Action Requested
Recommend, by motion, approval of the Conditional Use Permit with the following conditions:
1. The Conditional Use Permit shall not be recorded until all conditions have been completed.

3. The applicant must apply for and receive approval for all required permits before any
construction may begin.
4. The city's Building Official and Fire Marshal shall inspect the building for compliance with all
state and local building codes.
5. Hours of operation shall be limited to Monday through Saturday 7:00 a.m. —10:00 p.m. and
Sunday 8:00 a.m. — 8:00 p.m.
6. An amendment to this CUP will be required for future expansions /additions not shown on the
site plan dated September 26, 2016
7. Staff approval of a spectator safety plan.

11. All sources of artificial lights shall be so fixed, directed, designed or sized that the minimum
subtotal of their illumination will not increase the level of illumination on any nearby residential
property by more than 0.1 footcandle in or within 25 feet of a dwelling or by more than 0.5
footcandle on any part of the property.
12. All comments in the Engineering Division memo dated November 8, 2016, shall be addressed.
13. All comments in the Stormwater Coordinators Memo dated November 9, 2016, shall be
addressed.
14. All comments in the Environmental Technician memo dated November 7, 2016, shall be

Background /Discussion
The property is zoned Extreme Commercial Recreation (XCR) where Off -Road Racing Facilities require
a Conditional Use Permit (CUP). The applicant is seeking a CUP to combine and operate three Off-
Road Racing Facilities (ERX track, TORC track, and go -kart track) into one 42.48 acre parcel.
A preliminary plat application (Case # P 16 -19), to allow the operation of Off -Road Racing Facilities, was
reviewed by the Planning Commission on November 22, 2016.
The applicant received a CUP for the ERX track (CU 16 -15) on June 20, 2016 with eight conditions.
This new CUP application will include the ERX Track and the eight approved conditions from CU 16 -15
are being included in the current CUP conditions (1 -8). With an approval of this CUP request, the
previous approved CUP (CU 16 -15) will become void.
The applicant also received a CUP (CU 16 -18) for Active Use Storage but that is located on a separate
plat and is not included in this proposal.
Analysis
Comprehensive Plan
The property currently has a land use designation of Highway Business /Mining. The Highway Business
land use ranges from moderate to high intensity forms of commercial development in Elk River.
Businesses in this category may be the largest both in terms of size and traffic generation while also
providing services and convenience types of business. Market orientation tends to be regional in nature.
Development orientation tends to be toward regional highways. Examples of Highway Business uses
include discount retailers, grocery, restaurants, automotive sales and service, general merchandise, and
professional services.
The Gravel Mining Area Land Use, Transportation, and Utility Plan identifies the subject property as
Highway Business and Low Density Residential.
The proposed use is consistent with the Comprehensive Plan.
The Site
There are currently several buildings/ structures on the 42.48 acre site:

ERX Track
Future track expansion plans include an addition to the existing chalet which would include bathrooms
and concessions, as well as an additional storage shed.

