Recommend, by motion, the city maintain the existing pedestrian easement located at 11936 190"' Circle
NW and improve the easement with the construction of a bituminous trail.
Background/Discussion
At the January 19, 2016, Work Session, the City Council referred the discussion regarding the
maintenance and improvement of an existing pedestrian easement located at 11936 190"' Circle NW to
the Parks and Recreation Commission. The trail easement located on the west side of the property,
owned by Harold and Valerie Williams, was unanimously recommended by the Parks and Recreation
Commission on February 10, 2016, for the city to pave and maintain.
The Williamses attended the City Council Work Session requesting the city either maintain the trail or
vacate the easement. The trail will allow movements between the school and the neighborhood to the
north. The city maintained the easement for many years, before it was abandoned four years ago because
it was unpaved and difficult to maintain.
If the city is to maintain the easement, staff recommends constructing a bituminous trail that can easily be
maintained. It is recommended in the Parks and Recreation Master Plan (page 55) to ensure safe walking
and biking routes to schools. The preliminary cost estimate to construct a trail on the easement is
approximately $15,000, which could be paid for out of the Park Improvement Fund.
The Park Improvement Fund has $89,000 in trail repairs to replace the Orono Parkway trail. Staff
recently decided that this project be moved to 2017 when the road is scheduled to be replaced and the
trail can become part of that project. Therefore, a portion of these funds dedicated to the Orono trail can
be used this year to pave this easement.
Financial Impact
The approximate cost to construct the bituminous trail is $15,000.

Provide direction regarding the easement on the west 12 feet of the property located at 11936 190th
Circle NW.
Background/Discussion
During the Open Forum of the January 4, 2016, City Council meeting, Harold and Valerie Williams spoke
to the Council about a pedestrian easement located on the west side of their property. They stated that
the trail was used regularly when the development was first constructed, but more recently has been used
as a smoking refuge for students.
They requested the city to either maintain the trail or vacate the easement and allow them to utilize that
portion of their yard. In speaking with them after the meeting their preference was to have the city
maintain the trail.
The easement was included in the original plat to allow movement between the school and the
neighborhood to the north. The easement has also been used during sporting events at the school and
the athletic fields west of the neighborhood. There is also an opportunity for residents to use the
easement to move north and south in the area without the need to walk to Jackson Ave in the east or
Proctor Avenue in the west.
Staff recommends constructing a bituminous trail to connect the northwest corner of what is today the
arena parking lot in the south and 190"' Avenue in the north. The preliminary cost estimate prepared by
staff is approximately $15,000, which could be paid for out of the Park Improvement Fund in the 2016
budget.
The Parks Maintenance Superintendent is comfortable with the additional maintenance resulting from
trail construction. The Parks Department can provide additional information regarding funding and
maintenance during the meeting.
