SUBJECT: Consider Authorization to Advertise for Bids for Construction
of Westbound Liquor Store
At the November 22, 2004, City Council meeting, the Council discussed the Westbound
Liquor Store construction project. At that time, Gary Tushie of Tushie Montgomery
Architects gave the Council an update on the projected timeline for the project which
included accepting bids in February. The next step in the process is for the Council to
authorize the advertisement for bids.
Attached is the proposed Advertisement for Bids including a list of the twenty-two bid
packages for the project. This ad will be placed in the Elk River Star News so that alllocal
bidders have notice of the project. Liquor Manager, Dave Potvin, and his staff along with
the building inspection staff are waiting for the latest set of plans to review so that fInal
changes can be made and the fInal set of plans can be available by January 31 as stated in the
advertisement for bids. The schedule calls for the bids to be opened on February 24 with
Council award of bids on March 7. The anticipated construction start is March 21 according
to the schedule provided by the architect. The schedule provides for a store opening in late
fall.
Financing and planning approvals for this project are also proceeding simultaneously and
action items will be brought to the Council as needed to complete the financing and
planning process.
Action requested
The City Council is asked to consider authorization to advertise for bids as outlined in the
attached Advertisement for Bids for the construction of Westbound Liquor.

Advertisement for Bids
The City of Elk River will be receiving sealed multiple prime, lump sum bids for the Contract Packages as
noted below and required for construction of the Elk River Westbound Liquor Store until 2:00 p.m. local
time on Thursday, February 24, 2005, at the Elk River City Hall, at which time and place all bids will be
publicly opened and read aloud. The expected date of award of Contract is scheduled for March 7,
2005, with commencement of construction to start March 21, 2005.
This project includes the construction of a new Liquor Store of approximately 10, 262 square feet with
site work for this project on a site of approximately 65,429 square feet (1.5 acres). This project will be
coordinated and constructed as a construction management project.
Multiple copies of the bidding documents, including the Proposal Form, Drawings, Project Manual and
Specifications, will be on file at the Offices of the following:

Prospective bidders and interested subcontractors can obtain complete sets of the Contract Documents
upon receipt of deposit of $50.00 per set by contacting the Construction Manager by Facsimile. The
following information shall be required with the facsimile request: Company name, mailing address,
street address, phone and facsimile numbers and type of bidder. Drawings will be shipped to
prospective bidders upon receipt of check or money order and the facsimile information. Deposit shall be
returned upon receipt by Construction Manager of returned documents.

Proposals shall be submitted on the bid forms supplied in the Project Manual in full accordance with bid
documents and Contract Documents as prepared by Tushie Montgomery & Associates. No oral,
telegraphic or telephonic proposals or modifications will be considered. No bids will be considered
unless sealed and filed with the City Clerk. Bids arriving after the designated time will be returned
unopened.
Each bid shall be submitted with a certified check or acceptable bidder's bond payable to City of Elk
River in an amount equal to five percent (5%) of the total bid. The successful bidder will be required to
furnish satisfactory Labor and Material Payment Bond and Performance Bond.
Bids may not be withdrawn within (30) thirty days after the scheduled time of opening bids, without the
consent of the Owner. The Owner reserves the right to accept any bid or to reject any and all bids, or
parts of such bids, and waive any informalities or irregularities in the bidding.
All Bids shall be submitted as "Lump Sum Contract Packages" basis. The portions of the Work have
been segregated as indicated in the specifications, on the Bid Form and as itemized below. Contract
Package Bids shall be submitted for those line items, which relate to those portions of the Work so
indicated below, as specified, as indicated on the Drawings and as stated on the bid proposal form.
