Standards for Issuance of a Conditional Use Permit
The issuance of a Conditional Use Permit can be ordered only if the use at the proposed
location:
,. Wi/I not endanger, injure or detrimentally ciffect the use and enjoyment if other property in the
immediate vicinity or the public health, safety, morals, comfort, convenience or general welfare if the
neighborhood or the city.
2. Will be consistent with the comprehensive plan.
3. Will not impede the normal and orderly development and improvement if surrounding vacant
property.
4. Will be served adequately by and will not adversely ciffect essential public facilities and services
including streets, police and fire protection, drainage, refuse disposal, water and sewer systems, parks
and schools; and will not, in particular, create traffic congestion or interference with traffic on
adjacent and neighboringpublic thoroughfares.
5. Will not involve uses, activities, processes, materials, equipment and conditions if operation that will
be detrimental to any persons or property because if excessive traffic, noise, smoke, fumes, glare,
odors, dust or vibrations.
6. Will not result in the destruction, loss or damage if a natural, scenic or historic feature if major
importance.
7. Will fully comply with all other requirements if this Code, including any applicable requirements
and standards for the issuance if a license or permit to establish and operate the proposed use in the
city.
If denial of such a permit should occur, it shall accompany recommendations or
determinations by findings or a report stating how the proposed use does not comply with
the standards set forth in section 30-654.
Overview
The applicant would like operate a middle school at 555 Railroad Drive. The location of the
proposed facility will be within an existing building located on the site. They are utilizing
three rooms in the building, two class rooms and an office, about 2200 square feet. The
portion of the building was formally used by a Montessori school. Classes will run from 8: 1 0
to 2:10 Monday - Friday. Currently only grade 7 is located at the site. Next year they plan to
add an 8" grade class and eventually add a 6" grade class. The entrance into the school is on
the east side of the building adjacent to the parking lot. There is a fenced playground area
located on the west side of the parking lot. The fenced area was installed as part of the
Montessori school. A basketball hoop may be installed but no playground equipment is
proposed. The bus drop-off and pick-up area is on the north side of the building along 3'"
Street.
Analysis
There were no concerns raised at the staff site plan review meeting. The applicant will have
to work with the building and fire departments with regard to all building and fire codes.

Parking is adequate. No external improvements are proposed. No signage is proposed at this
time. Future signs will have to comply with the sign orclinance.
Plannina Commission Meetina
At the Planning Commission meeting held on November 23"', no one spoke at the public
hearing. The Commission asked about traffic and number of students. Most of the students
will be bussed so traffic should not be an issue. There will be 20 students per class. When
the 8'h grade is added there will be a total of 40 students. If a 6'h grade class is added, it is
likely the school will have to lease additional space or find a new location. The school will be
using the 2nd classroom as gym space this year. When they add the 8'" grade, they will share
gym space with a neighboring school. The Commission also asked if the number of students
is regulated by the zoning code. The occupancy is regulated by the builcling code and the
school.
Recommendation
The Planning Commission and staff recommend that the City Council approve the
Conditional Use Permit to operate a middle school.
