Action Requested
Recommend,by motion,approval of the Preliminary Plat with the following condition:
1. Updated preliminary and final plats shall be provided showing right-of-way for Business Center
Drive and Highway 10.
Background/Discussion
The property is zoned Business Park (BP) and the applicant is seeking preliminary plat approval to
construct an addition and renovate the Sherburne County Government Center located at 13880 Business
Center Driver,Case No. CU 16-20.
Sherburne County has submitted an application to plat the Elk Path Business Center 5th Addition for
their government center expansion. The plat will consist of Lot 1 (32.13 acres), Oudot A (8.15 acres),
and Oudot B (33.89 acres).
The minimum lot size for lots in the BP district is one (1) acre with a minimum lot width of 100 feet.
The proposed plat meets these requirements.
A gravel access at County Road 30 through Outlot B is being considered. The actual construction of this
access will depend on the bids they receive for the entire project and the budget. Additional detailing of
driveway access to the south will be needed should that occur.
Analysis
Parks and Recreation
The Parks and Recreation Commission,on July 13,2016,recommended park dedication be paid for 8.65
acres at the rate applicable when the subdivision is released for recording. The current rate is 8%of the
county assessed value. ($60,286)
Applicable Regulation
Approval of a plat may only"be ordered if the following findings have been made,as outlined in Section
30-375:

NATURE
(1) The proposed subdivision is consistent with the zoning regulations(article VI of this chapter)and conforms in
all respects with all requirements of this Code, including the zoning regulations and this article.
The property is zoned Business Park (BP) and the proposed subdivision is consistent with the
zoning regulations outlined in the city code and approved plans.
(2) The proposed subdivision is consistent with all applicable general and specialized ci y, county, and regional
plans, including, but not limited to, the city's comprehensive development plan.
The proposed subdivision does not conflict with any city, county, or regional plans,including
the Comprehensive Plan.
(3) The physical characteristics of the site, including but not limited to topography, soils, vegetation, susceptibility to
erosion and siltation, susceptibility to flooding and drainage are suitable for the type and density of development
and uses contemplated.
The site is suitable for the proposed development.
(4) The proposed subdivision makes adequate provision for water supply, storm drainage, sewage transportation,
erosion control and all other services,facilities and improvements otherwise required in this article.
The subdivision has adequate provision for all of these facilities.
(5) The proposed subdivision will not cause substantial environmental damage.
The proposed subdivision will not cause substantial environmental damage.
(6) The proposed subdivision will not conflict with easements of record or with easements established by judgment of
a court.
The existing easements are being vacated and new easements will be established. The
subdivision will not conflict with easements of record.
(7) The proposed subdivision will not have an undue and adverse impact on the reasonable development of
neighboring land.
The properties to the east are developed. The property to the west and south are owned by
the applicant. Highway 10 is north of the subject property. The proposed subdivision will
not have an undue and adverse impact on the reasonable development of neighboring land.
(8) The proposed subdivision is not premature.A subdivision is premature ifanj of the following exists:
a. Lack of adequate stormwater drainage.
b. Lack of adequate roads.
c. Lack of adequate sanitary sewer ystems.
d. Lack of adequate off-site public improvements or support ystems.
All of the above services or improvements will be connected or constructed as part of the
development. The area is within the municipal service area and existing facilities can
handle the additional capacity.

The project is consistent with all required findings for approval of the Preliminary Plat.
If denial of the plat should occur,it shall accompany recommendations or determinations by findings or a
report stating how the proposed use does not comply with the standards set forth in Section 30-375.

Statutory Review Period
Per State Statute 15.99 the required 120 day review period ends on October 25, 2016.
Council Meeting
If acted on, this item will go to the August 15, 2016, City Council meeting.
