SR 02-16-2016 Request for Action To Item Number Mayor and City Council 7.2 Agenda Section Meeting Date Prepared by Public HearingFebruary 16, 2016Chris Leeseberg, Senior Planner Item Description Reviewed by Ordinance Amendment to Rezone Property from Zack Carlton, Planning Manager R1c to R1a, Single Family Residential, 19640 and Reviewed by 19660 Proctor Road Cal Portner, City Administrator Action Requested Adopt, by motion, an ordinance to rezone certain property from R1-c to R1-a for the following reasons: 1.The rezoning is consistent with the City of Elk River Land Use Plan adopted as part of the City of Elk River Comprehensive Plan. 2.The subject area is outside of the Urban Service District which does not support R1-c requirements. Background/Discussion Staff was contacted by a property owner in the subject area regarding the size of an accessory structure they could build on their property. When researching the answer, staff identified an error on the zoning map. The subject properties are currently shown as R1-c but are 2 ½ acres or larger in size and are outside the Urban Service District (USD). These criteria reflect those of the R1-a zoning district. Upon reviewing the archived zoning maps, somewhere between 1989 and 1996, the subject property was changed from R1-a to R1-c. It is unclear why this was done. Applicable Regulation In reviewing a proposed amendment, consideration shall be given to existing conditions within the area directly and indirectly affected by the proposal, the conservation of property values, the use to which the property affected is being devoted at the time, and relevant provisions, if any, in the land use plan. The purpose of the Comprehensive Plan is to establish a framework and expectations as to the future use of land. The plan guides the properties for residential uses and is outside the (USD). The surrounding properties within a half mile of the subject properties are guided per the Comp Plan for residential uses and are zoned residential. Some of these properties are in the USD and some are not. In the review of the standards for a Zone Change as outlined, it appears that the request is consistent with all of these standards. Staff recommends the properties be rezoned from R1-c to R1-a to bring them into alignment with the Comprehensive Plan. Planning Commission meeting summary No one spoke for or against the request at the public hearing. The Planning Commission unanimously recommended approval of the request. That the duly adopted Zoning Map of the City of Elk River is hereby amended to rezone the property described on attached Exhibit A to Extreme Commercial Recreation (XCR). SECTION 2.That the rezoning approved by this Ordinance is based on the following findings: 1.The rezoning is consistent with the City of Elk River Land Use Plan adopted as part of the City of Elk River Comprehensive Plan. 2.The subject area is outside of the Urban Service District which does not support R1-c requirements. SECTION 3.That this Ordinance shall take effect and be in full force from and after the date of its publication.
