Zonina/Land Use C3, Highway Commercial / HB, Highway Business Planning Commission / CU 04..35 November 23, 2004 Page 2 Standards for Issuance of a Conditional Use Permit The issuance of a Conditional Use Permit can be ordered only if the use at the proposed location: 1. Will not endanger, ill!ure or detrimentally affect the use and enjoyment of other property in the immediate vicinity or the public health, safety, morals, comftrt, convenience or general welfare of the neighborhood or the city. 2. Will be consistent with the comprehensive plan. 3. Will not impede the normal and orderly development and improvement of surrounding vacant property. 4. Will be served adequately by and will not adversely affect essential public facilities and services including streets, police and fire protection, drainage, refuse disposal, water and sewer systems, parks and schools; and will not, in particular, create traffic congestion or interference with traffic on adjacent and neighboring public thoroughfares. 5. Will not involve uses, activities, processes, materials, equipment and conditions of operation that will be detrimental to any persons or property because of excessive traffic, noise, smoke, fumes, glare, odors, dust or vibrations. 6. Will not result in the destruction, loss or damage of a natural, scenic or historic feature of major importance. 7. Will fully comply with all other requirements of this Code, including any applicable requirements and standards ftr the issuance of a license or permit to establish and operate the proposed use in the city. If denial of such a permit should occur, it shall accompany recommendations or determinations by findings or a report stating how the proposed use does not comply with the standards set forth in section 30-654. Overview The applicant would like use the building at 17323 Highway 10 as a private club with on-sale liquor. They will be utilizing the entire building, about 7,762 square feet. The building was formally occupied by the Back to the 50's Restaurant and a small quilting business. The building is located at the northeast corner of 173'" Avenue and Highway 10. The main floor will include a kitchen, dinning area and bar area. The basement will be used as meeting space and storage. No exterior alterations are proposed. The floor plan has seating for 112 and includes stage and dance floor. The parking lot has 63 spaces with two drive ways from 173,d A venue. The property is within the urban service area and is hooked up to city sewer and water. There were no concerns raised at the staff site plan review meeting. The applicant will have to work with the building and fire departments with regard to all building and fue codes. An on-sale liquor license will have to be applied for to the City Council. Using this ratio 61 parking spaces are required; 63 spaces are provided. The existing two driveways from 173'" Avenue will be used. Parking and access are adequate. Utilities The property is located within the Urban Service Area and is currently hooked up to city sewer and water. Landscaping There are currently two trees on site; the landscape requirement for this lot is 25 trees. Additional trees will be required. Because this is a developed site with an existing building and there are limitations on were trees can be planted, 10 new trees should be planted. Signage There are two existing freestanding signs, one on 173rrJ and one on Highway 10. Neither of the signs complies with the 10 foot setback requirement. The sign ordinance allows one freestanding sign. The sign on 173'd should be removed. If the applicant modifies the sign along Highway 10, other than just changing the face, the sign will have to be moved so that it complies with the setback requirement. Plannina Commission Meetina At the Planning Commission meeting held on November 23'd, no one spoke at the public hearing. The Commission did not express any concerns regarding this application and voted 7:0 to recommend approval. Recommendation The Planning Commission and staff recommend that the City Council approve the Conditional Use Permit to for a private club and on-sale liquor with the following conditions: 1. The freestanding sign along 173'" shall be removed. 2. If the applicant modifies the sign along Highway 10, other than just changing the face, the sign will have to be moved so that it complies with the setback requirement. 3. The applicant shall work with the building and fire departments with regard to all building and fire codes. 4. A revised landscape plan shall be provided. An additional 10 trees will be required. The trees shall be overstory trees that comply with the landscape ordinance. 5. The applicant shall apply for an on-sale liquor license. The Eagles Club is relocating to 17323 Highway 10 N.W. and had to reapply for a Club License and Sunday Liquor License. Background investigation checks are in the process of completion. ACTION REOUESTED Motion by Council to grant or deny the liquor license application of Fraternal Order of Eagles AEROE #3264 dba Eagles Club, 17323 Highway 10 N.W., for a Club License and Sunday Liquor License contingent upon satisfactory background investigation checks and approval by Police Chief Beahen. The Public Safety Liquor Control Division will issue these licenses upon approval.
