Background/Discussion Case Number OA 15-11 The subject area is zoned as Mixed Use Elk River Plaza district MU-ERP which allows one permanent area identification sign per neighborhood. The applicant is asking that the ordinance be amended to allow a second smaller identification sign. Analysis The commercial development in the MU-ERP has one area identification on the east side of the development on Highway 169. The applicant is proposing to have one 10 foot tall, 50 square foot sign on the south end of the development. The proposed ordinance amendment would allow for a second area identification sign in the MU-ERP not to exceed 12 feet in height and 50 square feet. The proposed second sign requirements are smaller than what is currently allowed. N:\Public Bodies\Agenda Packets\12-21-2015\LASERFICHE\x7.3 sr sign amendment.docx Due to the applicant’s business being located one block off of Freeport, the lack of visibility, the size of the development, the number of freestanding structures, and the double road frontage the development has, staff agrees that a second area identification sign to the development is needed. Approval from the property owner would be required in order for the signage to be erected in the location it is being proposed. Planning Commission During the public hearing, Guardian Angels President and CEO Dan Dixon stated the sign will greatly assist in providing a clear entrance to their facility. No one else spoke for or against the proposal and the Planning Commission had no issues or concerns. The Planning Commission unanimously recommended approval of the request. That § 30-1584, MU-ERP mixed use Elk River Plaza district of the City of Elk River Code of Ordinances shall be amended to read as follows: Sec. 30-1584. - MU-ERP mixed use Elk River Plaza district. (e) Signage. (1) Temporary signs as permitted in section 30-851 et seq. (2) Permanent signs. a. One Two permanent area identification signs per neighborhood, subdivision, or development, one not to exceed 64 square feet with a maximum height of 20 feet, the second not to exceed 50 square feet with a maximum height of 12 feet. The area identification signs shall be located on the same premises as the development it they identifyies. b. One freestanding sign, not to exceed 100 square feet along collector street or 150 feet along arterial street. c. Max height of ten feet along collector street or 30 feet along arterial street d. Two wall signs, not to exceed 200 total square feet per occupancy. e. One on-premises menu board per drive-up or walk-up lane of a drive-in restaurant or carwash up to a maximum of 32 square feet each. Menu boards are allowed to have a message on one side only and may not contain an advertising message. SECTION 2. That this ordinance shall take effect upon adoption and be published as provided by law.
