10-27-2015PC MIN Meeting of the Elk River Planning Commission River Held at the Elk River City Hall Tuesday, October 27, 2015 Members Present: Chair Eric Johnson, Commissioners Garrett Christianson,Andrew Crook,Jill Larson-Vito,Mark Konietzko and Brad Thiel Members Absent: Commissioner Jeremy Johnson Staff Present: Planning Manager Zack Carlton, Senior Planner Chris Leeseberg, and Sr. Administrative Assistant Debbie Huebner I. Call Meeting to Order Pursuant to due call and notice thereof, the meeting of the Elk River Planning Commission was called to order at 6:56 p.m.by Chair Eric Johnson. 2. Consider October 27, 2015 Planning Commission Agenda Moved by Commissioner Larson-Vito and seconded by Commissioner Christianson �-- to approve the October 27,2015, Planning Commission agenda. Motion carried 6-0. 3. Consider September 22, 2015 Regular Planning Commission Meeting Minutes Motion by Commissioner Larson-Vito and seconded by Commissioner Crook to approve the September 22,2015, Regular Planning Commission meeting minutes. Motion carried 6-0. 4.1 Request by River of Life Church for Interim Use Permit for Temporary Classrooms, 21695 Elk Lake Rd. NW, Case No. CU 15-18 — Public Hearing Chris Leeseberg presented the staff report. Staff recommended approval with the conditions listed in the staff report. Chair Johnson asked what would be the alternative to the temporary structures, other than adding on to the existing building. Mr. Leeseberg stated that they would need to bring them up to code as a permanent structure,which would include a permanent foundation. Chair Johnson asked if there were any ordinances preventing them from making the structures permanent. Mr. Leeseberg stated no,just that a CUP would be required. Chair Johnson opened the public hearing. Planning Commission Minutes Page 2 October 27,2015 Jane Tokar, Business Manager for River of Life Church, explained that they will be removing the existing larger temporary office structure on the south side and adding a smaller temporary classroom structure adjacent to the existing temporary classrooms. She explained that the church planned to add onto the building in 2006,but due to changes in the congregation numbers and the economy, they were not able financially to do so. She asked that if the church had physical plans for a building addition in 2017,would the city be willing to extend the temporary classroom use until the building addition was complete. Chair Johnson asked what the current end date is for the structures. Mr. Leeseberg stated that it is June 1,217 for all three existing temporary structures. He stated that staff is not comfortable extending the date,and they would need concrete plans that a project will start. Commissioner Konietzko stated that he felt it would be reasonable to allow additional time, if there was a building plan pending. He stated he was not sure what would be needed as evidence. Discussion followed regarding appropriate language to be tied to a possible extension. Motion by Commissioner Larson-Vito and seconded by Commissioner Christianson to recommend approval of the request by River of Life Church for an Interim Use Permit for temporary classrooms at 21695 Elk Lake Road NW,with the following conditions: 1. The temporary structure on the south side of the building shall be removed before the proposed structure can be placed on the property. 2. The Interim Use Permit for all temporary structures shall expire on June 1,2017 if construction of the addition has not begun by June 1,2017. 3. A final Interim Use Permit extension may be allowed as long as construction of the addition has begun by June 1,2017. The final Interim Use Permit extension shall expire when construction is complete or by September 1,2017,whichever is sooner. 4. No further Interim Use Permits for temporary structures shall be allowed on the subject site after September 1,2017 Motion carried 6-0. 4.2 Request by Elk River Lodge & Residential Suites/The Briggs Companies for: - Land Use Amendment to change the land use of property at 17432 Zane St NW from FAST to Highway Business, Case No. LU 15-07 - Conditional Use Permit to allow hotel use, Case No. CU 15-17 — Public Hearing Zack Carlton stated that the applicant formally withdrew these applications yesterday (October 26, 2015), and stated that no action was required. 5. General Business - None Planning Commission Minutes Page 3 October 27,2015 6.1 City Council Liaison Update Councilmember Burandt stated that the City Council approved the B.R.E.W. Fitness and Panera Bread applications. She noted that the Big Tex Trailer World application was withdrawn. 7. Adjournment There being no further business, Chair Johnson adjourned the meeting.
