health. Results are typical with the Farrell's program. In 10 weeks with Farrell's, you

Ownership:
The proposed Elk River, MN franchise will be family owned. The owners will be active in the
day to day operations of the business,and their ownership percentages can be found below.
