Existinr Conditions
The subject property is located in the northeast comer of the intersection of Upland and
Tipton Avenues. u.s. Trunk Highway 10 also borders the property on the north. The
easterly 40 percent of the site is wooded. Located on the subject property is a one-story
home (encroaches into the front yard setback), a two-car garage, and a shed which is within
the Highway 10 right-of-way. The is encircled by a chain link fence, a portion of which is
also located within the Highway 10 right of way.
Analysis
The applicant is proposing to subdivide the parcel in two. The first parcel, Lot 1, will be
utilized for the existing house and garage; the second will be vacant and will be buildable.
Each lot meets the minimum lot width and lot area requirements for the R1 c District. The
stucco shed should be either removed in its entirety or relocated to be out of the Highway
10 right-of-way.
The City Engineer's memo addresses grading, drainage and other related issues including the
contemplated pavement management project in this area.
The Parks and Recreation Commission recommended cash dedication for one lot.
Recommendation
Staff recommends that the City Council approve the request to split the subject parcel into
two lots with the following conditions:
I. THE STUCCO SHED SHALL BE REMOVED ENTIRELY OR
RELOCATED TO COMPLY WITH THE SETBACK REQUIREMENTS
OF THE RIC DISTRICT.
2. PARK DEDICATION SHALL BE PAID FOR ONE LOT.
3. SURFACE WATER MANAGEMENT FEES SHALL BE PAID FOR
ONE LOT.
4. THE PLAT SHALL SHOW RESTRICTED ACCESS ALONG
HIGHWAY 10.
S. ALL OTHER COMMENTS OF THE CITY ENGINEER SHALL BE
ADDRESSED.

Dear Ms. McPherson:
As requested, we have reviewed the submittal information for the proposed Tipton Woods
Addition. Based on our review and comments received at the staff review meeting, we
would offer the following comments:
1. The submittal information consisted of a preliminaty and a final plat prepared by John
Oliver & Associates. The preliminaty plat was dated October 21,2004. The proposed
plat subdivides one existing single-family lot located on the northeast comer of Tipton
Avenue and Upland Avenue to create one additional single-family lot. Both lots appear
to meet all of the dimensional regulations required by the Gty Ordinance.
2. The final plat should provide limited access along the TH 10 frontage and Upland
Avenue frontage.
3. The westerly of the two lots contains the existing homesite with a house and a detached
garage. There is an existing shed that falls on the newly created Lot 2. It should be a
condition of the approval of the plat that this shed will need to be relocated or removed.
4. When construction takes place on Lot 2, they should attempt to keep the driveway
located as far to the west as possible to avoid conflicting traffic movements with Tipton
Avenue as it comes from the south and makes a 90 degree turn heading west.
5. sanitaty sewer and water services for the newly created lot will need to be constructed
from the existing facilities in Tipton Avenue.

6. It should be noted that the City Council is currenrly considering a street reconstruction
project in this general area, which could result in assessments to both of the newly
created lots.