Future track improvements include a two level announcing tower and a concession stand. A scoring
shelter, grandstand bleachers, viewing structures on the east and south sides of the track, and storage shed
will also be added to the TORC track area. In the meantime, the applicant will continue to utilize
temporary /portable bleacher units.
Go -kart Track
Future track improvements include lighting and storage shed.
An amendment to this CUP will be required for future expansions /additions not shown on the site plan
dated September 26, 2016.
Special Event Recreational Camping Area
As part of this CUP request, the applicant, directed by city staff, is including a portion of Oudot A (75-
825 -0010) as a special events recreation camping area. Special Event Recreational Camping Area means a
recreational camping area which operates no more than two times annually and for no more than 14
consecutive days. The applicant is requesting that the area shown on the site plan dated September 26,
2016 be allowed for Special Event Recreational Camping for no more than two times per year. This area
has received the proper grading permits.
Parking
There are 260 parking stalls in the southern paved lot and 200 parking stalls in gravel lot south of the
chalet. A total of 460 parking stalls are located on the subject property for spectators and participants/
sponsors. Parking requirements are one parking space per four expected patrons at capacity. With the
site parking, this would only allow 1,840 patrons on the site at one time.
There are over 500 parking spots located directly north adjacent to the subject property owned by the
applicant (Carlson Motor Sports). Over 1,000 additional spots are also available approximately .25 miles
to the northeast on property owned by Plaisted Companies (PID 75- 110 - 1105).
The site plan indicates the various paving types throughout the subject property, all of which are
acceptable materials for paving.
Section 30- 901(a) states all driving areas and parking areas shall be bounded by B612 concrete curb and
gutter. Due to past discussion and direction from the city council with CUP (CU 16 -15), staff is not
recommending curb and gutter for this application.
Transportation/ Circulation
The site has two access points from Highway 169. All access before and during events for spectators and
participants/ sponsors will occur at the 217th access. The southern access will only be for emergency
purposes and exiting at the end of an event. MnDOT was provided the submitted information to review
and the city has not received any comments from them. The Environmental Assessment Worksheet
(EAR currently being prepared may detail necessary future roadway networks on the subject parcels.

Utilities
The subject property is not located in the Urban Service District. Although the current project does not
require city services, some of the proposed permitted and conditional uses in the XCR district will require
city services and this will have to be addressed in the future. This area, as shown in the Comprehensive
Plan, is not anticipated to have city services until beyond 20 years.

Grading /Drainage
Current grading of the TORC track does not meet proposed Wetland Setback requirements and the
proposed Drainage and Utility Easement.
Landscaping
Per ordinance, 170 trees are required for the subject property. The total number of required new trees
may be offset by the retention of existing trees on the lot, provided that such trees satisfy the
requirements of Section 30 -934:

Staff visited the site and credit for 170 trees can apply to satisfying the landscaping requirements with
existing trees.
Signage
There are two permanent signs on the property. One is approximately 4'x4' and 14' tall and the other
sign is approximately 8'x8' and 15' tall. The XCR ordinance allows only one freestanding sign, not to
exceed 150 square feet with a maximum height of 30 feet. One of the existing signs is a legal non-
conforming sign.
In the future, the applicant anticipates constructing a single monument sign on the subject property that
would exceed 30 square feet of changeable copy. They are including a changeable copy sign exceeding 30
square feet with this CUP application. At the time this memo was drafted, the size and height being
proposed and the approximate location on the site are not know. Staff has requested that information.
Wetland
In 2008, the city indicated the current pond on the ERX track is an incidental pond created from mining.

The project appears to be consistent with six of the seven required findings for approval of the
Preliminary Plat but requirement number four will need to be evaluated once the EAW is received and

reviewed. If there are major concerns with the report that would not support the CUP request, staff
will bring this item back to the commission for further review.
If denial of such a permit should occur, it shall accompany recommendations or determinations by
findings or a report stating how the proposed use does not comply with the standards set forth in Section
30 -654.

Per State Statute 15.99 the required 60 day review period was extended to January 24, 2017.
Council Meeting

