Background/Discussion On August 22,2016,the city received a Conditional Use Permit and Land Use Application for a dog daycare and overnight boarding facility to be located in the Central Commercial (C-1) zoning district at 503 Jackson Avenue. The application was first reviewed as a daycare per the zoning examples provided by the applicant.There appeared to be a precedent that other cities had set in calling the operation a daycare,which is listed as a conditional use in the C-1 zoning district. On September 27,2016,the Planning Commission showed support for this facility at the proposed location and unanimously recommended approval. Following the meeting,additional concerns were raised with classifying a dog daycare the same as a "licensed daycare facility"as described in the city code. Staff reviewed the examples provided by the applicant,and contacted a number of cities throughout the area to determine how similar businesses were approved under their city code.Staff found that many cities classified similar businesses as a commercial kennel,which was already permitted under their city code,and other cities amended the ordinance after receiving a request for these facilities. One city approved this type of facility as a"daycare"via the conditional use permit(CUP) process. With this information,staff spoke with the applicant and noted that the best avenue for approval would be to amend the ordinance and clearly identify dog daycare facilities as a permitted use in the C-1 zoning district. The City Council reviewed the dog daycare and overnight boarding facility on October 17,2016.After showing support for this facility at the proposed location in the C-1 zoning district,the application was tabled until an ordinance amendment permitting the use has been approved. Similar to other cities,staff is classifying this business as a commercial kennel.A commercial kennel is defined as any premises where more than three animals over six months of age are boarded,trained or bred for compensation or are offered for sale,except for animals being raised as agricultural livestock,an animal hospital,a veterinary clinic or a pet shop. rrniiii � r I�JA�'URE Staff is proposing to amend the following language: Sec. 30-1022—C-1 central business district. (d) Conditional uses. Conditional uses in the C-1 district are as follows: (19) Commercial Kennel provided the following conditions are met: (a) no long term boarding exceeding 14 days takes place (b) no breeding for compensation or sale takes place (c) the sale of animals shall not take place The applicant requested the boarding limit to exceed 14 days. The current two-week limit is a recommendation from staff,and a specific timeframe was not requested by the applicant.The intent of the time limit is to ensure the safety of the animals and city residents within small lot/higher density commercial areas is preserved. Commercial kennels are typically located in the R-1 a zoning district where the minimum lot size is 2.5 acres, and the minimum distance between buildings would be 40 feet. Does the Planning Commission feel the recommended time frame of 14 days is appropriate for a kennel located in C-1 district? It is on their main road through town(Rum River Drive), and shares the block with residential dwellings immediately behind it. The City of Princeton categorized it the same as they do for children's daycare. They do not allow overnight boarding in residential areas. Their requirements included: • Animals are allowed outside only under direct supervision. • A maximum number of animals allowed at the facility will be established by the Planning Commission at the time of interim use permit issuance. • Noise shall be mitigated so as to not create a public nuisance for adjoining properties. • Indoor and outdoor facilities are to be kept in a clean, dry, and sanitary condition. • Waste shall be picked up immediately and disposed of in a sealed container. • Adequate storage and refrigeration shall be provided to protect food supplies against contamination and deterioration. • Indoor facilities shall be adequately ventilated and have ample light and heat. • Adequate screening shall be provided, as determined by the Planning Commission. • Hours of operation shall be reviewed and approved by the Planning Commission. , ac ^ , ...... :.....r ..Y' .. ... ..:. .... .... :.. .. ...:..,. ..,.. ..:. .'G^ ^.Wit.., — Maple Grove Petsmart—They have an indoor daycare/boarding facility. The city of Maple Grove allowed it as "integral to their retail business." Adogo —This facility is in a zone that the city of Maple Grove has designated as"freeway frontage." It is up to the Planning Director to determine which businesses can locate in this zone. They do not require a CUP. Their main concern was noise, and since it was close to the freeway,they didn't feel that any additional noise would be a concern, since the freeway already generated a lot of noise. The central business district is intended to encourage uses and designs that are consistent with the historic character of the central business district. Emphasis shall be placed on pedestrian access and design standards with flexibility to preserve the historic character of the central business district. Uses shall be designed to eliminate any nuisance or incompatibility with surrounding uses. (b) Permitted uses. Permitted uses in the C-1 district are as follows: (1) Business and professional offices. (2) Financial institutions. (3) Retail stores and shops. (4) Personal service establishments. (5) Outpatient health care facilities. (6) Hotels. (7) Class I restaurants. (8) Public parks. (9) Sale of firearms. (10) Bed and breakfasts establishments shall be allowed as a permitted use in an existing residential structure, subject to site plan review, provided the use complies with the following criteria: a. Off street parking shall be provided at a rate of one space per guest room plus those required for the single-family use. A piggy-backed or tandem parking arrangement is permitted. b. Off street parking shall be provided on an existing driveway. c. Signage shall be limited to one freestanding sign, not to exceed four feet in height and eight square feet in size, and one wall sign not to exceed four square feet in size. Signs shall not be illuminated. d. The exterior appearance of the structure shall not be altered from its single-family character. e. The proposal shall comply with all building and fire code requirements. If the proposed bed and breakfast business does not comply with one or more of the above criteria, it will require a conditional use permit. (11) Physical recreation or training. (12) Brewer taprooms producing less than 10,000 barrels of malt liquor annually. (13) Brewpubs. (c) Accessory uses. Accessory uses in the C-1 district are as follows: (1) Signs as permitted in section 30-851 et seq. (2) Off-street parking facilities. (3) Off-street loading facilities. (4) Telephone booths.
