The applicant, Frank Madsen, requests an administrative subdivision be approved to subdivide a six-acre parcel into one 2.5 and one 3.5 acre parcel. Analvsis History In March of 2000, the Elk River City Council approved a zone change and a land use amendment to allow Mr. Madsen to remove his property from the Urban Service District. This approval requires Mr. Madsen to maintain a 2 % acre minimum lot area, should he proceed to subdivide his parcel. Subdivision Requirements The proposed subdivision will create a 2.5 acre buildable lot located north of the applicant's home with access onto Proctor Road. The minimum lot width in the R1a (Single Family Residential) zoning district is 160 feet. The new parcel is proposed to have a lot width of 180 feet. As part of the approval process, the applicant will need to grant to the City drainage and utility easements, five feet along the side and ten feet along the rear and front lot lines. The applicant will also need to identify primary and secondary septic locations on the site. Access . As the new parcel will have frontage on County Road No. 77, the applicant or new owner will be required to received an access permit from Sherburne County for a driveway. The County has reviewed the request for an access permit for the new parcel and has denied the request, as the new driveway would not meet the County's spacing requirement. Mr. Madsen has three options for providing access to the subject parcel: 1. Create a private access easement over his parcel to Parcel A from his driveway; however, it has been the City's past policy to avoid private driveway easements wherever possible (Option A). 2. The parcel division could be reconfigured and Mr. Madsen's driveway relocated to meet the County's 330' spacing. The driveway could then straddle the common property line between both parcels in such a way that they could share one access point, similar to the recently approved administrative subdivision for Marlene Hentges near 213th Avenue (Option B). 3. The City could submit a letter to the County stating that it has no objection to a new driveway on County Road No. 77, at which point the County would then issue the access permit for Parcel A. It is staff's opinion that the City should not be requesting or objecting to . driveways on County roads. The County has adopted an access policy and S:\PLANNING\MICHMC\CCREPRTS\ASOO-7.DOC . . . The County has adopted an access policy and ordinance in order to provide safe traffic flow on its roads. The current ordinance does not have a variance mechanism but it is staffs understanding that one is being considered. City Engineer, Terry Maurer, has provided a memo which outlines staffs objection to getting involved in the County's regulatory role. Park Dedication and Fees The applicant will be required to pay park dedication and surface water management fees at the rate required by the City, once the subdivision has been approved. Recommendation Staff recommends that the City Council approve the request for an administrative subdivision with four conditions: 1. PARK DEDICATION FEES BE PAID. 2. SURFACE WATER MANAGEMENT FEES BE PAID. 3. DRAINAGE AND UTILITY EASEMENTS BE GRANTED ALONG THE PROPERTY LINES. 4. THE APPLICANT SHALL EITHER OBTAIN A PERMIT FROM THE COUNTY FOR ACCESS TO COUNTY ROAD NO. 77, OR IMPLEMENT EITHER OPTION A OR B TO PROVIDE ACCESS TO THE NEW PARCEL. Our spacing between accesses must be a minimum of 330', I measured it at 508' between Frank Madsen's driveway and the next driveway north. If you placed your driveway at the midpoint it would only be 254'. The minimum highway frontage must be 200', the drawing shows 180'. I talked with Steven Wensman, planner for the City of Elk River about our concerns. Under our ordinance no new parcel can be created that does not meet the minimum frontage requirement and an access permit cannot be granted on a new parcel that does not meet the spacing requirement. Therefore, unless requested by the City of Elk River your access permit is denied. One solution is to change the boundary of your common lot line and possibly the position of Mr. Madsen's driveway. Box 490 Elk River, MN 55330-0490 RE: HERRBOL T DRIVEWAY ACCESS COUNTY ROAD 77 Dear Ms. McPherson: I have reviewed a copy of Sherburne County's letter denying the driveway access for the Herrbolt property dated July 24, 2000. The letter is signed by Richard Corbin, Sherburne County Public Works. Mr. Corbin states that the County policy regarding driveway accesses onto a road such as County Road 77 is a minimum of 330 feet between driveways. In reviewing the Sherburne County Transportation Plan, Table 11, a copy of which is attached, this is the least restrictive of all roadway types. I believe that the County policy is reasonable for trying to control the spread of additional accesses onto County roads. As you are aware, there are a number of existing driveways on County Road 77 and other County roads throughout the City of Elk River and Sherburne County that do not meet the recently adopted standards. This, however, is not a reason for allowing additional driveways to be constructed on these County roads. As development and the population continue to grow in Elk River, so will the vehicle traffic on all roads, especially the County road system. Minimizing the number of access points will reduce conflicts, increase the efficiency of the road to carry the higher expected volumes, and provide for a safer environment for the motoring public. I have reviewed the proposed lot split of the Madsen property which Mr. Herrbolt is proposing to develop, and I have also reviewed the aerial photo which shows the existing development on the parcel that the Madsens will retain. It appears with some additional work and expense, the Madsens and Herrbolts could combine in a joint driveway off of County Road 77, which would service both properties and meet the Sherburne County access spacing guidelines. Mr. Corbin's letter rejecting the Herrbolt application for the driveway access does indicate that, unless requested by the City of Elk River, the access permit is denied. I do not believe, nor recommend, that the City of Elk River intercede on the part of Mr. Herrbolt.