CUP NARRATIVE - 21591 US HWY 169 NW
Background
ERX was launched in the winter of 2008 and is recognized today as one of the fastest - growing
motorsports facilities in the Midwest. With a focus on family - friendly events and grassroots
motorsports activities, ERX has been quickly embraced by motorsports enthusiasts of all kinds.
ERX was created by Todd Plaisted and Chris Carlson, two Elk River businessmen who are long-
time powersports enthusiasts. Plaisted and Carlson both enjoy participating in powersports
activities with their families. They saw an opportunity to create a facility which would address
this opportunity and provide value for the Elk River community. Their original intent was to
provide a facility for snocross racing and training. Today ERX is a year -round complex hosting
both snowmobile events in the winter and off -road truck, car, ATV and go -cart racing in the
summer months. ERX hosts events for local and regional organizations and non - profits such as
the Day of the Dozers event raising money for Children's Hospital and another fund raising
concert event for the Three Rivers Community Foundation, which raises money for grants and
scholarships in the Elk River and surrounding communities. Future uses may include concerts,
product demonstrations, and endurance events such as "Tough Mudder" or "Running with the
Bulls ".
In June of 2008, ERX received an IUP to operate, and in July of 2015, to accommodate our long
term vision, the city approved a new zoning district, XCR extreme commercial recreation.
On April 5, 2016, Sportech staff met with Elk River Planning and Zoning staff to discuss ERX;
during this meeting, staff asked us to submit a CUP for this site to continue operations at our
current location, 21591 US Hwy 169 (PID: 75- 110 - 2405).
In July of 2016, City Council approved a CUP for the original 13.29 acre parcel with conditions.
In July of 2016, ERX platted another area to house our power shops. Looking ahead, we'd like
to convert our truck track and go -cart track into permanent tracks.
In September of 2016, ERX, City staff, and Anderson Engineering proposed a plan that would
combine the 13.29 acre parcel, the go -kart track (portion of PID: 75- 825- 0040), and the new off-
road truck track (portion of PID: 75- 825 -0010) onto the same plat and under the same
conditional use permit. This would meet the 300' right of way requirement without dedicating
217th Avenue. Additionally, this also preserves 217th Avenue for Outlot A, for future
development. By doing this, we will void the approved CUP (CU 16 -15) on the 13.29 acre ERX
site and transfer those conditions, for the ERX track, to this new permit.
In a meeting with City staff on September 14, 2016, staff informed us the City attorney
indicated it was allowable for ERX to include special event camping on Outlot A under this CUP
application. At this time, special event permitting occurs twice a year, during our larger special
events (i.e.: Red Bull, Torc, etc). Since this land is not platted, ERX Properties would still be able
to apply for additional special event permits until this land is developed.
Because of the incredible success of the events ERX has hosted thus far, we are applying for a
CUP that would combine all track elements (off -road, snocross,and go -cart) on a single plat.
During our meeting with City staff on September 14, 2016, it was indicated once approved, this
would eliminate the need to apply for a special event permits in the future for our larger events
that stay within land boundaries with the exception of our possible two events per year that
would allow special event camping on Outlot A.
Detailed Description
From the very beginning, Mr. Plaisted and Mr. Carlson have implemented a few fundamental
principles which have been consistently used to guide the organization through the years.
• ERX will be family and community focused. It will be a facility which will provide safe,
family friendly activities, with the ultimate goal of creating value with the local
communities and within the powersports industry.
• ERX will utilize an operating philosophy grounded in integrity, and benevolence and
charitable activities will be a key part of the operation. Free admission has been,
and will continue to be offered to charities, ministries, schools and non - profits. ERX
is proud to have partnered with a number of outstanding non - profit organizations
through the years, including but not limited to Big Brothers and Big Sisters, MN Adult
and Teen Challenge, Boys and Girls Club of MN and the Fellowship of Christian
Athletes (FCA). Most recently, ERX has donated the use of their property to the
YMCA of MN for their summer youth motorcycle training program, the "National
Youth Project Using Minibikes (NYPUM) ".
• ERX will encourage development. Since the beginning, ERX has hosted events designed
to promote improved skills and safety. These events, and much more, include ERX
Learn To Ride Clinics, Motocross Clinics, YMCA Youth Motorcycle training, Avalanche
Awareness Classes, Youth Snowmobile Safety Training, Day of the Dozers, and
concerts for the Three Rivers Community Foundation.
Brief overview of vision
ERX is recognized as the top testing and development facility in the country for amateur and
professional snocross racers. As a direct result, the large OEM supporting this industry, such as
Polaris, Arctic Cat, and BRP, are investing in the Elk River area as well through leased lodging
and shop space for their factory teams. At least two of the OEMs have expressed interest in
moving part, or all, of their corporate racing operations to Elk River to gain improved access to
ERX.

