City of Elk: River - 13065 Orono Parkway Elk River, MN 55330 September 13, 2004 File: 823930J -0060 The Honorable Mayor and City Council City of Elk River 13065 Orono Parkway Elk River, MN 55330 RE: GATES AVENUE RESTRIPING ISSUE Dear Councilmembers: As directed at the last City Council meeting, staff has prepared the attached striping plan to re-install the two-lane striping pattern with a wide shoulder area on the southern portion of Gates Avenue. The northern portion of Gates Avenue and Freeport Avenue would remain as currently striped in a three-lane configuration. We have looked at the various options for transitioning from a two-lane roadway to a three-lane roadway. We believe that the best transition would be as shown on the exhibit, with back-to-back left turn lanes for St. Andrews Church driveway north-bound and the Evans Meadows apartment complex south- bound. South of this area would be a two-lane roadway with a wide shoulder, and north of this area would be the three-lane configuration. It should be noted that City staff, including myself, Police Chief Jeff Beahen, and Street Superintendent Phil Hals, are still concerned about safety with allowing parking along both sides of Gates Avenue, which has a traffic count of over 6,000 vehicles on an average weekday and no pedestrian facilities adjacent to the roadway. It should also be noted that as directed by the City Council, this re-striping exhibit has been sent to the property owner mailing list for Gates Avenue. Also, as requested by the City Council, I have attached two previous City Council agenda items. The first is from 1994 and deals with the potential realignment of 3'd Street east of Gates Avenue to line up the east and west sides of 3'd Street. The second item is from 1997 and deals with the analysis of whether or not a four-way stop sign at the intersection of Gates Avenue and 3,d Street would be appropriate. As you've read in the paper, the City Council has directed me to contact you regarding the potential acquisition of a parcel of property from you in order to realign the intersection. Potentially, this realignment could be accomplished by acquiring a triangular strip of property along your southerly property line which would be approximately 20 feet wide at Gates Avenue and taper to zero at the southeast comer of your lot. Attached are two copies of a sketch that was prepared in July of 1992 showing a concept of realigning this intersection. As we discussed on the phone today, this is only a concept-it is not a hard and fast design. Also, the City Council's direction to me was to make contact with you and see if there was any interest in pursuing a discussion regarding the potential of acquisition of the property necessary for the realignment. As you are aware, the realignment of this intersection by moving Third Street to the north would necessitate the removal of the large tree in the front of your property. As I indicated, if you would like, we would be happy to put some survey stakes on your property to indicate the actual area the City would like to acquire. After you have had an opportunity to review the sketch, please give me a call. I'd be happy to meet you and your husband at any mutually convenient time to discuss this issue further. NW, Elk River Dear Mr. Maurer: Thank you for dropping off the sketches of the proposed change of Third st. and the staking out you did in our front yard. Considering all of the issues that would come into play when moving Third st., we wish to inform you that we are not interested in selling any portion of our property or tree for this project. Our reasons are as follows: 1. The healthy oak tree which you indicated would have to be cut down is too important to us. It would be tragic to remove a tree that is at least 100 years old, healthy and valuable for many different reasons. 2. The Nickerson family has been in Elk River since 1854 and this is the last piece of property remaining in the family. since the home was constructed in 1910, family members have lived in it and it is very important for us to preserve that. There is absolutely no way we would willingly have half of our front yard lost to a roadway. We would not only lose land but all sense of what privacy is available in the center of town. 3. with the proposed movement of Third street, our driveway would be extremely close to the intersection. As it is now, it is difficult to back onto Gates. with the proposed change, it would be next to impossible and very hazardous. 4. We have been in contact with a real estate specialist. He has looked at the proposed change and has informed us that if the roadway were to be moved and the tree as well as our front yard were lost, it would reduce the value of our home by approximately 20-25% of its present value. For these above reasons, we again say, no. Should the city council continue to go ahead with this plan, we wish to have the issue of right of way addressed as the street now stands. It is our understanding that the right of way for Third Street was not created by any easement or other recorded document and that, therefore, the right of way may only extend to the edge of the actual paved road. In that case the city has no right of way beyond the roadbed. If there is anything further you need or if there is any more discussion on this matter, we would appreciate hearing from you. Box 490 Elk River, MN 55330 RE: THIRD STREET/GATES AVENUE 4-WAY STOP SIGN STUDY Dear Council Members: Per your request on April 7, 1997, an analysis was done to determine if a 4-way stop is warranted at the intersection of Gates Avenue and Third Street (see Exhibit A). There are currently stop signs for both eastbound and westbound Third Street. Traffic counts were taken from April 22 to April 24 for all approaches of the intersection. A 48-hour count was taken, with volumes recorded every 15 minutes. A summary of those counts is found in Appendix A. Accident records were also obtained and are found in Appendix B. The warrants for installation of multi-way stop signs, found in the Minnesota Manual of Uniform Traffic Control Devices, were then used to determine whether or not a recommendation should be made to install stop signs for northbound and southbound traffic on Gates Avenue. The warrants for multi-way stop signs, and the degree to which they are met at this intersection, are as follows: 1. Where traffic signals are warranted and urgently needed, the multi-way stop is an interim measure that can be