Background/Discussion The city and the International Union of Operating Engineers have agreed to a labor agreement with Local 49 as the sole representative. Article 30 of the labor agreement stipulates participation in the IUOE Central Pension Fund. The fund requires employer contributions on behalf of the employees. The union agreed to a wage deduction to account for the employer's share of the contribution. The contract language indemnifies the city,its officers, agents, and employees from any claims, suits, orders, or judgments. It also states that contributions from the city will not be funded from any other source other than the wage reduction. In the event the pension fund requires additional contributions to maintain solvency, the employees agree to further reductions from their wages. The EMPLOYER also agrees to be bound to all provisions of the Restated Agreement and Declaration of Trust of the Central Pension Fund of the International Union of Operating Engineers and Participating Employers (AGREEMENT), and as it may be amended or restated, so long as the EMPLOYER has an obligation to make contributions to the Central Pension Fund. The EMPLOYER consents to the appointment of the Trustees, currently administering the Central Pension Fund, as well as their duly appointed successors. The EMPLOYER further agrees to continue contributions to tate Central Pension Fund during ar y period in which it is engaged in negotiations with the UNION, on the basis specified in its most recently expired agreement with the UNION, until such time as a new agreement is reached or the EMPLOYER no longer has a duty to bargain with the UNION.
