1. Call Meeting to Order
Pursuant to due call and notice thereof, the meeting of the Elk River City Council
was called to order at 6:30 p.m. by Mayor Dietz.
2. Pledge of Allegiance
The Pledge of Allegiance was recited.
3. Consider 09/06/2016 Agenda
Moved by Councilmember Westgaard and seconded by Councilmember
Olsen to approve the September 6, 2016, agenda. Motion carried 5-0.
4. Consider Consent Agenda
Moved by Councihnember Wagner and seconded by Councilmember Burandt
to approve the following consent agenda:
4.1 Minutes
■ August 1, 2016, regular meeting
■ August 8, 2016, special budget work session
■ August 8, 2016, closed meeting
■ August 15, 2016, regular meeting
4.2 Check register, check numbers 9863-9866 and 98129-98346 as outlined
in the staff report.
4.3 Appoint Finance Director Lori Ziemer to the Fire Relief Association
Board with a term expiration of January 3, 2017.
4.4 Special event permit to the Elk River Youth Hockey Association for
their 50" birthday celebration on Saturday, September 10, 2016, subject
to the following conditions:

The event planner is required to notify surrounding businesses,
residents, and organizations. The city will provide a template of the
notice that must be distributed and a list of the property owners to
notify. The event planner must provide an affidavit that the notice
was distributed.
2.
Applicant must receive permission for use of any private property.
3.
Tents must meet applicable state and fire building code
requirements. Tents must be secured with weights, not stakes. No
stakes shall be pounded into the pavement. Applicant is
responsible for contacting the fire marshal at 763.635.1110 to
schedule an inspection prior to use of the tents.
4.
Liquor may only be served by a caterer licensed to serve alcohol in
the State of Minnesota. Prior to the event, the city must receive a
copy of the caterer's licenses issued by the state allowing the
caterer to serve food and alcohol. Caterer must also provide
certificate of insurance naming the city as an additional insured for
liquor liability coverage.
5.
Applicant is required to have two police officers on-site from 6:00
p.m. until 11:30 p.m. while alcohol is served. The applicant is
responsible for fees associated with police personnel.

Temporary signs must receive a temporary sign permit from the
Planning Department prior to display and all signage must comply
with the standards set forth in the ordinance beginning with
Section 30-851.
4.5 Adopt Resolution 16-52 approving the summary publication of
Ordinance 16-19, an ordinance which amends the code of ordinances
by adding Section 30-1587, entitled "Focused Area Study (FAST)" and
Section 30-1158, entitled "Structure Regulations".
4.6 Solicitor permit to Aaron Jahnke, The Window Store Home
Improvements, Inc. valid through December 31, 2016.
4.7 Additional design and engineering fees for the Rivers Edge Commons
Park Expansion project as outlined in the staff report.
4.8 Agreement 2016-26 between the Decklan Group and the City of Elk
River to market advertisers for the city's two ice resurfacers.
4.9 Agreement 2016-27 between RinkSide Advertising and the City of Elk
River for marketing the dasher boards for advertisers at the Olympic
and Barn rinks.
Motion carried 5-0.

6.1 Proclamation. Constitution Week
Mayor Dietz read the proclamation.
Marilyn Schroeder, representative of the Anoka Chapter of the Daughters of the
American Revolution, thanked the Council for their support. She stated this year's
Constitution Week activities include a non-partisan voting display at the Elk River
Library. She explained the presentation promotes voting and provides direction for
first time voters.
Moved by Councilmember Burandt and seconded by Councilmember Olsen
to proclaim September 17, 2016, through September 23, 2016, as Constitution
Week. Motion carried 5-0.
6.2 Oath of Office: Police Officer Nicholas Albert
Chief Nierenhausen presented Nicholas Albert and Mayor Dietz administered the
police officer oath of office to Mr. Albert.
7. Public Hearings
There were no public hearings.
8.1. Rivers Edge Commons Park Construction Change Orders
Mr. Hecker presented the staff report.
Moved by Councilmember Westgaard and seconded by Councilmember
OIsen to approve the change order requests for the construction of the Rivers
Edge Commons Park Expansion as outlined in the staff report. Motion
carried 5-0.
8.2 Economic Development Authority and Housing and Redevelopment
Authority Levies
Ms. Othoudt presented the staff report.
Moved by Councilmember Wagner and seconded by Councilmember
Westgaard to adopt Resolution 16-53 approving the 2017 tax levy for economic
development purposes for the Elk River Economic Development Authority.
Motion carried 5-0.
Moved by Councilmember Burandt and seconded by Councilmember Wagner
to adopt Resolution 16-54 approving the Housing and Redevelopment
Authority tax levy. Motion carried 5-0.

8.3 Discuss Work Session Items
No items were added.
9.1 Council Liaison Updates
The Council provided updates of the various boards/commissions.
The Council recessed at 6:59 p.m. in order to move into work session. The meeting
reconvened at 7:03 p.m.
10.1 Park Projects for Referendum

The Council reviewed the list of park projects for inclusion in the referendum as
recommended by the Parks and Recreation Commission.
Mayor Dietz explained he asked for this to be on the agenda because he wants to
make sure the park priorities identified will entice people to vote for the referendum.
He added he believes improving trails would be more beneficial to the general
public.
Mr. Hecker explained the Parks and Recreation Commission process for reviewing
and assigning the priorities.
Parks and Recreation Commissioner Dave Anderson stated the commission had a
difficult time narrowing the priorities but discussed completing larger projects rather
than piecemealing smaller projects. He added trails are beneficial; however, many of
the proposed trails are not shovel ready and would require property acquisition prior
to completion.
Mayor Dietz asked what would happen if trails were included as part of the
referendum but the money wasn't spent right away. Ms. Ziemer indicated bond
proceeds must be used in a specified amount of time.
Councilmember Wagner explained she pushed for trails but once she realized
property acquisition was necessary she understood why trails were removed from the
commission's prioirittes. She suggested staff work with the Parks and Recreation
Commission to create a trail plan so trails can be completed as funding or grants
become available.
Mayor Dietz indicated the general consensus of the seniors is to have multiple pickle
ball courts in one location. He stated the high school may be relocating their tennis
courts soon and suggested staff talk to high school staff about possibly incorporating
pickle ball courts. Councilmember Westgaard indicated this was discussed with
school representatives and they advised they would keep it in mind. Councilmember
Wagner added the task force identified pickle ball courts as a priority of the multi-
purpose facility.

Mr. Hecket indicated marketing rnaterial will be based on discussions this evening.
Council consensus to go with recommendation of the Parks and Recreation
Commission as presented.
II. Adjournment
There being no further business, Mayor Dietz adjourned the meeting of the Elk
River City Council at 7:33 p.m.
