Don Stutesman, Project Manager for Kraus-Anderson Construction Company, will be at this
City Council meeting to discuss the conclusion of the Public Safety building project and to
review a repayment request for remporary fencing.
As I understand the situation, all of the payment requests have been frnalized and submitted
to the Finance Department. The one slightly unusual request, because of the timing, is the
reimbursement for the remporary fencing. Attached is a letter dated November 1, 2004,
from Don Stutesman regarding this requesr. The request relates to an actual expenditure
incurred by Kraus-Anderson that typically is the expense of the owner and part of the
bidding process; however, the timing and sequence of events necessitated Kraus-Anderson
taking the lead for the city and having this fencing installed. In discussing this request with
Chief Beahen, I was reminded that this situation had to do with securing the site (equipment
and the hole for the building project) prior to the Independence Day celebration and the
County Fair.
The Public Safety project alone was challenging but it was even more so difficult when this
project is combined with the Utilities building and the City Hall remodeling. The city started
the master planning for this entire project in late 2001 with construction of the Public Safety
building beginning in 2002. Substantial completion was achieved in 2003 and frnal
completion has now been achieved. The City Hall remodeling started in mid-2003 and we
moved in at the end of March. The project will not be 100% completed until 2005.

Dear Pat:
This letter is a follow up to our telephone conversation of October 26, 2004, in regards to the
above referenced project. In that conversation, I indicated that Kraus-Anderson had installed the
temporary construction fence around the project at the beginning of construction. It was the
original intent that the temporary construction fencing would be part of the fencing bid package.
As you are aware, the fencing bid package was not contracted at the beginning of the project due
to the fact that the design of the fencing had not yet been completed.
Therefore, Kraus-Anderson went ahead with installation of the temporary fencing around the
project. The cost that we have incurred for this work is $10,557. This work was done by Keller
Fence company and includes the cost for initial installation, subsequent modifications as the
project progressed and the final removal of the fencing upon completion of the project.
Our next construction billing for the above referenced project will include this amount.

Attached are pay estimates for the Public Safety and City Hall builcling projects. These pay
estimates have been reviewed and approved by Kraus-Anderson and Tushie Montgomery.
The Public Safety pay estimate submitted for approval is a final pay estimate. Retainage will
be released on all contracts with approval of this pay estimate. The pay estimate also includes
adclitional payments to Kraus-Anderson Construction for reimbursement of several project
expenses paid clirectly by Kraus-Anderson as follows: $10,551.67 for temporary fencing that
was not included in the fence contract; $1,203.00 to reupholster acoustical panels to address
the sound problem in the hard interview room; $15,623.65 for millwork to replace damaged
cabinets in the EOC. This payment was offset by a previous change order to reduce Collins
Electric contract by $15,623.65.
It is my understancling that all of the punch list items have been addressed and that all
builcling, electrical, mechanical, and landscaping requirements have been met and certificates
of completion/ occupancy have been issued for the Public Safety Builcling.
Finally, the City Council withheld payment from Kraus-Anderson in July on both builcling
projects pencling completion of the projects. A total of $25,628.00 was held of which
$14,784.00 was for the Public Safety Project. Since the Public Safety project is now complete,
the Council will need to take action on releasing payment to Kraus-Anderson.

Action Requested
The City Council is asked to consider the fmal pay estimate for the Public Safety Builcling
project inclucling the adclitional payments to Kraus-Anderson and to approve the City Hall
pay estimate as stated above. The Council is also asked to consider release of payment of
$14,784.00 to Kraus-Anderson for the Public Safety Project.
