The Commission questioned whether the motion correctly stated that the first phase of the construction of the school district maintenance building contained 12,900 sq. ft. with an investment of$900,000. The information in the attached agenda memo from Bill Rubin indicates that the motion was correctly stated. The first phase of the • project will contain approximately 12,900 sq. ft. at a cost of$900,000. The second phase will result in the construction of an additional 7,800 square feet with an investment of approximately $300,000. District 728 Maintenance Facility At its meeting of June 12, 1995, the Elk River EDA authorized a Contract for Private Development by and between the EDA and Independent School District 728. The Agreement was entered into the 27th day of October, 1995. A copy of the Agreement is included in the agenda packet and more thoroughly outlines the terms and conditions of the project. Section 3 of the Agreement addresses the topic of default. District 728 is required to obtain a Certificate of Occupancy on or before March 1, 1996. It is also required to provide a minimum investment of $750,000. While general site development activities occurred last fall, higher than expected construction bids delayed this project; As a ppears as though the District will phase-in this project. For #example, the project's first phase will likely contain approximately 12,900 square feet. Construction will begin this spring and should be completed by October. The anticipated investment required for this project is $900,000. A second phase,with an investment of approximately $300,000, will result in the construction of an additional 7,800 square feet. This space may not be constructed for OrdwiPto Five years. As a result of these issues, Dr. Ron Bratlie has agreed to attend the EDA meeting and answer any questions or address any areas of concern. In order that the integrity of the Agreement be retained, it would be in order to move forward with, say, a first amendment which addresses the project's revisions. P.O. Bill Rubin explained that Section 3 of the EDA's contract for Private Development requires that District 728 obtain a Certificate of Occupancy on or before March 1, 1996, and it is required to provide a minimum investment of$750,000. He indicated that the Agreement should be amended because of the revised plans by District 728. COMMISSIONER DUITSMAN MOVED TO AUTHORIZE THE PREPARATION OF A FIRST AMENDMENT TO THE CONTRACT FOR PRIVATE DEVELOPMENT WITH INDEPENDENT SCHOOL DISTRICT NO. 728 TO REFLECT THE FIRST PHASE OF CONSTRUCTION CONTAINING 12,900 SQUARE FEET WITH AN INVESTMENT OF$900,000. COMMISSIONER FARBER SECONDED THE MOTION. THE MOTION CARRIED 5-0. 8. Update on Upcoming Marketech, Inc. Expansion Rich Duggan, president of Marketech, Inc., 16864 Highway 10, addressed the EDA regarding his proposal to expand his existing business by constructing a new 8,000 square foot facility. Mr. Duggan explained that Marketech currently occupies 4,350 square feet and employees 24 people. He stated that the expansion will create a need to employ 5 more people during the next year. Mr. Duggan indicated,that he is in the process of looking for land on which to build and further indicated that he will be requesting tax increment financing. He stated that it his first desire to build in the Elk River Industrial Park. 9. Consider Concept of Public/Private Business Incubator • Executive Director Bill Rubin explained the concept of a business incubator. He indicated that an incubator is intended to provide low-cost space for newly- formed ewlyformed or emerging companies. Bill Rubin indicated that in mid-January, he had the opportunity to attend an open house and tour of a successful business incubator in Columbia Heights. A video presentation was presented to the Commissioners to reinforce the concept of the Anoka County business incubator and its respective players. Commission Holmgren arrived at this time (6:30 p.m.) Commissioner Duitsman indicated his interest in this concept. He stated that it would be beneficial to request a presentation to the EDA and Sherburne County Board of Commissioners by the Anoka County Economic Development Partnership on business incubators. 11. Other Business 11.1. Sustainable City Showcase Commissioner Duitsman indicated that as Mayor he has received a request for the City to consider becoming a Sustainable City Showcase. Bill Rubin indicated that a Sustainable City Showcase is a project of Minnesota Environmental Initiative's Energy Alley Task Force. Consider Agenda Commissioner Duitsman added the following item to the agenda. • 11.1. Sustainable City Showcase COMMISSIONER BENDER MOVED TO APPROVE THE 2/12/96 EDA AGENDA AS AMENDED. COMMISSIONER SCHEEL SECONDED THE MOTION. THE MOTION CARRIED 5-0. 3. Consider EDA Consent Agenda COMMISSIONER FARBER MOVED TO APPROVE THE EDA CONSENT AGENDA AS FOLLOWS: 4. JANUARY 8, 1996, EDA MINUTES -- APPROVED 6. EDA CHECK REGISTER -- APPROVED COMMISSIONER DUITSMAN SECONDED THE MOTION. THE MOTION CARRIED 5-0. 5. Open Mike No one appeared for this item. 7. Update on District 728 Maintenance Facility Executive Director Bill Rubin updated the EDA on the progress of the District 728 maintenance facility. He indicated that because the construction bids came in • higher than anticipated last fall, the facility would be built in phases. Mr. Ed Palmer of Solar Attic, 15548 95th Circle NE, Otsego, is a member of the Sustainable City Showcase project. Based on the energy- related companies here, Mr. Palmer has indicated that Elk River would be a strong candidate for Sustainable City. COMMISSIONER DUITSMAN MOVED TO SEND IN THE REQUEST FOR MORE INFORMATION ON THE SUSTAINABLE CITY SHOWCASE BY FEBRUARY 16, 1996,AND TO REQUEST MR. PALMER COME TO THE NEXT EDA MEETING TO UPDATE THE AUTHORITY ON THIS CONCEPT. COMMISSIONER FARBER SECONDED THE MOTION. THE MOTION CARRIED 6-0. 10. Accept Resignation from Executive Director William Rubin COMMISSIONER DUITSMAN MOVED TO ACCEPT THE RESIGNATION OF EXECUTIVE DIRECTOR WILLIAM RUBIN EFFECTIVE MARCH 5, 1996. COMMISSION BENDER SECONDED THE MOTION. THE MOTION CARRIED 6-0. COMMISSIONER DUITSMAN MOVED TO APPOINT PAT KLAERS AS THE EXECUTIVE DIRECTOR FOR THE ECONOMIC DEVELOPMENT AUTHORITY. Chair Gongoll expressed his regret in accepting Bill Rubin's resignation and thanked him for the progress he has made in economic development in the City • of Elk River during his tenure. 12.
