Park/Miske Meadows subdivisions.
Background/Discussion
Paxmar is proposing to continue the River Park Development with the 4th Addition. The plat includes
55 single-family homes and proposes 4.02 acres of park land. This is anticipated to be combined with
2.07 acers from the Miske Meadows development directly to the east, creating a proposed 6.09 acre park.
Park Area
The proposed River Park 4th Addition now directly impacts the proposed park land,which results in the
need to look more closely at the proposed park area. Park dedication for the original River Park
development platted in 2004 was approved to be a combination of land (4.7 acres, as shown on the
exhibit titled"2004 Preliminary Plat") and cash. At this time,the city has not received any of the
dedicated 4.7 acres of land located at the south end of the overall development. Land and cash will
continue to be collected as phases are developed. With future development of the property to the south
of this area,additional land is anticipated to be obtained to create a larger overall park.
The River Park 4th Addition proposed park area deviates from the 2004 preliminary plat. On the 2004
preliminary plat, the development provided more public street frontage (Ivanhoe and 187th Lane) for the
park. This can be seen on the exhibit titled"2004 Preliminary Plat". The 2004 preliminary park was
more rectilinear in shape compared to what is being proposed in today's application. The proposed park
area today now has approximately 1.1 additional acres that extends north behind approximately one
dozen homes. The applicant indicated the additional park area allows for variations in facilities and to
accommodate the ponding that the park design will cause. It is unclear to staff what facilities and
ponding will be accommodated. A common issue the city has dealt with in regards to pockets of park
land located directly behind homes is backyard creep,which occurs with home owners slowly expanding
their landscaping into the park.
The finished grading of the current proposed park and the surrounding property has not been defined
with any certainty at this time.

Staff recommends the commission evaluate this area and determine if the additional land and
configuration meets the Parks and Recreation Master Plan. An exhibit is included,with various ballfields,
showing the scale of the proposed park area. This exhibit is not intended to be a proposed design.
Park Dedication
In determining if the proposed land is suitable for dedication, Section 30-327 needs to be referred to,
which states:
(h) Criteria for determining suitability of land. The suitability of land proposed to be dedicated for park and recreational
purposes shall be determined by reference to the following criteria:
(1) Whether the land is reasonably located and suited for its intended use. Staff believes it is.
(2) Whether the land has frontage on public or private roads as determined by the city. Staff questions if
adequate parking will be available, as proposed, for a park that will eventually be 8-10 acres
in size?
(3) Si<e, shape, topography,geology, hydrology, tree cover, access, and location. Unless specific park uses
are identified,irregular shaped parcels can be difficult to plan for. How will this proposed
parcel, the anticipated park parcel to the east and the anticipated park parcel to the south
work together topographically?Does the additional land meet the Parks and Recreation
Master Plan?
(4) Consistency with the goals and objectives of the master park and recreation plan. Staff believes it is.
Powerline Corridor
The Parks &Recreation Commission made a recommendation at their February 10,2016 meeting to
accept park dedication in the form of both land and cash, not including land beneath power lines. Since
this meeting,the applicant stated to staff the commission only reviewed and commented on the Miske
Proposal and not a merged corridor. Staff told the applicant when the Miske Proposal (corridor)was
reviewed,it was understood that the corridor would extend to Ivanhoe Street,if not beyond,and would
not dead end in the back of future residential lots. The applicant now believes,with this fourth addition
actually touching the public realm of Ivanhoe Street,is a more fair discussion can be had to review what
percentage of the corridor is fair for consideration as a linear park. Staff anticipates the use of a powerline
corridor to be limited as no structures or trees can be placed under them. The applicant has suggested
that a trail,bird watching,and sledding can occur under the powerline.
It was questioned at the February 10,2016 meeting if park dedication credit can be given to the
installation of trials. Section 30-327 states:
j') Credit for construction of recreational facilities. Park dedication credit shall not be granted for the construction of
recreational facilities unless specifically approved by the city council. The submission for review by staff and the park and
recreation commission shall include an estimate of installation costs, equipment specifications and a site plan. The park
and recreation commission shall review such improvements for appropriateness with the park and trail master plan.
The applicant would like to not have a resolution other than the power line corridor should be examined
for the fair value to both. Due to the number and size of wetlands in the area,the surrounding developed
land, and a park corridor is not identified in the Parks and Recreation Master Plan. Staff recommends
that property beneath the power lines not be counted towards park dedication. However, staff does agree

that there is some benefit for pedestrian circulation within the development but does not see the overall
Parks and Recreation benefit.
As the applicant does not want to maintain the property, the commission recommended, on February 10,
2016, to accept the property beneath the power line,with the requirement that a trail be installed by the
applicant. Neither the land under the powerlines nor the trail would count towards park dedication
requirements. Section 30-327 states:
(z) Improvements to dedicated land. As part of the subdivision or plat approval, the tract owner shall be reiponsible for
making certain improvements to land dedicated for park, trail and public open space purposes, including, but not
limited to,finish grading,ground cover, construction of trails and clearly identifying park and trail boundaries with
city-approved markers.
