The Northstar Corridor Development Authority met on August 5, 2004, in regular session at
the Sherburne County Government Center, Elk River, Minnesota.

1. Minutes: The meeting was called to order at 4:40 p.m. A motion was made by Ewald
Petersen, seconded by Lewis Stark and carried unanimously to approve the meeting
minutes of June 24, 2004, and the agenda of August 5, as presented.
2. Executive Committee Report:
a) Final 2003.2004 Budget.
Tim Yantos reviewed the final 2003.2004 NCDA budget being brought forward for
consideration. Mr. Yantos noted that over the last several years, the NCDA's budgets
have reflected the State's fiscal year (from June through June) and not the calendar year
because of the uncertainty of action the State Legislature and of the available of grant
funds. Mr. Yantos noted that the approach of aggregating the 2003.2004 budget was
necessary to appropriately account for expenditures and shift the NCDA back to a
calendar year budget. Mr. Yantos further noted that this budget includes an extension
of the current budget to cover the period September through December, 2004 but that
no additional contributions are being requested from contributing members. Art
Daniels made a motion that the 2003.2004 Budget be approved. The motion was
seconded by Arne Engstrom and passed unanimously on a voice vote.
b) Amendments to Professional Services Contracts for Remainder of 2004.
Tim Yantos noted that the NCDA approved professional services contract amendments
with Richardson, Richter & Associates and Ken Stevens for project management
services and Himle Homer, Inc. for community and public involvement services on
June 24, 2004. These amendments increased the contract amounts for work performed
through September 30, 2004. In order to continue working on Northstar Project
development, the Executive Committee/Capital Budget Committee is recommending
that the NCDA authorize amending the contracts to cover the extended time period.
Mr. Yantos noted that these contract amendments are within the approved 2004 NCDA
budget and work plan. The amendments being recommended are:
i) Amendment No.2 with Ken Stevens increasing the contract amount by
$20,000 for work within the current scope of services;
ii) Amendment No.2 with Richardson, Richter & Associates increasing the
contract amount by $37,000 for work within the current scope; and
iii) Amendment No.2 with Himle Homer Incorporated increasing the
contract amount by $110,000 and extending the term of the contract
through December 31, 2004.
Mr. Yantos noted that these contract amendments are within the approved 2004 budget
and work plan and require no additional monetary contributions by the members.
Peter McLaughlin made a motion that the NCDA approve the proposed 2004 contract
amendments as recommended by the Executive Committee and authorize the Chair to
finalize negotiations and execute contract amendments with Richardson, Richter &
Associates, Ken Stevens and Himle Homer Incorporated. The motion was seconded by
Felix Schmiesing and passed unanimously on a voice vote.
c) Proposed 2005 Budget and Work Plan.
Mr. Yantos noted that the 2005 budget being submitted for recommendation, reflects
federal and regional contributions, as well as the local expenditures necessary to keep
Northstar moving. Dan Erhart made a motion which was seconded by Peter
McLaughlin that the NCDA approve the proposed 2005 NCDA budget as presented.
, The motion passed unanimously on a voice vote. Dan Erhart noted that the
perseverance and determination by the NCDA members over the past seven years has
been what has moved this project forward.
d) Options for Northstar Commuter Coach.
Jon Olson reviewed three options for consideration regarding the Northstar Commuter
Coach services. Option One: Terminate service on September 30, 2004. Option Two:
Continue operation, leave fares at the current levels and operate until all reserves are
spent - about three months. Option Three: Continue service through September 30,
2004 with no fare increase. After some discussion, Dennis Berg made a motion that the
NCDA continue operations of the Northstar Commuter Bus for one year, from October
1,2004 through September 30, 2005, increase fares from Elk River to $4.50 fare from
Riverdale unchanged, and add $100,000 to the NCDA 2005 budget to be allocated 1/3
to the NCDA, 1/3 to Sherburne County and 1/3 to Anoka County. The motion was
seconded by Felix Schmiesing and passed unanimously on a voice vote.
3. Public Information Update: John Himle gave a brief update on public information
activities.
4. Project Update: Ken Stevens noted that staff are developing an RFP for general
engineering consultant services for final design of the Northstar Commuter Rail
Project. The RFP scope of work will include advance planning, rolling stock, design on
capacity improvements and continued negotiations with BNSF.
5. Legislative Update:
a) State.
Bill Schreiber gave a brief update on legislative activities at the State Legislature. He
noted that the Legislative Commission on Metropolitan Government has scheduled a
meeting on the Governor's proposed Northstar funding package. The meeting is
scheduled for August 10,2004 at 9:00 a.m. Chair Grandy handed out a sheet of general
questions and their answers to members.
b) Federal.
Elliott Perovich handed out a Congressional update as prepared by Mullenholz Brimsek
on behalf of the NCDA.
6. Other: Next meeting: Chair Grandy set the next NCDA meeting for September 2, 2004
at 4:30 p.m. to be held at the Sherburne County Government Center.
7. Chair Grandy adjourned the meeting at 5:37 p.m.