ERX has built a national caliber off -road truck track that has been quoted by Professional drivers
as being the "most fun they have had racing, ever". ERX strives to become the number one
track in the nation. During our meeting with city staff on July 28, 2016, ERX indicated that we
would like to offer overnight parking and camping to spectators for these events. City staff
indicated it wouldn't be a problem seeing, as it was only a couple times a year. In August, City
Environmental Technician sent over the requirements from the MNDH for the rules of special
event camping.
Scope of Project /Proposal
Currently five buildings /structures are on the 43.7 acre site, off -road truck track, go -cart track,
snocross track, (county map attached) including:
• A 624 square foot office
• A 2,400 square foot shop
• A 1,320 storage facility
• A 3,250 square foot facility (chalet)
• A 240 square foot shed
Future facility expansion plans include an addition to the existing ERX Chalet which would
house bathrooms and concessions, as well as an additional storage shed.
Future improvements near the off -road truck track include a two level announcing tower which
would house an announcing booth on the upper level, and a concession stand on the lower
level. A scoring shelter, grandstand bleachers, a semi - permanent viewing structure on the east
side of the track and on the south side of the track, and a storage shed will also be added to the
off -road truck track area. In the meantime, we will continue to utilize temporary/portable
bleacher units.
Future improvements on the go -kart track include lighting and storage shed.
The 13.29 acre site has been operating as ERX since 2008 and has served as a feeder system to
ISOC, the national snocross series. Riders who were introduced to the sport of snocross at ERX
are now winning national championships and are recognized as some of the best emerging
racers in the world. As a direct result, ERX is quickly acquiring a reputation as a facility which
develops and builds future champions.
In the spring of 2016, the ERX team built an off -road truck track which, in July of 2016, ERX
hosted stops 7 and 8 on the national TORC (The Off -Road Championship) circuit. In the future,
we would like to hold two off -road truck events per year and have teams come out for
occasional testing.

Because of the success of that event we are applying for a CUP for the off -road truck track to
continue operations at this location, in conjunction with all other applicable land use
applications deemed applicable by city staff at our meeting on July 28, 2016 (i.e.: Preliminary
Plat, Final Plat, etc.).
In addition providing a safe, yet challenging track for testing and training, ERX provides the
following events on a regular basis:
1. ERX Grassroots Snocross Series
This series will be entering its 9th year this year, and is hosted on Thursday nights,
focusing on first -time, amateur and youth racers. The largest classes are youth
oriented, and the largest specific groups of racers are the 120cc class, which features
riders from ages 4 to 12 years old. Competitors follow the six race series with hopes of
capturing the ERX Season Points Championship. We have racers traveling from Ontario,
Manitoba, North Dakota, Wisconsin, Michigan, Iowa and Ohio. Average attendance for
this race is approximately 1,000 people; we don't anticipate attendance to ever exceed
1,500 people.
2. Summer Beater -X Series
This series features compact cars, light trucks, ATVs and UTVs competing on an all -dirt
track. The track layout consists of rolling jumps, elevation changes, tight corners and
provides an exciting and challenging extreme form of racing, with a focus on low -
budget racing for amateurs and first -time racers.
3. Friday Night Go -Kart Races
This is the 2nd year of go -kart racing. This track is a small oval track, directly to the east
of the main ERX track, which is rented by 169 Speedway and offers families a chance to
experience the first steps of racing.
Future off -road racing events at ERX could include grassroots off -road truck racing, regional off -
road truck racing, and motocross racing.
We are currently working in conjunction with City staff and Anderson Engineering on the EAW
process as required by the city; this is in part triggered by our anticipation of hosting event in
the future which would exceed 5,000 participants.
To date, the largest attendance at any of our events was approximately 4,500 peek attendance.
We anticipate future off -road truck races and larger extreme snocross races to exceed 5,000
participants and spectators. In the event we were to consider hosting an event on this site
which would exceed 19,999 peek participant and spectator attendance, we will work with the
city to ensure all necessary requirements are put into place prior to the event.

