b. Approve,by motion,the ordinance amending the City of Elk River zoning map to rezone Oudot F,
Elk Path Business Center, from R-1c (Single-Family Residential) to BP (Business Park).
Background/Discussion
Case Nos. LU 15-06 and ZC 15-09
City and county staff have been working together to position county property adjacent to the Sherburne
County Government Center for a data center.As part of that discussion, the remainder of Oudot F,Elk
Path Business Center,must be rezoned from R-1c to BP. The city recently completed a similar process
on a portion of the lot to clean up the zoning boundaries,but increased interest in the property shows a
need to rezone the entire parcel.
To accommodate the proposed rezoning the underlying land use must be amended to reflect the
proposed rezoning. Oudot F is currently guided for Public/Institutional uses and does not permit
industrial uses. The proposal changes the entirety of Oudot F to Industrial in order to accommodate
future use as a Business Park.
The adjacent map shows the proposed area,in yellow, to be
rezoned to Business Park. The property had been guided for
Public/Institutional uses to accommodate future use by
Sherburne County,but their current plans identify a facility
expansion to the west of their existing building and this lot is
V 111 no longer included in those plans.

existing conditions witbin the area directly and indirectly affected by the
proposal, the conservation ofproperly values, the use to wbicb the
property affected is being devoted at the time, and relevantprovisions, if
any, in the land use plan.

The proposed Land Use Amendment amends the Comprehensive Plan to reflect the proposed rezoning.
The Comprehensive Plan establishes a framework and expectations as to the future use the property.
In the review of the standards for a Zone Change as outlined, the request is consistent with these
standards.
Planning Commission
No one spoke during the public hearing held by the Planning Commission and no comments have been
received for or against the request.
The Commission did not have any concerns, and unanimously recommended approval of both requests.

Resolution 15-
A Resolution of the City of Elk River Amending the Comprehensive Plan to
Change the Land Use from Public/Institutional to Industrial
WHEREAS, Minnesota Statutes, Chapter 462.355,Subdivision 2,prescribes the procedure for
amending the Comprehensive Plan,and
WHEREAS, the Planning Commission held a public hearing on September 22,2015,and
recommended approval regarding the Comprehensive Plan amendment request for the property
generally described as: Oudot F,ELK PATH BUSINESS CENTER, Sherburne County,Minnesota;
and
WHEREAS, the City Council has reviewed the Comprehensive Plan amendment request and
finds the following:
1. The proposed use of the site is consistent with Light Industrial uses.
2. The land use is consistent with the surrounding land uses.
3. The use would not have adverse impacts on surrounding land uses.
4. The proposed changes are in general conformance to the adopted Comprehensive Plan.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk
River,Minnesota, as follows: The Land Use Plan be amended to change the property as
described above from Public/Institutional to Industrial.
Passed and adopted this 19th day of October 2015.

Ordinance 15 -
An Ordinance Amending the City of Elk River Zoning Map to Rezone Certain
Property from R-I c Single Family-Residential to BP Business Park
Case No. ZC 15-09
The City Council of the City of Elk River does hereby ordain as follows:
SECTION 1.That the duly adopted Zoning Map of the City of Elk River is hereby amended to
rezone the property described on attached Exhibit A from R-1c Single Family-Residential to BP
Business Park.
SECTION 2.That the rezoning approved by this Ordinance is based on the following findings:
1. THE REZONING IS CONSISTENT WTH THE CITY OF ELK RIVER LAND USE
PLAN ADOPTED AS PART OF THE CITY OF ELK RIVER COMPREHENSIVE
PLAN.
SECTION 3.That this Ordinance shall take effect and be in full force from and after the date of its
publication.
Passed and adopted by the City Council of the City of Elk River this 19th day of October,2015.
