Background/Discussion
On October 17, 2016, the City Council denied two variance requests from Vanman Architects and
Builders that would have allowed a second freestanding sign and a height variance of 55.5 feet (75 foot
total height). After that action, Council directed staff to research how other cities handle religious
symbols, structures, and public art. Staff reviewed our ordinance and several other ordinances to
determine how these items are regulated.
The city's zoning ordinance includes the following sign regulations for each district. Religious signage
falls under the last category:
*For permitted nonresidential uses, such as churches, synagogues, and schools, in residentially zoned
areas, one on -premises freestanding sign and one wall sign, not to exceed 96 square feet in total sign area.
Where a zoning lot has in excess of 1,000 linear feet of combined street frontage, the total sign area shall
not exceed 192 square feet with no more than 96 square feet per sign. Freestanding signage shall not
exceed 20 feet in height.

City code provides signage opportunities for each district based on the potential impacts to surrounding
properties, the need for visibility and wayfinding, and community aesthetics. Religious signage is no
different, and due to their typical location within residential areas, signage is kept below that of
commercial areas. All uses have opportunities for signage, and staff does not recommend increasing the
signage available for religious institutions.
Staff s research into what other cities allow, specific to religious institutions, did not show anything
considerably different than what we currently allow. Cities outline height and area requirements, some are
larger/taller than ours, but nothing significantly different. One exception staff noted was from the City of
Minneapolis which exempts religious symbols from size limits when attached to buildings (wall signs),
but notes they cannot be illuminated.
Symbols and Signage
During the variance review, there was a discussion regarding symbols and whether or not a religious
symbol should be exempt from the sign ordinance. The following definition and scope, outlined in the
city code, may cause confusion in regards to symbols. All symbols, including religious symbols, are
considered a sign as stated in the definition. The city regulates many types of symbols (signs) used by
businesses to advertise their location and to draw people in. A few samples are shown on the attached
Symbol Exhibit. The purpose of a cross on/over a church is no different than golden arches on/over a
restaurant. Staff suggests that all symbols be regulated as signage and to modifying the language of
Section 30-852 to more clearly iterate that the content of all signs will not be regulated by Subdivision II.
Signs in the city code, which is the intent of Section 30-852(b).
Section 30-1. — Definitions.
Sign means any device, structure, fixture, or placard using graphics, symbols, and/or written copy
designed specifically for the purpose of advertising or identifying any establishment, product,
goods, or services.
Section 30-852. — Purpose, scope, and findings of subdivision.
(b) Scope. This subdivision shall not relate to building design, nor shall this subdivision regulate
official traffic or government signs; the copy and message of signs; window displays; product
dispensers and point of purchase displays; scoreboards on athletic fields; flags of any nation,
government, or noncommercial organizations; gravestones; barber poles; religious symbols;
commemorative plaques; the display of street numbers; or any display or construction not
defined as a sign in section 30-1.
Bell Towers — Accessory Structures
City code permits bell towers as an accessory structure in residential zones and a church may apply for a
permit to construct one in accordance with these regulations. Staff does not recommend any changes to
the current accessory structure regulations. The permitted height for a bell tower is as follows:

Section 152.033 SITE PLAN REVIEW
(D) Administrative Site Plan Review.
(1) Approval criteria. Site and building plans for projects maybe approved by the City
Manager in lieu of City Council approval if they meet the following criteria, except as
otherwise expressly provided in this chapter:
(b) Sites, buildings and uses that are permitted in the zoning district and do not require
any variances from this chapter or any other city code, with the exception of the
following:
(5) Religious institutions, either free-standing or within a multi -tenant building.
Section 152.093 TOWERS AND ANTENNAS IN RESIDENTIAL AREAS.
(B) Personal (non-commercial) radio and television towers and antennas that exceed the
maximum height defined elsewhere in the City Code and commercial towers shall be considered
conditional uses in residential districts. Commercial towers may only be allowed as a
conditional use on the following parcels:
(1) Religious institution sites, when constructed in or as part of a steeple, spire, bell tower or similar
architectural feature.
Section 152.181 RELIGIOUS INSITUTIONS
Religious institutions are permitted in various districts as outlined in §§ 152.242 and 152.342, but the
restrictions on it may differ based on the district in which the religious institution is proposed.
Architectural materials allowed for religious institutions shall follow the regulations for Business Districts
(see § 152.392).
(A) Green space/landscaped area in residential districts. No more than 60% of the site may be
covered by impervious surface. The remaining 40% must be landscaped or sodded. Tree and
shrub quantities shall be calculated using the B1 requirements of § 152.374(A)(2) for all religious
institutions located within a residential zoning district.
(B) Residential districts. Religious institutions may only be located on sites located directly at
the intersections of two collector streets or along an arterial street as designated in the
Comprehensive Plan.
(C) Business districts. In the B-3 Zoning District, religious institutions are only allowed as one
tenant in a multi -tenant building, up to 49% of the building, located on a single tax parcel. All
tenants must have separate, independent accesses through a public corridor or directly from
outside. All building code requirements must be met.

