The applicant requests a Conditional Use Permit to operate a bus storage facility.

Existin~ Conditions
The combined lots are approximately 2.19-acres in size and have one existing structure. The
site is open with some trees in the northwest corner near the cul-de-sac.
Analysis
The existing building will be utilized for storage of four highway coaches (40-45 feet in
length) and three school buses as well as office space. There will be one full time staff
person on site during the day,
There will be light maintenance of the buses within the building. The building also has an
additional 1 ,700 square feet of office space that will be rented. This will require 5 parking
stalls. The site has adequate parking stalls available for both tenants.
The site is accessed off of York Street, which has direct access to Meadowvale Road (County
44). The buses will be leaving at 15-20 minute intervals before peak traffic times, usually
before 6 a.m., and will return between 6-7 p.m.
At the present time they have no plans to expand and currendy have 7 employees, which do
not drive every day.
Standards for Issuance of a Conditional Use Permit
The issuance of a Conditional Use Permit can be ordered only if the use at the proposed
location:
1. Will not endanger, i,?jure or detrimentallY ciffect the use and e'?Jqyment if other property in the
immediate viciniry or the public health, safery, morals, comfort, convenience or general we!fare if the
neighborhood or the ciry.
2. Will be consistent with the comprehensive plan.
], Will not impede the normal and orderlY development and improvement if surrounding vacant
property.
4. Will be served adequatelY f:y and will not adverselY ciffect essential public facilities and services
including streets, police and fire protection, drainage, rifuse disposal, water and sewer !)Istems, parks
and schools; and will not, in particular, create trqflic congestion or inteiference with trqflic on
acfjacent and neighboringpublic thoroughfares.
5. Will not involve uses, activities, processes, materials, equipment and conditions if operation that will
be detrimental to af!Y persons or property because if excessive traffic, noise, smoke, fumes, glare,
odors, dust or vibrations.
6. Will not result in the destruction, loss or damage if a natural, scenic or historic feature if mqjor
importance.
7. Will fullY complY with all other requirements if this Code, including af!Y applicable requirements
and standards for the issuance if a license or permit to establish and operate the proposed use in the
ciry.

If denial of such a permit should occur, it shall accompany recommendations or
determinations by fIndings or a report stating how the proposed use does not comply with
the standards set forth in section 30-654.
Planning Commission Action
The Planning Commission discussed the issue of outdoor storage of buses after an adjacent
property owner asked that a condition be placed on the request that did not allow storage of
unusable vehicles on site.
The applicant stated that buses might be stored outside overnight and was agreeable with a
condition which limited overnight parking to 24-48 hours.
One Commission member was not willing to support the request until County Road 44
(Meadowvale Road) was upgraded to support the added bus traffIc.
The Planning Commission recommended approval of the request by a 6-1 vote.
Recommendation
Staff and the Planning Commission recommend City Council approve the Conditional Use
Permit with the following conditions:
1. Outdoor storage of inoperable buses or bus parts is prohibited. Occasional
overnight outdoor parking of buses is allowed.
2. All bus maintenance shall occur within the building.
3. The building shall comply with all building codes.
4. The building shall comply with all fire codes.
5. If more than 7 buses are to be stored in the building, the applicant shall apply
for an amendment to the Conditional Use permit.
6. If more than 7 employees are to be on site, the applicant shall apply for an
amendment to the Conditional Use permit.

We are requesting a conditional use permit for Speco Charter LLC, a charter bus company. Speco Charter
wishes to purchase the propriety at 18940 York Street, Elk River. Thepurchase ofthispropriety is
conditional on the city approving this permit.
Speco Charter's intent for the propriety is to be used as a storage felicity (garage) and light maintenance.,
along with our office. This building also has office space in the front, which we would be renting out.
We do not consider ourselves a bus "terminal" as we do not have customers coming to our felicity to catch
the bus.
We have 4 highway coaches, and 3 school busses. At the present time we have no plans to expand, but
would be replacing equipment as needed.
Buses would not impact the amount of traffic in the area much, as they leave before peak traffic times, and
at [5 to 20 minute intervals, usually betore 6 AM and come in around 6-7PM in the evening. We have 7
employees, and they do not drive everyday.
