Action Requested
Recommend,by motion, approval of the Conditional Use Permit with the following conditions:
1. The authorized Conditional Use Permit shall not be recorded until all conditions have been
completed.

3. The applicant must apply for and receive approval for all required permits before any
construction may begin.
4. Elk Path Business Center 5th Addition shall be platted prior to releasing the CUP for recording.
5. All utility equipment shall meet the standards set forth in Section 30-1294 (e)(3).
6. Sanitary sewer modifications shall provide for grinding of all illegal discharges from the subject
property.
7. All comments in the Environmental Memo dated July 1,2016 shall be addressed.

Background/Discussion
The property is zoned Business Park (BP) and the applicant is seeking a Conditional Use Permit (CUP) to
construct an addition and renovate the Sherburne County Government Center located at 13880 Business
Center Driver,Case No. CU 16-20.
As part of this application, the applicant has submitted an application to plat the Elk Path Business
Center 5th Addition for their government center expansion. The plat will consist of Lot 1 (32.13 acres),
Outlot A (8.15 acres),and Oudot B (33.89 acres).
Analysis
Comprehensive Plan
The subject property has a land use designation of industrial with a zoning of BP. The proposed use is
consistent with both the comprehensive plan as well as the zoning district.
Transportation/Circulation
An additional access point is being proposed onto Business Center Drive west of the existing public
access. When the project is complete, the existing public access will become an exit only. Staff is

requesting signage and striping to clearly define the access as exit only to prevent vehicles entering the site
at that location.
A gravel road through Outlot B and an access at County Road 30 are being considered. The actual
construction of these will depend on the bids received for the entire project and their budget. Additional
detailing of driveway access to the south will be needed should that occur.
Utilities
The property/project is served adequately by public facilities including water and sewer systems.
The city has requested details of sanitary sewer modifications that will provide for grinding of all illegal
discharges currently being conveyed from this property. Please see the letter from Eric West,dated July
15, 2016,in response to this request.

Building Materials
The materials of the addition will complement the existing building and will consist of brick to match the
existing, metal panel,and glass. The proposed design meets the BP design standards.
There will be one mechanical unit on the roof of the second level addition. The mechanical unit will be
screened along the North facade and the addition will help screen the other sides from the main entry.
All utility equipment (rooftop and ground units) shall meet the standards set forth in Section 30-1294 (e)

Tree Requirements
The total number of required new trees may be offset by the retention of existing trees on the lot
provided that such trees satisfy the requirements of this section as to size and species. Existing trees
between four inches in diameter and less than eight inches in diameter will receive credit for one tree.
Existing trees eight inches or greater in diameter will receive credit for two trees.
There are numerous trees abutting the subject property on the north and south sides but these trees are
not located on the subject property and therefore cannot be counted towards the tree credit.
Per ordinance, 145 trees are required for the subject property. Staff visited the site and determined they
can receive credit for 18 trees leaving the need for 127 additional trees to satisfy the landscaping
requirements. The following trees will be required:
• 55 Overstory
• 36 Ornamental
• 36 Coniferous
Applicable Regulation
The issuance of a Conditional Use Permit can be ordered only if the use at the proposed location:
1. Will not endanger, injure or detrimentally affect the use and enjoyment of other property in the immediate
vicinity or the public health, safety, morals, comfort, convenience or general welfare of the neighborhood or the city.

Project Narrative June 27, 2016 Sherburne County Government Center Addition and
Renovation
The Sherburne County Government Center was originally constructed in 1978 with expansions in
1988, 1994, 1997,2000 and most recently 2004. The older portions of the facility's infrastructure
(boilers, cooling, etc.) are beyond their useful lifespans and are no longer able to be properly
serviced or controlled. Replacement of old equipment and components,repairs to serviceable
equipment and components, system back-up, and an overall control system is an integral part of the
construction project. These improvements will improve the ability of the Government Center to
operate efficiently,reliably, and serve the County into the future.
There is also a demand for increased services. Recently, the County was named the 11th fastest
growing county in the State and this rapid growth has led to the need for additional space in several
departments - especially crucial in the public safety and human services departments. An in-depth
analysis of current and future department requirements informs the proposed configuration so that
it meets County needs through 2027 to house xxx employees. This includes space for agency
partners to improve the County's ability to provide services in a cost effective and convenient
manner.
Due to the limitations within the current building, the existing courts facilities present significant
circulation, security, accessibility, and technological challenges. Courtroom size, support areas,and
configuration impede the ability of the Courts to meet the needs of the County and Judiciary,as well
as prohibit routine utilization of current information systems employed by the Minnesota Judicial
Branch. Moving court functions to a new building addition best addresses these issues for citizens,
staff and judges.
The proposal for the site is to include a new main entry to the site from the Western portion of the
parcel along Business Center Drive. The existing entry to the site will become an"exit only"in
order to help serve the elevated exiting of car traffic at key times of the day. The site work is adding
parking on-site to accommodate the additional square footage of the addition. The design team has
calculated parking requirements based on the programmatic requirements of each individual
program use within the new and existing building. These calculations, confirmed with City staff,
indicate that 960 stalls are required. The submitted plans call for a total on-site parking of 969 stalls.
The 99,250 SF addition is proposed to house 5 new courtrooms, 2 potential future courtrooms, and
a variety of administrative and public spaces associated to serve the courtrooms. The West facade
of the addition will introduce a new public entry to the Sherburne County Government Center.
The materials of the addition are meant to work with and complement the existing building. The
exterior materials consist of brick to match the existing, metal panel, and glass. There will be one
mechanical unit on the roof of the second level addition. The intent is that this mechanical unit will
be screened along the North facade and the addition will help screen the other sides from the main
entry.
There are two exterior signs proposed. One lit monument sign at the entrance to the site off of
Business Center Drive. The location and size are indicated on the submitted plans. The second
monument sign will be located at the building entry. There are no proposed outdoor storage areas.
Hours of operation and number of employees are not changing as part of this project.