(D) An office for a religious institution is considered an office use provided no worship services,
events, or the like are conducted on site.
(E) Religious institutions with additional uses operating concurrently with a worship service
must be figured into parking requirements.
(F) Parking shall meet the requirements of § 152.142.
(G) All religious institutions are subject to Site Plan Review requirements of § 152.033.
(H) Religious institutions may conduct worship and educational programs as permitted
accessory uses in public schools in all zoning districts outside of normal school instructional
hours. Formal Site Plan Review as described in § 152.033(D)(1) is not required.
(1) Religious institutions in residential zones are allowed to operate a farmer's market as
described in § 152.362(G) by obtaining a conditional use permit.

placed or maintained in the public right-of-way and shall not be illuminated.
543.200. - Specific sign standards.
(a) In general. All signs shall conform to the applicable standards of Table 543-1, Specific Standards for
Signs in the Residence and ORI Districts, Table 543-2, Specific Standards for Signs in the OR2, OR3 and
Commercial Districts, Table 543-3, Specific Standards for Signs in the Downtown Districts, and Table 543-
4, Specific Standards for Signs in the Industrial Districts, and all other applicable regulations of this
chapter.

ORI Districts: public libraries, public parks, religious institution places of assembly, and schools (grades
K-12).

Sec. 64.401. -All signs.
No person shall place, erect or maintain a sign, nor shall a lessee or owner permit property under
his control to be used for such a sign, which does not conform to the following requirements and
without first obtaining the requisite permit for such sign. The following provisions shall apply in all
zoning districts, to all exterior signs visible from a public right-of-way, and to all interior window
signs with dynamic display that are within three (3) feet of a window and oriented toward and
visible from a public right-of-way.
(j) For parking lot areas, one identification sign not to exceed a total of fifteen (15) square feet in
area is permitted per parking lot entrance. An identification sign up to twenty-five (25) square
feet in area, however, may be permitted if such sign incorporates the following uniform parking
symbol: fifty (50) percent of the total sign area of the parking identification sign must bear
thereon a blue rectangle with a white letter "P" in Gothic type face with the letter "P" being not
less than fifty (50) percent of the area of the blue rectangle. The remaining portion of the sign
incorporating such a parking symbol may be used for other pertinent information. In addition to
the one (1) identification sign per parking lot entrance, however, one (1) directional sign not to
exceed a total of four (4) square feet is permitted per entrance or exit. Such directional signs
may be up to ten (10) square feet in area if they also incorporate the above -prescribed parking
symbol. These parking identification and directional signs are in addition to other signs
permitted in each zoning district. No sign shall project higher than fifteen (15) feet above grade.
For community centers and religious, civic and educational institutions, a maximum of two (2)
directional signs may be placed on private property along two (2) different arterial or collector
streets within two thousand five hundred (2,500) feet of the community center or institution,
providing a valid lease indicating the consent of the owners of the property where the signs are
to be located is on file with the city, that the gross surface display area does not exceed five (5)
square feet per sign on residential property or fifteen (15) square feet per sign on nonresidential
property and that the height does not exceed seven and one-half (7%) feet.
Sec. 64.502. - RL—RM3 residential and entirely residential uses in T1—T4 traditional neighborhood
districts.
(a) Identification signs:
(4) For parks, community centers, and religious, civic, educational or philanthropic institutions,
one (1) identification sign, not exceeding a total of thirty (30) square feet in area for each street
frontage, and one (1) bulletin board not exceeding a total of thirty (30) square feet in area. Such
bulletin board signs may be signs with dynamic display, which shall be monochromatic, shall not
scroll or change their displays faster than every twenty (20) minutes, and shall be turned off
between 10:00 p.m. and 7:00 a.m.
(5) No sign shall project higher than thirty (30) feet above grade.

