Action Requested
Recommend,by motion,approval of the Conditional Use Permit request to operate a commercial
recreational indoor facility in the Mixed Use—Elk River Plaza district,with the following conditions:
1. The Conditional Use Permit shall not be recorded until all conditions have been completed.
2. As indicated on the site plan,parking stalls shall be striped to the dimensional requirements set
forth in Section 30-892.
3. The city's Building Official and Fire Marshal shall inspect the building to verify compliance with
all state and local building codes.
Background/Discussion
The subject property is located within the Mixed Use—Elk River Plaza (MU-ERP) district. The MU-ERP
district identifies indoor commercial recreational facility uses as a conditional use,requiring a Conditional
Use Permit (CUP) application and approval from both the Planning Commission and the City Council.
GA Wellness 365,LLC/Club GA is currently operating a fitness facility (Gym 365) at 518 Freeport.Their
business offers access to the fitness facility 24 hours a day by key card for all members. Gym 365 was
originally located in the Marcus theater building since 1998 and relocated to its current location. Gym 365
has been operating at 518 Freeport since May of 2010.
Building
There are no proposed changes to the exterior or interior of the building or site.
Signage
There are no proposed changes to the existing signage at the site.
Parking
The fitness facility occupies 8,000 square feet and requires 40 parking spaces per city ordinance (1 space
per 200 square feet of floor area). The parking lot in front of and to the east of the facility is adequately
sized to accommodate the required parking for the proposed use and all other uses in the development.
Hours of Operation
Thi facility will be open to members 24 hours a day seven (7) days a week.

NATURE
Employees
The applicant is not proposing to hire any additional employees. The business will be operated by the
owners during the work day Monday through Friday.
Applicable Regulation
Conditional Use Permit
The issuance of a Conditional Use Permit can be ordered only if the use at the proposed location:
1. Will not endanger, injure or detrimentally affect the use and enjoyment of other property in the immediate
vicinity or the public health, safey, morals, comfort, convenience or general welfare of the neighborhood or the ciy.
The proposed use will not detrimentally affect nearby property as the use fits with the intended
use of the development and is surrounded by other commercial establishments.
2. Will be consistent with the comprehensive plan.
The use is consistent with the Comprehensive Plan as commercial recreation facility uses are
allowed in Highway Business land use.
3. Will not impede the normal and orderly development and improvement of surrounding vacantpropery.
The surrounding area is nearly fully developed, and the proposed use will not affect the
remaining vacant lots.
4. Will be served adequately by and will not adversely affect essential public facilities and services including
streets,police and fire protection, drainage, refuse disposal, water and sewer systems,parks and schools;and
will not, in particular, create traffic congestion or interference with traffic on adjacent and neighboring public
thoroughfares.
The facility will be served by city services. There does not appear to be any other potential
impacts to public facilities or services.
5. Will not involve uses, activities,processes, materials, equipment and conditions of operation that will be
detrimental to any persons or property because of excessive traffic, noise, smoke,fumes,glare, odors, dust or
vibrations.
The proposed use does not involve hazardous materials or activities that may detrimentally
affect nearby properties or residents.
6. Will not result in the destruction, loss or damage of a natural, scenic or historic feature of major importance.
The facility will be locating in an existing building and the proposal does not include exterior
site modifications that may damage natural or historic features in the area.
7. Will fully comply with all other requirements of this Code, including any applicable requirements and
standards for the issuance of a license or permit to establish and operate the proposed use in the dty.
The applicant is required to comply with all other sections of the code and must apply for all
required building permits in addition to the Conditional Use Permit.
If denial of such a permit should occur,it shall accompany recommendations or determinations by
findings or a report stating how the proposed use does not comply with the standards set forth in Section
30-654.

In the review of the standards for CUP as outlined,it appears that the request is consistent with all of
these standards.
Statutory Review Period
Per State Statute 15.99 the required 60 day review period ends on June 25, 2016.
Council Meeting
If acted on, this item will go to the June 6, 2016, City Council meeting.

Narrative for Gvm 365 /Club GA/ GA Wellness 365, LLC CUP Application
The purpose of this request is to memorialize for the record and with a conditional use
permit as required for the currently existing and continuing operation of the
Athletic/Health Club facility business known as GYM 365. The GYM 365 was
originally located in the Marcus theater bldg since on or about 1998 and subsequently
relocated to the 518 Freeport building starting on or about May 2010.
The business is available for access by Members 24 hours a day by key card access and
is staffed by the Owners during the work day Monday through Friday. The usual and
customary staff levels are one to two people on any given day.
The business occupies 8,000 square feet of the building with the other portion of the
property occupied by Flowers Plus. There is ample parking with over 60 currently
existing parking stalls. It is not proposed to change any of the currently existing, (since
2010), characteristics of the premises in regards to screening, landscaping, signage, or
other improvements to the building interior, exterior, or grounds. There is no outdoor
storage at the property.