installed quickly to control traffic while arrangements are being made for the signal installation. A traffic signal is neither warranted nor urgently needed at this intersection. Therefore, this warrant is not met. 2. An accident problem, as indicated by five or more reported accidents in a 12- month period, of a type that could be correctable by a multi-way stop installation. Such accidents include right and left turn collisions, as well as right angle collisions. One accident was reported at this intersection in 1992, two in 1993, three in 1994, two in 1995, and two in 1996. Therefore, this warrant is not met. 3. Minimum traffic volumes: a) The total vehicular volume entering the intersection from all apptoaches must average at least 500 vehicles per hour for any eight hours of an average day, and An Equal Opp~rtunity Employer Honorable Mayor and City Council May 7, 1997 Page Two During the first 24-hour count, this volume warrant was met for seven hours. During the second 24-hour count, this volume was met for six hours. Since this intersection does not have a volume of 500 vehicles for at least eight hours each day, this warrant is not met. b) The combined vehicular and pedestrian volume from the minor street or highway must average at least 200 units per hour for the same eight hours, with an average delay to minor street vehicular traffic of at least 30 seconds per vehicle during the maximum hour, but Pedestrian counts were not taken. However, during the time the traffic counters were set up and taken down, very little pedestrian volume was observed. Therefore, the volumes involve only those of vehicles. During the first 24-hour count, this volume warrant was met for one hour. During the second 24-hour count, this volume warrant was met for zero hours. Since the minor street does not have a volume of 200 vehicles per hour for eight hours each day, this warrant is not met. Because the first part of this warrant was not met, a delay study was not conducted to determine if the second part of this warrant is met. b) When the 85-percentiIe approach speed of the major street traffic exceeds 40 miles per hour, the minimum vehicular volume warrant is 70 percent of the above requirements. The speed limit of Gates Avenue is 30 mph. Therefore, the warrant reduction does not apply. Based on the fact that none of the warrants for 4-way stop control are met at this intersection, it is our recommendation that stop signs not be added at northbound and southbound Gates Avenue at this time. Periodic reviews of existing installations may be desirable to determine whether, because of changed conditions. the use of less restrictive control or no control could accommodate traffic demands safely and more effectively. STOP signs should never be used on the through roadways of expressways. Properly designed expressway interchanges provide for the continuous flow of traffic, making STOP signs unnessary even on the entering roadways. Where at-grade intersections are temporarily justified for local traffic in sparsely populated areas, STOP signs should be used on the entering roadways to protect the through traffic. STOP signs may also be required at the end of diverging roadways at the intersection with other highways not designed as expressways. In most of these cases. the speeds will not warrant any great increase in the sign sizes. STOP signs shall not be erected at intersections where traffic control signals are operating. The conflicting commands of two types of control devices are confusing. If traffic is required to stop when the operation of the stop-and-go signals is not warranted, the signals should be put on flashing operation with the red flashing light facing the traffic that must stop. Where two main highways intersect, the STOP sign or signs should Lormally be posted on the minor street to stop the lesser flow of traffic. Traffic engineering studies, however, may justify a decision to install a STOP sign or signs on the major street, as at a three-way intersection where safety considerations may justify stopping the greater flow of traffic to permit a left-turning movement. STOP signs may be used at selected railroad-highway grade crossings only after their need has been determined by a detailed traffic engineering study. Use of the STOP sign at railroad-highway grade crossings is described in Section 8B-9. Portable or part-time STOP signs shall not be used except for emergency purposes. Also, STOP signs should not be used for speed control. 2B-6 Multiway Stop Signs The "Multiway Stop" installation is useful as a safety measure at some locations. It should ordinarily be used only where the volume of traffic on the intersecting roads is approximately equal. A traffic control signal is more satisfactory for an intersection with a heavy volume of traffic. Any of the following conditions may warrant a multiway STOP sign installation (sec. 2B-4): 1. VIll-5 (e) Rev. 2 2. An accident problem, as indicated by five or more reported accidents of a type susceptible of correction by a multiway stop installation in a 12-month period. Such accidents include right- and left-turn collisions as well as right-angle collisions. 3. Minimum traffic volumes: (a) The total vehicular volume entering the intersection from all approaches must average at least 500 vehicles per hour for any 8 hours of an average day, and (b) The combined vehicular and pedestrian volume from the minor street or highway must average at least 200 units per hour for the same 8 hours, with an average delay to minor street vehicular traffic of at least 30 seconds per vehicle during the maximum hour, but (c) When the 85-percentile approach speed of the major street traffic exceeds 40 miles per hour, the minimum vehicular volume warrant is 70 percent of the above requirements. 2B-7 Yield Sign (Rl-2) The YIELD sign assigns right-of-way to traffic on certain approaches to an intersection. Vehicles controlled by a YIELD sign need stop only when necessary to avoid interference with other traffic that is given the right-of- way. The YIELD sign shall be a downward pointing, equilateral triangle having a red border band and a white interior and the word YIELD in red inside the border band. The standard size shall be 36 x 36 x 36 inches. y 2B-8 Warrants for Yield Signs The YIELD sign may be warranted: I. At the entrance to an intersection where it is necessary to assign right-of-way and where the safe approach speed on the entrance exceeds 10 miles per hour. 2.
