7.0. EDSR 01-09-1995 FIRST AMENDMENT TO CONTRACT FOR
111 PRIVATE DEVELOPMENT
THIS FIRST AMENDMENT TO CONTRACT FOR PRIVATE DEVELOPMENT is
made and entered into this day of January, 1995, by and
between ECONOMIC DEVELOPMENT AUTHORITY FOR THE CITY OF ELK RIVER
("EDA") and TESCOM CORPORATION, a Minnesota corporation
("Tescom") .
RECITALS:
FIRST: EDA and Tescom entered into that certain Contract for
Private Development dated May 18, 1993 ("Contract") ,
regarding the property legally described as Lots 2 and
3, Block 2, Elk River Industrial Park 2nd Addition,
Sherburne County, Minnesota.
SECOND: EDA and Tescom desire to amend the Contract as set
forth below.
NOW, THEREFORE, in consideration of Ten and 00/100 Dollars
($10. 00) and for other good and valuable consideration, the
receipt and sufficiency of which is hereby acknowledged, EDA and
Tescom agree that the Contract shall be amended as follows:
1. Schedule A of the Contract is hereby amended in its
111 entirety as follows :
SCHEDULE A
Description of Development Property
Lot 1, Block 2, Elk River Industrial Park 2nd Addition, Sherburne
County, Minnesota;
Lot 2, Block 2, Elk River Industrial Park 2nd Addition, Sherburne
County, Minnesota; and
Lot 3, Block 2, Elk River Industrial Park 2nd Addition, Sherburne
County, Minnesota.
2 . Except as hereby modified and amended, all other terms,
covenants and conditions of the Contract shall continue in full
force and effect without change.
IN WITNESS WHEREOF, the parties have executed this First
Amendment to Contract for Private Development on the day and year
first above written.
