SR 05-16-2016 Request for Action To Item Number Mayor and City Council 4.5 Agenda Section Meeting Date Prepared by ConsentMay 16, 2016Jessica Miller, Executive Secretary/Deputy City Clerk Item Description Reviewed by Transient Merchant License: Tony’s Dogs Tina Allard, City Clerk Reviewed by Cal Portner, City Administrator Action Requested Approve, by motion, a transient merchant license for Camilo Antonio Vega, dba Tony’s Dogs, to operate a hot dog cart in front of Menards, 19521 Evans Street NW, Thursdays, Fridays, Saturdays, and every- other Sunday July 1 - October 31, 2016. 1.One 24-square foot sign shall be allowed. A temporary sign permit must be obtained prior to display of the sign. Contact the Planning Department at 763.635.1000. 2.The merchandise displayed shall not occupy more than 100 square feet \[Section 38-414(6)\]. 3.Applicant must remain on the asphalt surface and no product shall be displayed in the grassy areas. 4.No electrical services shall be across any drive or walking surface. 5.If traffic becomes a problem around the temporary site, the sales area shall be delineated with a barrier to restrict traffic. 6.The area shall be maintained free of debris and kept in an orderly condition. 7.Only one cart/trailer shall be utilized. 8.The cart/trailer shall not be left on site overnight. Background/Discussion Mr. Vega applied for a transient merchant license to operate a hot dog cart selling hot dogs, brats, pop, chips, water, and nachos from the Menards store located at 19521 Evans St NW. He has written permission from the property owner, paid all applicable fees, and successfully cleared a Police Department background investigation. City code limits the duration of transient sales to 30 days, unless a longer period is approved by City Council. Mr. Vega is requesting to sell hot dogs Thursdays, Fridays, Saturdays, and every other Sunday July – October, weather permitting, for a total of approximately 50 days.
