Background/Discussion
During the July 18, 2016, discussion of the Lake State Recycling Conditional Use Permit, the City Council
directed staff to expand the definition of Recycling Processing Centers to allow the staging of vehicles for
salvage or processing off site. Staff recommends expanding the definition to allow staging vehicles for
recycling, but continue to prohibit on site salvage or processing.
Staff proposes the following language for the definition of Recycling Processing Centers:
Recycling Processing Center means land or buildings where reusable materials are bought, sold,
exchanged, stored,baled, cleaned,packed, disassembled or handled,including metal,rags,
plastic,paper, cardboard,rubber (excluding tires),glass and wood products, or where
segregated waste materials are reprocessed into usable, salable products. The staging of
motor vehicles for processing off site shall be permitted. The salvage of motor vehicles and
machinery parts are not included and shall be prohibited at a recycling processing center.
A significant number of our zoning uses are not defined and staff is currently creating,modifying, and
combining definitions relating to the land development regulations. It is anticipated the definition of
motor vehicle will be any self-propelled vehicle designedpri�narily for transportation ofpassengers (90 or fenvei) orgoods.
Specific number of vehicles allowed to be staged will be reviewed and determined during each
Conditional Use Permit process.
Planning Commission
No one spoke for or against the request and staff has not received any comments since the Planning
Commission meeting.
The Planning Commission had no concerns and unanimously recommended approval of the request.
On August 18, 2016, staff met with Lake State Recycling and their consultant to discuss the proposed
ordinance amendments. Current drafts were provided to all in attendance and staff has not received any
concerns from Lake State Recycling or their consultant.

The City Council of the City of Elk River does hereby ordain as follows:
SECTION 1. That§ 30-1, Definitions, of the City of Elk River Code of Ordinances shall be
amended as follows:
