RES 90-1 THE ECONOMIC DEVELOPMENT AUTHORITY FOR THE CITY OF ELK RIVER, MINNESOTA RESOLUTION NO. 90 - 1 A RESOLUTION AMENDING THE DEVELOPMENT PROGRAM FOR DEVELOPMENT DISTRICT NO. 1 AND EXPANDING THE BOUNDARIES OF DEVELOPMENT DISTRICT NO. 1. The Economic Development Authority for the City of Elk River (the Authority) acting pursuant to its authority under the Minnesota Economic Development Act (Minnesota Statutes, Sections 469 . 124, at seq. ) hereby finds, determines, and resolves as follows: FINDINGS 1. That City of Elk River Development District No. 1 was designated as a municipal development district pursuant to Minnesota Statutes, Chapter 472A and Sections 124 at seq. , and that the Development Program for Development District No. 1 was approved by resolution of the City Council for the City of Elk River dated April 1, 1985, and amended by resolutions of the City Council of the City of Elk River dated January 27, 1986, and November 30, 1987 . 2 . That the City Council for the City of Elk River, pursuant to Resolution No. 87-63 has transferred authority for Development District No. 1 to the Economic Development Authority for the City of Elk River. 3. That the Development Program for Development District No. 1 anticipates and provides for the adoption of Tax Increment Financing Plans and the establishment of Tax Increment Financing Districts to assist in the financing of the public improvements and other public costs necessary to attract and retain new development in the Development District. 4 . That implementation of Development District No. 1 and construction of public facilities and other public improvements through tax increment financing has attracted new commercial and industrial development to the Development District. 5 . That there is a demand within the City for further business and industrial development, including development in areas of the City not presently included in Development District No. 1. 6 . That additional business and industrial development in many areas of the City designated for business and industrial use is not possible absent city assistance in addition to the installation of certain public improvements . f 7 . That the high cost of constructing required public 4,1 improvements and facilities, and providing other forms of assistance for new development, cannot be met, and additional business and industrial development is therefore not possible, without public intervention. 8 . That it is necessary to expand Development District No. 1 and to adopt the proposed amendments to the Development Program for Development District No. 1 in order to continue providing assistance for new development. 9 . That the proposed amendments to the Development Program prepared by City staff and consultants adequately and accurately set forth the required amendments to the Development Program. 10 . That the Planning Commission for the City of Elk River has been consulted with respect to the amended Development Program and expansion of the Development District. 11. That the amended Development Program is consistent with the City's Comprehensive Land Use Plan. 12 . That notice of a public hearing on the amended Development Program has been published in the official newspaper of the City as required by Minnesota Statutes . • 13 . That a public hearing on the proposed amended Development Program was held before the Economic Development Authority on February 12, 1990, and that an opportunity to be heard was granted at that time to all residents of the City and all other interested person. 14 . That it is therefore necessary, desirable and in the public interest to amend the Development Program for Development District No. 1 and to expand Development District No. 1 as set forth in the amended Development Program. RESOLVED A. That the Economic Development Authority for the City of Elk River hereby adopts each and every one of the findings set forth above. B. That the Economic Development Authority for the City of Elk River hereby adopts the proposed amendments to the Development Program for Development District No. 1 and readopts in its entirety the Development Program for Development District No. 1 and readopts in its entirety the Development Program for Development District No. 1, as amended, as of this date. C. That the Economic Development Authority for the City • of Elk River hereby expands the area of Development District 2 . No. 1 as provided for in the amended Development Program 411 adopted this date. D. That the Economic Development Authority for the City of Elk River hereby designates the Executive Director as the administrator for Development District No. 1 and directs the Executive Director to proceed to take all steps necessary to implement the expanded Development District No. 1 and amended Development Program for Development District No. 1. • 410 3 .
