Action Requested
Recommend, by motion,approval to rezone certain property from Commercial Reserve Transition to
Highway Commercial with the following condition:
1. A Conditional Use Permit to operate an auto body repair facility shall be approved by the City
Council before May 31, 2016.
Background
The applicant initially applied for a Conditional Use Permit (CUP) and a Zone Change to the subject
property in order to operate an auto body repair facility. Due to timing issues and the need for further
information, the applicant has withdrawn their Conditional Use Permit (CUP) application and will be re-
applying for a CUP.
The subject property is zoned Commercial Reserve Transition (CRT) with a portion of the property in
the Antenna Overlay District (AT). The AT will not be affected by the zone change request. Because
CRT does not allow auto body repair facilities, the applicant is requesting the property be rezoned to C3
(Highway Commercial).
Applicable Regulation
In reviewing a proposed amendment, consideration shall be given to existing conditions within the area directly and indirectly-affected by
the proposal, the conservation ofpropery values, the use to which the properly affected is being devoted at the time, and relevant
provisions,if any,in the land use plan.
The property is surrounded by Extreme Commercial Recreation,Commercial Reserve Transition,Medium
Industrial,and Mineral Excavation Overlay. Most of the surrounding property is zoned for some form of
commercial use.
In the review of the standards for a Zone Change as outlined,it appears that the request is consistent with all of
these standards.

I want to withdraw my current application then. Do I need to call or fill anything out or is letting you know
