Background/Discussion
Case No. P 16-06 & CU 16-16
At the June 20, 2016, City Council meeting, the applicant expressed concerns about dedicating right-of-
way for the future extension of Business Center Drive. Specific concerns include financial impacts from
future assessments and the buildable area of the outlot south of the billboard parcel. The applicant stated
that they had not seen the right-of-way request until the Wednesday prior to the meeting (June 15, 2016),
and requested additional time to review the request. The City Council closed the public hearing and
continued the discussion to July 18, 2016, per the applicant’s request. City staff would like to note the
applicant received notice of the request for right-of-way dedication on June 1, 2016.
Staff and the applicant met shortly after the June 20, 2016, Council meeting to discuss their concerns and
continue to work together to identify options and clarify the request.
However, since that meeting, the applicant reviewed their site and would like to amend their request. The
changes include moving the billboard to a new location on the property, which requires additional review
by the Planning Commission. To accommodate the additional review on June 26, 2016, the applicant has
requested to continue the discussion to the August 15, 2016, City Council meeting.
Statutory Review Period
Per State Statute §15.99, the 60 day review period for the Conditional Use Permit was extended to August
23, 2016, and the 120-day review for the plat ends on August 23, 2016.
