EDSR 06-06-1994 ELK RIVER ECONOMIC DEVELOPMENT AUTHORITY MEMORANDUM TO: ECONOMIC DEVELOPMENT AUTHORITY FROM: WILLIAM RUBIN, EXECUTIV DIRECTOR DATE: JUNE 1, 1994 SUBJECT: AGENDA MEMO FOR JUNE 6, 1994, EDA MEETING 3./4. Public Hearing on Alltool Land Sale/Quit Claim Deed State law requires that an Economic Development Authority conduct a public hearing on any proposed sale of property owned by the agency. • The June 6 public hearing relates to the proposed sale of land immediately west of the Elk River Industrial Park 2nd Addition. By way of a previous memorandum, EDA Commissioners were advised that Alltool Manufacturing Company, Inc., is proposing a 40,000 square foot expansion to its existing 85,000 square foot facility in the Elk. River Industrial Park. The proposed expansion begins to exceed certain Uniform Building Code thresholds relative to the need for a fire lane and for additional setback areas around the structure. Alltool's existing site cannot accommodate both of these requirements. Property to the west of Alltool is owned by the EDA, and, although it is unplatted, it is considered more of an element of the City's storm drainage system than it is a viable industrial site. Conveying a 100 foot strip off of this track to Alltool would have little or no affect on the drainage system. In addition, the 100 foot wide strip does not pose a problem for Alltool relative to wetland restrictions. This property would be conveyed to Alltool by way of a Quit Claim Deed. The consideration for this Deed would be less than $500. The Deed would not be recorded until such time as the City has completed its internal site plan review process and a building permit has been • issued. P.O. The 2.17 acre parcel is described as follows: That part of the Southwest Quarter of Section 28, Township 33, Range 26, Sherburne County, Minnesota, described as Beginning at the Southwest corner of Lot 4, Block 1, of the duly recorded plat of ELK RIVER INDUSTRIAL PARK 2ND ADDITION, said Sherburne County; thence westerly along the Westerly extension of the South line of said Lot 4 to intersect a line 100.00 feet west of, as measured at right angles to, and parallel with, the West line of Lots 1 through 4 • inclusive, said Block 1; thence north along said parallel line to intersect the South line of the right-of-way of County State Aid Highway No. 1, also known as Elk Lake Road; thence easterly along said highway right-of-way to the Northwest corner of said Lot 1, Block 1, thence south along said West line of Lots 1 through 4 inclusive to the Point of Beginning. This parcel will be conveyed to Alltool Manufacturing Company, Inc., by way of a Quit Claim Deed. The consideration for this Deed is less than $500. All persons desiring to appear at the public hearing will be afforded an opportunity to express their views with respect to the proposed sale of the above-described parcel.
