AN ORDINANCE AMENDING THE
CITY OF ELK RIVER ZONING MAP TO REZONE CERTAIN PROPERTIES
FROM RID SINGLE FAMILY RESIDENTIAL TO PUD PLANNED UNIT
DEVELOPMENT
CASE NO. ZC 04- 05
The City Council of the City of Elk River does hereby ordain as follows:
Section 1. The duly adopted Zonillg Map of the City of Elk River is hereby
amended to rezone the properties from Rld Single Family Residential to PUD Planned Unit
Development described as:
See Attached Exhibit A
Section 2.
The rezonillg is being approved based on the following findings:
1. THE ZONING IS COMPATIBLE WITH THE UNDERLYING LAND USE
OF MEDIUM DENSITY RESIDENTIAL.
2. THE PROPOSED USE IS CONSISTENT WITH THE ZONING
REQUESTED.
3. THE PROPOSED ZONING IS COMPATIBLE WITH ADJACENT USES
AND ZONING.
Section 3. That this Ordinance shall take effect and be in full force from and
after the date of its publication.
Passed and adopted this 19th day of July, 2004, by the City Council of the City of Elk
River.

All that portion of the North half of the Northeast Quarter of Section 35, Township 33,
Range 25, lying west of Judicial Ditch No.1, as same now crosses tract, Sherburne County,

That part of the Northwest Quarter of the Northwest Quarter of Section 36, Township 33,

Range 26, Sherburne County, Minnesota, lying easterly of the center line of County State Aid
Highway No. 13, and Southerly of a line described as follows:
Beginning at a point on the east line of said Northeast Quarter of the Northwest
Quarter, the bearing of which is assumed to be South 00 degrees 59 minutes West,
said point being 910.75 feet as measured along said East line from the Northeast
corner thereof; thence South 88 degrees 16 minutes 30 seconds West, a distance of
833.86 feet, more or less to intersect said center line of County State Aid Highway
No. 13, and there terminating, together with and subject to that part taken for said
highway.
