SUBJECT: Business Park Design Standards.
The Planning Commission recently held a workshop,in which the EDA was invited to
attend, for a discussion regarding the Business Park design standards. The attached current
Business Park design standards prohibit the use of pre-cast concrete panels. Brookstone
Development has raised the concern about the prohibition of pre-cast concrete panels and
the limitations it presents for business development.

At the May 8, 2001 workshop,Brookstone Development presented a video of pre-cast
buildings in other communities and similar to buildings they would propose for the East
Business Park. Brookstone also presented written standards for Planning Commission
consideration. EDA members stated interest in continuing a discussion of the current
Business Park design standards,issues raised by Brookstone Development, and impact on
the Economic Development Industrial Marketing Strategy.
The Planning Commission stated a willingness to consider revision to the ordinance with
appropriate language that clarifies the City's vision for Business Park construction materials
and buildings. The Planning Commission directed staff to re-work the language proposed
by Brookstone and to review the proposed ordinance with the development community and
economic development key accounts for input.
In addition, a concern has been raised regarding the process of rezoning Light Industrial,
Medium Industrial or Business Park property to other zoning and land uses (e.g. residential).
The concern is reducing the amount of business development areas in the City,when the
City has identified business development as a priority within the Strategic Economic
Development Plan. Staff recommends that the EDA have the opportunity to review such
rezonings for comment and recommendation as it relates to the Economic Development
Industrial Marketing Strategy.

SUBJECT: TIF 19 —Authorize Issuance of Certificate of Completion and Notes
Issue
The TIF 19 Contract for Private Redevelopment, dated July 30, 1999, between the EDA and
Associated Investors of Elk River, Inc., Fischer Sand&Aggregate, LLP, and Elk River
Business Park,LLC requires a Certificate of Completion be executed prior to payment.
Recommendation
• Staff has determined that the conditions precedent to the issuance of the Certificate of
Completion have been satisfied. Staff recommends the EDA authorize the EDA President
and Vice President to execute the TIF 19 Certificate of Completion and the Limited
Revenue Tax Increment Notes A and B.

WHEREAS, the Economic Development Authority in and for the City of Elk River (the
"Authority") and Associated Investors of Elk River, Inc., Fischer Sand & Aggregate, LLP, and
Elk River Business Park, LLC, (the "Redeveloper"), have executed a Contract for Private

completion by the Redeveloper of certain improvements (the "Initial Improvements"), described
in the Redevelopment Agreement; and
WHEREAS, said Redeveloper has to the present date substantially performed its
undertakings under the Redevelopment Agreement in a manner deemed sufficient by the
Authority to permit the execution of this certificate pursuant to Section 4.4 of the Redevelopment
Agreement:
NOW, THEREFORE, this is to certify that the Initial Improvements have been completed
on the Development Property in substantial conformance with the terms of the Redevelopment
Agreement.