Thanks you for reviewing our applications for Preliminary Plat, Final Plat and Conditional Use Permit for the renovation
and expansion of the Sherburne County Government Center.
We offer the following in responses to the comments identified in your letter dated July 8,2016.Below we have included
the comment in regular script and our response in italics.
Engineering
1. The existing 40-feet of side,east of the current main entrance on Business Center Drive,should be removed and
replaced to continue a straight running line along the street.
Response:The sidewalk plan will revised accordingly.
2. ADA compliant pedestrian ramps meeting MnDOT standards with red truncated domes must be installed at the
current and new driveway entrance location.
Response:Additional pedestrian ramp details will be added at those locations and the City detail will be replaced
with the MnDOT standard plate.
3. Please identify the signing and striping that will complete the exit only conversion at the main entrance.
Response:Signing and striping will be added at that location in the plans to better communicate that is an exit only.
4. Provide detail of sanitary sewer modifications that will provide for grinding of all illegal discharges currently
being conveyed from this property.
Response:The County's building expansion and renovation project have nothing to do with the jail's housing units.
At the same time,several steps have been put in place over the years to prevent and/or intercept items from
entering the sanitary sewer system from the jail.
a. Recently the County jail and maintenance staff installed a'hook'system inside the pipes that catch most if not
all clothing such as towels,sheets,socks or t-shirts being flushed. These hooks have been installed behind every
cell in the facility.
b. In 2010 the County discontinued specific commissary products for inmates in special housing,items such as
potato chips, thus eliminating the foil type packaging and other similar foil type wrappers or packaging related
to commissary items. This type of packaging was a concern to the city at that time.
c. In 2013 we developed a plan for water shutoff before each shakedown. A shakedown is a surprise/random
search of each inmate's cell. Once the shakedown starts and inmates become aware of the shakedown, we
didn't wont them to have the opportunity to try and flush anything down the toilet prior to search searching
each jail cell. Being caught with extra issued items will trigger a loss of certain highly regarded privileges

within the jail.
d. Finally,Corrections Officers maintain a strict inventory of inmate's clothing and other items that are issued to
them. When items are issued,inmates exchange their items,one for one,meaning one pair of socks for one
pair of socks as an example. They should never have extra unaccounted for items issued to them-not to say it
never happens,but it shouldn't. This is managed by staff and directed by jail policy.
In summary,several measures have been put in place to stop the introduction of undesirable items entering the
sanitary sewer system. Therefore,the County doesn't plan on doing any sanitary sewer modifications.
5. Additional detailing of driveway access to the south will be needed should that alternative be selected.
Response:An enlarged plan will be added to 234.CG showing that access connection to Mississippi Road NW.
Stormwater
1. A MIDS report is needed.
Response:A MIDS report has been completed and will be provided to city staff the week of July 18.
2. Note that the project is within one mile of an impaired water; Lake Orono and within one mile of a special water;
Mississippi River.
Response:This information will be included in the SWPPP document once that is prepared after the Contractor is
selected and prior to work commencing.
3. A detailed maintenance schedule is needed for each of the permanent BMPs and who will be responsible.
Response:A draft maintenance document will be provided for City review prior to the start of construction. Once
approved the County will assume responsibility.
4. Add all required NPDES SWPP details.An issued NPDES permit is required before the project can start land
disturbing activity.
Response:Once selected,the Contractor will apply for the MPCA General Permit. The Civil Engineer will prepare the
SWPPP and include all required details and information.
5. Add required detail for the temporary sedimentation basin.
Response:Additional temporary sedimentation basin information will be on 235.CE. The Contractor will be
responsible for amending that basin,or any SWPPP BMP,if the site requires.
Building Materials
1. The building materials meet the requirements of Section 30-1294.
Response:No action required.
Environmental
1. Environmental staff suggests working with the Elk River Municipal Utilities and city staff to incorporate energy
efficient and sustainable design.
Response:The County and the design and construction teams are committed to sustainability. Conversations are
underway with Elk River Municipal Utilities and the project plans to participate in the Sherburne County landfill
abatement legacy grant.
Landscaping
1. Provide a detailed landscape plan indicating the types and quantities of plantings.
Response:Those drawings are attached in pdf form.