(b) Temporary Signs
(4) For parks, community centers, and religious, educational, civic or philanthropic institutions,
portable signs and temporary signs are permitted for special events under the following
conditions:
a. Portable signs:
1. On zoning lots with a street frontage of three hundred thirty (330) feet or
less, the gross surface display area of the signs shall not exceed one hundred
(100) square feet. On zoning lots with a street frontage of over three hundred
thirty (330) feet, the gross surface display area of the signs shall not exceed
three hundred (300) square feet;
2. The signs shall be permitted two (2) nonconsecutive times per calendar year
for a period of not more than fourteen (14) days per time;
3. The signs shall not be flashing signs or located in a required yard, required off-
street parking space or maneuvering area, or public right-of-way.
b. Temporary signs.
1. The gross surface display area of the signs shall not exceed one hundred (100)
square feet;
2. The signs shall be permitted three (3) nonconsecutive times per calendar year
for periods of not more than thirty (30) days per time;
3. The signs shall not be flashing signs or located in a required off-street parking
space or maneuvering area, or public right-of-way
(5)No sign shall project higher than thirty (30) feet above grade.

60.424 Specific Policies: The following paragraphs contain the guidelines applicable to specific types of
design modifications which shall be considered by the approval authority.
Subd. 6. Height:
A. Type I Design Modification: The Zoning Administrator may permit as a Type I Design
Modification the following:
(1) Appurtenances attached to the side of the building or free standing such as private
antennas, chimneys, flagpoles, bell towers, smokestacks, steeples, spires, parapet walls,
skylights, Small nonutility WECS and WECS meteorological towers.
(2) Rooftop appurtenances such as fire escapes, antennas, satellite dishes, mechanical
penthouses, ventilators observation or bell towers, smokestacks, steeples, elevator
bulkheads, rooftop water towers or cooling towers, domes or spires, Small non-utility
WECS with no limitation on height, provided they do not occupy more than 25% of the
roof area and provided that all mechanical equipment is screened.
B. The limited modification of height requirements may be considered as a Type II Design
Modification. The zoning administrator and Commission shall investigate the effect of shadows,
loss of privacy, and the closing of views resulting from the contrast created between the height
and location of the proposed building with existing buildings or adjacent open spaces in making
a determination to approve the proposal. In addition, fire officials and building officials shall be
consulted to see if any public safety concerns will be created by the additional building height.
No more than 25% increase in height in any Residential District or 50% increase in height on a
parcel zoned in a non-residential district which abuts an R-Sa, R-1, CN -NR, R -1x, or R-2 District
may be considered as a Design Modification. In all other instances, up to 100% increase in height
may be considered.

92) TEMPORARY RELIGIOUS SIGN - A temporary Stake Sign used to provide the name of and direction to
a location occupied by a religious organization or religious group that temporarily operates in a school or
other facility. A temporary religious sign identifies the meeting location/address, website information,
hours of service, and/or telephone number of a religious organization or group.
a) Time - No sign permit required. A Temporary Religious Sign may be erected during times of
worship provided that the sign is placed no earlier than two (2) hours prior to worship and
removed no later than two (2) hours after worship.
b) Place. A Temporary Religious Sign shall be placed on private property with consent of the
property owner. Temporary Religious Signs shall be erected on private property not closer than
ten (10') feet from the edge of any street pavement or designated roadway or right-of-way.
c) Manner -The maximum area of a Temporary Religious Sign shall not exceed six (6) square feet.
The maximum height of a temporary religious sign shall not exceed four (4') feet. A temporary
Religious Sign shall not contain balloons, streamers, flags, pennants, or wind devices.
