SR 05-16-2016 Request for Action To Item Number Mayor and City Council 4.16 Agenda Section Meeting Date Prepared by ConsentMay 16, 2016Justin Femrite, City Engineer Item Description Reviewed by Approve Petition Waiver and Agreement for Sewer Amanda Othoudt, ED Director and Water Connection Reviewed by Cal Portner, City Administrator Action Requested Approve, by motion, the attached Petition, Waiver and Agreement Background/Discussion Council is asked to consider the approval of the attached Petition, Waiver and Agreement submitted by the owners of Die-Concepts. The petition includes a request to have the Sewer Access Charge (SAC) and Water Access Charge (WAC) associated with the connections of the building at 18498 Twin Lakes Road, assessed over a term of three years. Staff began discussions with the applicant about the opportunity to have these costs assessed in the fall of 2015. Since that time, the applicant has been working on environmental reviews and planning for their improvements to the property which includes connections to the public systems. Since the applicant was not the fee owner of the property until April 27, 2016, they could not complete the application before the original program sunset on December 31, 2015. Staff feels it in within the spirit of the original program to approve the Petition, Waiver, and Agreement as submitted to allow for the assessment of these costs. The applicant will be paying their contractor’s costs for physically making the connection so that is not included in their request. Financial Impact There are no costs associated with this action. The revenue associated with this assessment will come in over the next three years with interest accruing at 2.5%. Attachments  Petition, Waiver, and Agreement
