DATE: September 20, 2004 SUBJECT: Case No. CU 04-22 Request by Vanman Companies on behalf of LeFebvre Companies for a Conditional Use permit to Construct Expansion to Existing Facility Reauest Consider a request by Vauman/Lefebvre Companies to construct a 70' X 100' storage building 60 Dav Rule In order to comply with Minnesota Statute 15.99 (60 - Day Requirement), action must be taken on tbis request by September 21, 2004 Location 10895171" Avenue Zonina/Land Use PUD (planned Unit Development / LI (Light Industrial) Attachments . Location Map . Site Plan . Building Elevations Vanman/LeFebvre CU 04-22 September 20, 2004 Page 2 Overview The applicant is proposing to construct a 70' X 100' storage building. Since the property is zoned PUD, a conditional uSe permit to amend the PUD is required to construct the proposed building. The proposed building is located along the north property line; it will be setback 13 feet from the north property line and about 105 feet from the east property line. The Furniture and Things warehouse is located to the north and the BNSF railroad tracks are to the east. There is about 33 feet between the Furniture and Things warehouse and the proposed building. The building will be 18 feet tall and constructed of concrete blocks. There are two overhead doors on the east side. No other improvements to the property are proposed as part of this project. Analysis Setbacks The proposed side yard setback for the building is 13 feet. The required side yard setback in the light industrial district is 25 feet. The Furniture and Things warehouse is setback 20 feet from their south property line. In 1994 they Were granted a variance to the required 25 foot side yard setback setback. Since this property is a Planned Unit Development, a 13 foot side yard setback can be approved without the need for a variance. The Fire Chief has reviewed the site plan and is ok with the distance between the two buildings. Building Elevations The exterior of the building will be concrete block. The exterior should match the existing building. Accent stripes are also proposed around the top of the building. The two overhead doors on the east side of the building will be accessed from the existing yard area. Grading and Drainage There are no significant grading or drainage issues. Plannina Commission Meetina At the Planning Commission meeting held on August 24th no one spoke at the public hearing. One Commissioner asked why the building could not be setback farther from the property line. The applicant explained that there is a fueling station that prevents the building from being setback more than the proposed 13 feet. Recommendation The Planning Commission and staff recommend that the City Council approve the proposed storage building with the following conditions: S: \PLANNING\Case Files \2004\CU 04-22 Vanman \CU04-22CC9-20.doc Vanman/LeFebvre CD 04-22 Septernber20,2004 Page 3 1.