Amendment #2 to the Kimley-Horn, Inc. Agreement for Advanced Preiiminary
Engineering Services
In 2003, the NCDA entered into an agreement with Kimley-Horn, Inc. for advanced preliminary
engineering services inciuding the preparations of the New Starts submittal to the FT A. The
Metropolitan Council is developing a new regional ridership forecasting model that will be used
in Northstar's ridership analysis. It is taking the Metropolitan Council longer than anticipated
and the NCDA's New Starts submittal to the FTA has been delayed. In addition, revisions to the
financial pian are more substantial than anticipated due to inclusion of a Mn/DOT 20-year cash
flow projection.
Therefore, the Project Management Team is recommending the Agreement with Kimley-Horn,
Inc. be amended to extend the tenm of the Agreement through January 31,2005 and increase
the contract amount by $20.000. Note this amendment does not change the scope of services.
The amount of $20,000 is within the approved 2003/2004 NCDA Budget and Work Plan.
Action Reauested:
That the Executive Committee 1 Capitai Budget Committee recommend
that the NCDA authorize the Chair to finalize negotiations and execute
Amendment NO.2 to the Advanced Preliminary Engineering
Agreement with Kimley-Horn, Inc. extending the term of the Agreement

Northstar Commuter Bus Agreements
At its last meeting, the Northstar Corridor Development Authority (NCDA) agreed to continue
operations of the Northstar Commuter Bus for one year, from October 1, 2004 through
September 30, 2005. The NCDA also approved an increase to fares from Elk River to $4.50
and an additional $100,000 to the NCDA 2005 budget to be allocated 1/3 to the NCDA, 1/3 to
Anoka County and 1/3 to.,/\nr.k""County.

In order to continue the bus service for another year, it is recommended that the NCDA enter
into or amend the following agreements:
1. An amendment to the agreement (2003-0199) between Laidlaw Transit Service, Inc.,
(the commuter bus service provider), Mn/DOT, and the NCDA for operating services
October 1, 2004 through September 30,2005, not to exceed $1,188,374.
2. An amendment to Mn/DOT Grant Agreement #85651 for federal funds for coach lease in
the amount of $380,765.
3. An amendment to the agreement (2003-0184) for transit convenience fares
reimbursement with the Metropolitan Council to provide to the NCDA reimbursement for
Northstar Commuter Bus fares collected by Metropolitan Council as part of the regional
transit system.
4. An amendment to the agreement between the NCDA and Anoka County to provide
contract management services, relating to Laidlaw Transit Service, Inc.'s operation of the
Northstar Commuter Bus system, for one additional year.
5. A grant agreement with the Metropolitan Council for an amount not to exceed $78,000 in
federal and regional funding.

The NCDA will review the operations, costs and ridership of the commuter bus project at its
April 2005 meeting.
Action Reauested:
That the Executive Committee/Capital Budget Committee recommend
that the NCDA authorize the Chair to finalize negotiations and execute
the above listed agreements and any other agreements necessary to
receive funding for the Northstar Commuter Bus service.

Authorization to Enter Into a Grant Agreement with the Metropoiitan Council
Recentiy, Governor Pawlenty and the NCDA announced plans to provide interim funding
that would allow the Northstar Corridor commuter rail line project to proceed. The action by
the Governor will secure $10 million in federal funding for property acquisition and related
activities, as well as BNSF negotiations. The Governor's plan includes using $2.5 miliion
from the Metropolitan Council as the local match to the $10 million. These funds will be
used for land acquisition in the metropolitan area for the Northstar Corridor facilities. The
Metropolitan Council approved the $2.5 million in funding at its meeting on August 11, 2004.
Action ReQuested: That the Executive Committee I Capital Budget Committee
recommend that the NCDA authorize the Chair finaiize negotiations
and execute a Grant Agreement with the Metropoiitan Council for the
$2.5 million in funding contribution to be used for land acquisition in
the metropoiitan area for the Northstar Corridor facilities.

RFP for Engineering Services for the Final Design of the Northstar Commuter
Rail Project
The next step in the development of the Northstar Corridor Commuter Rail Project is final
design. Pursuant to a memorandum of understanding, the NCDA will begin final design in
January 2005. Because the State Legislature has not committed its State share of the non-
federal funding for the Project, the FTA has not yet given its approval to enter final design. It is
anticipated that the NCDA will undertake final design without federal participation at this time.
Funding for final design will be provided by the NCDA capital partners which include the
regional railroad authorities of Anoka, Hennepin and Sherburne Counties. Once the local match
has been committed by the Minnesota Legislature, the NCDA will seek FTA approval of final
design activities.
Staff are requesting that the NCDA authorize the release of a Request for Proposals (RFP) for
Engineering Services for the Final Design of the Northstar Commuter Rail Project. The
engineering services requested in the RFP include a general engineering consultant responsible
for the final design of the following project components: six commuter rail stations; track and
signal improvements to the BNSF railroad; maintenance, layover and central control facilities;
and rolling stock. In addition, the consultant would be responsible for value engineering and
assisting the NCDA in the preparation of New Starts reports and in providing support for
community involvement and transit-oriented development activities. And depending on the
outcome of negotiations with BNSF, the consultant may also be required to conduct preliminary
engineering and prepare environmental documentation for an alternate site for the maintenance
and central control facility. The term of this project is anticipated to be from January 2005
through early 2006.
