Background/Discussion Section 46-38 of the city’s ordinance authorizes the city to levy an assessment against property for any costs the city incurs to abate a public nuisance. All property owners who were in violation of the public nuisance ordinance received a notice informing them they had the opportunity to correct the violation or the city would abate the property and they would be assessed for the costs. Attached is a list of abated properties and the costs incurred by the city. The total amount assessed is $1,578.24. The total amount assessed in 2015 was $1,537.18. Financial Impact None Attachments  Resolution  List of Properties Abated Template Updated 4/14 Resolution 16-____ A Resolution of the City of Elk River Adopting and Levying Assessment for Abatement of City Code Violations WHEREAS, Minnesota Statutes Section 429.101 authorizes the city to levy an assessment equal to the cost of abatement for removal or correction of a hazardous condition; and WHEREAS, the city ordinance Section 46-38 authorizes the city to levy an assessment against property for any costs the city incurs to abate a public nuisance; and WHEREAS, all customers and property owners with public nuisance violations were given adequate notice of this pending assessment and have been given opportunities to pay prior to this assessment being levied; and WHEREAS, state law does not require a public hearing or notice before levying such assessments. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk : River, Minnesota, as follows The parcels and amounts listed in attached Exhibit A are correct and made a part hereof, and are to be levied and certified to the Sherburne County Auditor. st Passed and adopted this 21 day of November 2016.
