NW, Reviewed by Public Hearing Action Requested As there currently is an active Interim Use Permit on the property for three temporary structures set to expire on June 1,2017,recommend, by motion, approval of the Interim Use Permit with the following conditions: 1. The temporary structure on the south side of the building shall be removed before the proposed structure can be placed on the property. 2. The Interim Use Permit for all temporary structures shall expire on June 1, 2017. 3. No further Interim Use Permits for temporary structures shall be granted for the property. Background/Discussion Case No. CU 15-18 The applicant is requesting their fifth extension to their Interim Use Permit (IUP) for temporary classroom structures. They are proposing adding a third structure on the north side of the church replacing the existing 16'x 80' structure located on the south side of the church,which is expected to be removed by November 1, 2015. The two 12' x 56' structures on the north side of the church are set to expire on June 1, 2017, and were approved by the City Council on June 2, 2014. They are asking that all three of the structures have IUP's that expire on September 1, 2019. To date, the applicant has had temporary structures on the property for 11 years and,if the current request is approved,would have an IUP authorizing temporary structures for a total of 15 years (2004- 2019). Analysis Currently there are three temporary structures on the property with at total area of 2,624 square feet. The proposed structure is smaller than the one being removed and would result in reduction of 608 square feet of temporary accessory space. The temporary 16' x 80' structure on the south side of the building has a condition from the previous IUP extension (CU 15-18) that is shall not be granted any future IUPs, and must be removed by June 1, 2017. If the current IUP were to be denied, all of the existing structures would be authorized to remain until June 1, 2017. ► 1NEHED 11'E JA 'UR Applicable Regulation In determining whether to authorize an interim use, the Planning Commission and City Council shall consider the following criteria: 1. The period of time for which the interim use permit is to be granted will terminate before any adverse impacts are felt . upon adjacent properties. 2. There is adequate assurance that the property will be left in suitable condition after the use is terminated. 3. The use is similar to uses defined in the zoning district in which the proper y is located. 4. The date or event that will terminate the use can be identified with certainty. The temporary structures were intended to meet the needs of their growing congregation while they planned an addition on the south side of their existing building. Over the past 11 years, this addition/planning event has not been identified with any certainty and there have been no assurances the use will terminate. 5. Authorizing the use will not impose additional costs on the public if it is necessary for the public to take the property in the future. 6. The applicant and user agree to all conditions that the city council deems appropriate for authorh ation of the interim use. 7. The applicant provides assurances deemed adequate by the ciy council that the use will terminate as provided in the interim use permit. The city council may require the applicant to deposit a cash amount with the ci y, or provide some other form of security, to ensure compliance with this criterion. There have been no assurances the use will terminate. The applicant applied for extensions in 2006, 2008, 2010, 2014 and is applying for another 4 year extension in 2015. If the proposed fifth IUP extension is granted, temporary structures will be in use on the subject property for 15 years. . 8. Authorization of the interim use will not result in adverse effects on the public health, safety, or welfare. 9. The proposed interim use is consistent with the City of Elk River Comprehensive Plan and conforms to the city's zoning regulations. If denial of such a permit should occur,it shall accompany recommendations or determinations by findings or a report stating how the proposed use does not comply with the standards set forth in Section 30-658. In the review of the standards for an IUP as outlined, criteria #4& #7 are not satisfied to permit the IUP. Currently the three structures have been authorized to remain until June 1, 2017 in their current location. The applicant is essentially requesting the relocation of the south structure and extending the IUP expiration date for all three until September 1, 2019. IYER 0f LIFE i(,5 City of Elk River 13065 Orono Parkway Elk River,MN 55330 September 28,2015 City of Elk River Planning Committee: We are requesting to add an additional 12x56 portable classroom on the north side of our building. Currently,we have two 12x56 classroom buildings located there and would like to add a third.We also have a 16X80 mobile home that is located on the south side of our building that will be sold and removed from the property. We would like to add the portable as we currently are in need of additional classroom space for our Sunday School and Wednesday night ministries. We will be removing the mobile home unit as it is not sufficient for either office space or classroom meeting space. Our office hours are Monday-Friday 8am-4pm,however we serve the community not only on Sunday mornings but also many evenings throughout the week with Bible Study,Youth&Children's programming and Care Ministries. We currently employ eleven full and part-time staff and are in the process of hiring a minimum of three new employees. The addition of this temporary building will not impact our parking or outside signage at this point.