Number of Employees
There is currently no full -time staff employed by ERX. ERX is currently operated with community
volunteers and employees from Plaisted Companies, Sportech and Carlson Motorsports.
Traffic
Traffic and other key elements will be addressed in further detail upon our completed EAW
(anticipated to be completed December 2016). Based on the findings, ERX will work with
MnDOT and City staff to ensure safe entrance and exit with Hwy 169.
Number of Parkine Stalls (existine & additional)
There are 260 parking stalls on the upper paved lot, and 200 parking stalls on the bottom lot
near the ERX chalet. We also have over 500 parking spots located directly adjacent to ERX on
property owned by Envision (Carlson Family, PID: 75- 833 - 0105). Over 1,000 additional spots are
also available approximately 0.25 miles to the NE on property owned by Plaisted Companies
(PID: 75- 110 - 0105).
Sianne /Outdoor Storage
There are two permanent signs on the property. One of the signs is 14 foot high by 4 foot wide.
The other sign is 15 foot high by 8 foot wide.
ERX will have event sponsor signs up during and in between events. ERX will comply with all
city codes set forth in the Elk River Zoning Ordinance.
In the future, we anticipate constructing a monument sign on ERX Properties that would exceed
30 square feet of changeable copy. We are including a changeable copy sign in this CUP
application. We will work with city staff and apply for any applicable sign permit(s).
Utility Plan
This property isn't currently in the Urban Service District therefore we don't require city
services at this time.
Wetland Delineation
In 2008, Todd Plaisted had a conversation with Rebecca Haug, the Environmental Administrator
with the City of Elk River. Rebecca stated that the current pond that is on the main ERX track is
an incidental pond created from mining.
In 2010, Anderson Engineering performed a Wetland Delineation on the go -kart track, at that
time Rebecca Haug was copied on the documentation of the report that stated this was an
incidental pond and not regulated by Minnesota Wetland Conservation Act.

In 2016, Anderson Engineering performed wetland delineation on the rest of this property. All
wetlands have been preserved in building the off -road truck track.
Grading
With the exception of the off -road truck track and the special event camping are, there will be
no grading changes from the current state, at which time, ERX will apply for necessary
permit(s).
Camping
As part of this CUP, per City staffs request, ERX is including unplatted Outlot A (PID: 75-
725 -0010) as a special events camping area. ERX will ensure all codes are met with the
Minnesota Department of Health. "Special event recreational camping area" means a
recreational camping area which operates no more than two times annually and for no more
than 14 consecutive days.
Economic Impact for the City of Elk River
Athletes, sponsors, business owners, attendees and event planners come to Elk River, MN from
all over the US, Canada and several Scandinavian countries to ERX Motor Park. As these
individuals travel here for ERX, the Elk River area experiences a significant positive financial
impact. The impacts are most significant during the winter snocross seasons as teams and
athletes continue to call Elk River "home" in their attempts to locate near the ERX track. Teams
support local businesses by utilizing local restaurants, hotels, municipal liquor stores, grocery
stores and gas stations. During large ERX events, the Elk River community is filled with teams,
families and spectators as they spend multiple days in the area participating in events at ERX.
Since our inception, there's been a handful of families who have purchased land in the Elk River
area to be closer to ERX, thus:
1) providing part-time housing for their family and team,
2) operating their respective business(es) and racing team operations),
3) leasing available space and
4) patronizing local businesses.

EXISTING STRUCTURES

Same Comments as October 4h, 2016 site plan review:
1. Stormwater management requirements are needed as listed in Ordinance
Sec. 78 -503. - Stormwater and urban runoff control. and Sec. 78 -504. - Post
construction stormwater management. NPDES permit is needed for
construction activity disturbing one acre or more of soil and all SWPPP details are
required (previous NPDES permit can be amended).

2. Also, a MIDS water quality report and soil borings showing the ground water depth
and infiltration rate is needed. Three feet of separation between the bottom of any
proposed infiltration basin is and groundwater is required.
