Background/Discussion

The applicant is seeking an ordinance amendment allowing two menu boards in drive-thru lanes.
Currently one menu-board per drive-up is allowed in the following districts:
■ Central Business District (Cl)
■ Highway Commercial (C3)
■ Mixed Use Elk River Plaza District (MU-ERP)
■ Extreme Commercial Recreation (XCR)
The applicant believes not allowing the use of a pre-order station creates delays at the primary order
station,which during peak hours can contribute to vehicle back-ups and longer customer wait times.
This negative impact, the applicant feels, could be alleviated by providing a pre-order board to allow
customers the opportunity to review the menu choices prior to reaching the order station.
Providing a pre-order menu board has become the industry standard, and is not limited to Panera Bread
(applicant) drive-thru designs. Many fast-food and quick service restaurants incorporate a pre-order
menu board for the reasons stated above. There are several businesses in the city that have pre-order
menu boards but these typically are within a Planned Unit Development and are typically smaller than the
menu board.
The applicant is proposing to add the following language:
One on premise pre-order board per drive thru lane up to a maximum of 32 square feet. Pre-order boards are allon)ed to
have a message on one side onjand may not contain advertising. Pre-order boards shall not have a speaker or
communication system installed.
Staff supports amending the ordinance to allow one pre-order menu board. However staff recommends
that the proposed square footage be reduced from 32 square feet to 20 square feet. This is consistent
with existing pre-menu boards previously approved as part of a handful of Planned Unit Developments.

any comments from the public. The Planning Commission discussed how the request is consistent with
the industry and agreed that pre-menu boards should be smaller than the primary menu boards. They
unanimously recommended approval of a 20-square foot pre-menu board.

Proposed Language

permitted on any facade that is not directly adjacent to a residential zone. Businesses in
multi-tenant facilities shall be allowed their proportionate share of permitted wall sign area.
For the purposes of this section a road shall constitute a separation of zones.
(2) One freestanding sign,not to exceed 64 square feet in sign area with a maximum height of
20 feet.
(3) Area identification signs as permitted in section 30-865.
(4) The sign area of freestanding signs may be increased by 25 percent if the sign is constructed
as a monument sign.
(5) One on-premises menu board per drive-up or walk-up lane of a drive-in restaurant or
carwash up to a maximum of 32 square feet each. Menu boards are allowed to have a
message on one side only and may not contain an advertising message.
(6) One on-premise pre-order board per drive thru lane up to a maximum of 20 square
feet. Pre-order boards are allowed to have a message on one side only and may not

River Code of Ordinances shall be amended to read as follows:
(e) Signage.
(1) Temporary signs as permitted in section 30-851 et seq.
(2) Permanent signs.
a. Two permanent area identification signs per neighborhood, subdivision, or development,
one not to exceed 64 square feet with a maximum height of 20 feet, the second not to
exceed 50 square feet with a maximum height of 12 feet. The area identification signs
shall be located on the same premises as the development they identify.
b. One freestanding sign,not to exceed 100 square feet along collector street or 150 feet
along arterial street.
c. Max height of ten feet along collector street or 30 feet along arterial street.
d. Two wall signs, not to exceed 200 total square feet per occupancy.
e. One on-premises menu board per drive-up or walk-up lane of a drive-in restaurant or
carwash up to a maximum of 32 square feet each. Menu boards are allowed to have a
message on one side only and may not contain an advertising message.
f. One on-premise pre-order board per drive thru lane up to a maximum of 20
square feet. Pre-order boards are allowed to have a message on one side only and
may not contain advertising. Pre-order boards shall not have a speaker or
