III MEMORANDUM TO: Economic Development Authority FRO Cathy Mehelich, Director of Economic Development DATE: November 13, 2000 SUBJECT: Snowmobile Trail Request Issue Staff has received a request by the River City Snow Riders Club to acquire a permit to build a snowmobile trail along the east side of the railroad and within the wetland area of the EDA (Brown) property in the East Business Park. Representatives of the River City Snow Riders Club may be in attendance to answer questions. III Attachments • Maps of EDA Property indicating Proposed Trail • Letter from Greg Strommen, dated November 1, 2000 • Sherburne County Snowmobile Trail Permit • MN United Snowmobilers Association Landowner Protection Law Background Proposed Trail Location Attached is the letter of request for the snowmobile permit received from Greg Strommen, representing the Snow Riders Club. Also attached is a map indicating the EDA property and location of the proposed trail as it relates to the designated wetland area. The trail is proposed to run between the west property line and within the designated wetland area. Additionally, the Club has proposed that a trail run along the north and south property line. Staff understands that discussions are underway with MNDOT for building a trail along the Highway 10 and 169 corridor rights-of-way. Staff believes that if a trail is built along the highway rights-of-way, an additional trail along the EDA north property line will be unnecessary. III Memo to EDA Snowmobile Trail Permit November 13,2000 Page 2 • The City may consider locating the proposed southerly trail within the 173rd Avenue rights-of-way, rather than along the EDA property line. Trail Permits Attached is a Sherburne County Snowmobile Trail Permit as drafted by the Snow Riders Club. The permit may be terminated upon sale of the property, or upon a six-month written notification. A 12-foot trail width is being proposed. Liability Issues The State of Minnesota has a statute to protect landowners from liability lawsuits when permission has been granted without charge. Attached is a copy of MN Statute 604A.23 and summary provided by the River City Snow Riders Club. Action Requested Should the EDA choose to grant the request, staff recommends that the following conditions be added to the permit: 1. Permit will be considered for issuance on an annual basis 2. Trail use is limited to within an area 300' from the west property line i • November 1,2000 Subject: Snowmobile trail on Brown property in East Business park. To all concerned We the River City Snow Riders would like permission to put a snowmobile trail on the Brown property. This trail would run along the railroad property at the west end of the property. We do not have permission to continue the trail along the railroad right of way. We would then like to run the North property line. This would take us underneath the power transmission lines over to Tyler Street. Currently we will run along the railroad right of way on the adjoining property to the North. We anticipate future expansion to limit how long we are able to do this. The trail will then move to the Tyler street Park and Rec Asphalt trail or near it. We will be coming off of Tyler street onto the old 173`d road and entering the trail at the existing point. This trail will be a main corridor trail and is badly needed. Currently there are many snowmobilers coming from Anoka and Ramsey. Once they reach Elk River they are going where ever they feel they have to go to get to 169. We are trying to eliminate this problem. Your cooperation is greatly needed. Stat. 604.20 et seq. in 1994, MnUSA successfully fought to pass a hill at the State I.egislanire protecting private landowners from tort lawsuits. Under this law protection is granted to private landowners who allow a snowmobile trail across the landowners property without charge. The only remaining tort liability for a landowner is where the landowner willfully takes action to cause injury. In other words,there is no legal basis for suing a landowner' for negligence if the landowner meets the requirements of the law. To be protected wider this law the landowner must: • Give oral or written permission for the public to use the land for snowmobile • •Allow this public use without charge, admission or fee. • Refrain from willfully taking action to cause harm. This extraordinary legal protection is granted when the recreational use is incidental to or arises from access granted to the Iand for recreational trail use. Where the landowner grants permission to the public to use the land for other than trail use, A lesser amount of protection is granted. In such case the landowners duty of care is limited to the duty of care to a trespasser. Where permission is refused, the landowner is afforded no protection against lawsuits. In enacting this law, the legislature clearly wanted to encourage private landowners to permit snowmobile trails on their land The incentive granted was to olid such great protection from lawsuits that now a landowner who gives permission for a • trail is legally better off than a landowner who refuses. Subdivision 1. General. For the purposes of sections 604A.20 to 604A.27, the terms defined in this section have the meanings given them, except where the context clearly indicates otherwise. Subd. 2. Charge. "Charge"means any admission price asked or charged for services, entertainment, recreational use, or other activity or the offering of products for sale to the recreational user by a commercial for profit enterprise directly related to the use of the land. Subd. 2a. Dedicated. "Dedicated" means made available by easement, license, permit, or other authorization. Subd. 3 . Land. "Land" means any of the following which is privately owned or leased or in which a municipal power agency has rights: land, easements, rights-of-way, roads, water, watercourses, private ways and buildings, structures, and other improvements to land, and machinery or equipment when attached to land. • Subd. 4. Owner. "Owner" means the possessor of a fee interest or a life estate, tenant, lessee, occupant, holder of a utility easement, or person in control of the land. Subd. 5. Recreational purpose. "Recreational purpose" includes, but is not limited to, hunting; trapping; fishing; swimming; boating; camping; picnicking; hiking; bicycling; horseback riding; firewood gathering; pleasure driving, including snowmobiling and the operation of any motorized vehicle or conveyance upon a road or upon or across land in any manner, including recreational trail use; nature study; water skiing; winter sports; and viewing or enjoying historical, archaeological, scenic, or scientific sites. Subd. 6. Recreational trail use. "Recreational trail use" means use on or about a trail, including but not limited to, hunting, trapping, fishing, hiking, bicycling, skiing, horseback riding, snowmobile riding, and motorized trail riding.
