Recommend,by motion,establishing October 31,2016, as the no later than date for the Downtown Rivers Edge Business Association group to respond to all staff questions regarding feasibility of placing a dock within Rivers Edge Commons. Background/Discussion The Rivers Edge Commons dock project was presented to the City Council by Annie Deckert and Fred McCoy as representatives of the Downtown Rivers Edge Business Association on April 4,2016, during work session. The group proposed installing a dock along the Mississippi River within Rivers Edge Commons as part of the expansion of the park. Council directed staff to assist the group as they develop a proposal. Additionally, council proposed the following questions: • Costs and staff time required for installing and removing the dock each year; • annual maintenance expenses; • location of storage during winter months; • where funds would be obtained for the purchase and maintenance of the dock. Staff met with Annie Deckert on May 10, 2016,and discussed the Council direction and proposed the following questions to be answered by the group: • Develop a design to meet ADA accessibility requirements: • Option 1 would be to construct an elevated ramp platform on concrete footings to minimize disturbance to the current shoreline; • Option 2 would be to construct a paved ramp along the shoreline;this option is less desired as it would require substantial disturbance to the shoreline. • Develop a maintenance plan to include installation and removal and determine if volunteers or staff would conduct these activities; • Conduct a survey to determine depth of water along the shoreline to include the ordinary high water mark to a minimum distance of 10 feet beyond the end of the proposed dock design to determine feasibility; • Propose design options describing the type of dock and ramp including materials type; • Develop construction documents for city review; • Provide a budget and funding source (Council indicated no city funding for the project); FI ■ EIEI 11 NATURE 1 , • Determine required permits. Staff received a response from the Downtown Rivers Edge Business Association on June 23, 2016, answering some of the questions proposed by staff and Council as well as potential designs. A follow-up meeting wasinducted on July 28, 2016 to further discuss the requirements of the project and information tart avgs required. It is understood that requiring ADA accessibility in this area adds substantial costs to the project. The DNR representative indicated that not all of their docks are ADA accessible,however they do state that they do have ADA accessible docks within the same geographic area. In this case,there will be no other ADA docks within the area. The Commission will need to determine and recommend whether or not to require an ADA-accessible dock. Upon Council direction on 4-14-16, you and I met on 5-10-16 to discuss our next steps. On 5-11-16, you provided several comments/recommendations; the purpose of this letter is to address some of those recommendations, and to submit three different dock options for your review and direction. Your support of the dock is appreciated and you indicated you would like to see the dock project executed in coordination with the River's Edge Commons expansion which begins 8-15-16, provided we address your comments. Your feedback on our proposed specifications will allow us to better define total project costs, while maximizing our time and supporting project efficiency. Our group will address your remaining comments upon your direction and feedback. Please see our initial comments below: • Any fishing dock installed in the park would need to be ADA accessible - T. Sevcik Considerable research and multiple discussions have been conducted to address the city's request for the dock to meet ADA regulations. Discussion with Trygve Hanson, Acquisition and Development Specialist for the DNR, Division of Parks and Trails on 5-11-16 concluded: "...the slope at the river bank makes meeting ADA requirements quite difficult. The site would probably require some form of switch back ramp and there might not be enough room to do that. Obviously the cost, if feasible, would be high. Due to the physical characteristics of many of our public water access sites it's not possible to meet ADA requirements or would be very cost prohibitive. Our policy is to try and provide this opportunity on sites that lend themselves to providing ADA accessibility... our goal is to have ADA opportunity within a geographic area but not necessarily on every site."-Mr. Hanson Discussions were also conducted to discuss dock specifications, pricing and ADA feasibility with Charlie Groetsch, MINNCOR's engineer and Doug Johnson, Account Manager on 5-24-16. Mr. Johnson indicated "the cost, if this site were to be made ADA accessible, would be extremely high." Mr. Groetsch concurred. In May of 2016, discussions with Paul Paige, Hoisington Koegler, also indicated that high costs may be used as a factor to determine ADA accessibility infeasible. Additional discussions with the DNR indicated that approximately one of every four public docks in the state are ADA accessible, and that often, "extremely high costs and location"justify and support ADA requirements being infeasible. . Based on our research and discussions with professionals in the field, we strongly recommend staff to recognize that providing an ADA compliant dock would be infeasible at this particular location. • Design options describing the type of dock and ramp to include materials type (aluminum, composite, wood, etc.) would need to be reviewed by city staff- T. Sevcik City staff has requested that a public dock located in downtown Elk River must be temporary. Attached are three temporary design options and estimated costs provided by MINNCOR: 1. 52-ft Custom Fishing Pier(1072100600): Cost estimate: $20,000- $23,000 2. "L" Pier Assembly (1078108600): Cost estimate: $16,000- $18,000 3. "T" Pier Assembly (1078104000): Cost estimate: $16,000- $18,000 Dock materials include sturdy 2" by 8" board construction, modular construction with treated pine deckinga and rails, steel parts that are hot-dip galvanized for long wear, rotation-molded with solid foam filled floats and rod mount holes. We are proposing temporary, aluminum stairs that are compliant with the DNR and MINNCOR. Estimated cost is $5,000.
