Windsor Development L.L.P. is requesting final plat approval of Windsor Oak

Overview
The applicant is requesting final plat approval of a 40- lot subdivision with
two outlots, out of a 69.40-acre parcel in the Rlc, single-family residential
zoning district. The property lies west of County Road 1 and North of
. Meadowvale Heights and Meadowvale Heights Park. The final plat is the 31-

acre, first phase of the development that when built out will include 87
single-family homes. The final plat differs from the preliminary plat because
of County Road 1 access issues and also to reflect the City Council's request
that Lot 16, Block 2 of the preliminary plat be added to the parkland
dedicated. The City Council approved the preliminary plat on October 18,
1999.
Lot Size
There are 40 lots in the first phase of the development with lots ranging from
.27 acres to 2.49 acres in size. All of the lots conform to the minimum
requirements of the Rlc zoning district.
Access to Countv Road 1
Since the preliminary plat approval, the road intersection with County Road
1 has been moved and the lots reconfigured. The County is requiring a turn
lane and the former intersection with County Road 1 would have required the
filling of a wetland. The entrance road has been relocated to the south to
avoid the wetland. The City Engineer has no issues with the new location.
Future Access to Landers
Access to Landers Street was an issue at the time of the preliminary plat
approval. Outlot A in the M-vale subdivision was originally created for a
future road connection from Landers Street. Outlot A was privately owned at
the time of preliminary plat, but has now been deeded over to the City of Elk
River. Phase II of Oak Hill will connect to Landers Street.

LandscaDine and Screenine
The developer intends on constructing a 6' wood fence along the County Road
1 right-of-way with conifer trees to provide screening. Street trees and yard
trees will also be provided as required by City Ordinance.

Park Dedication
To fulfill the park dedication requirements, the developer will be dedicating
Outlot B as park. Outlot B is 12.75-acres in size of which 7.74-acres is
wetland. Credit will be given towards park dedication for the 5-acres of
upland. The remainder of the required park dedication will be accepted as
cash in lieu ofland at the $1400/lot rate. The developer will be constructing a
trail through the park and will receive a credit for the cost of the trail
construction at the rate of $14.00/ LF.
Recommendation
Staff recommends that the City Council approve Resolution 00-_, granting
approval of the Windsor Oak Hill final plat.

Dear Mr. Wensman:
The Developer of Windsor Oak Hill (formerly Seven Oaks) is requesting final plat
approval for the first phase containing 40 lots. Within the past several weeks, the
Developer's engineer has resubmitted a grading, drainage, and erosion control plan and
storm sewer calculations. Based on our review of those documents and information
from our project file, we would offer the following comments regarding the first phase
final plat:
1. The two critical issues with the preliminary plat have now been resolved. First was
the access onto CSAH 1 relative to Sherburne County's comments. If you recall,
Sherburne County has required a right turn lane which, with the original access
point on CSAH 1, would have required filling of a wetland. The Developer has now
moved the access point further to the south so that the improvements on CSAH 1
that the County has requested do not impact the wetland. The second issue
revolves around access on the extreme west end of the plat. One of the conditions
in preliminary plat approval was that the Developer acquire control of Outlot A of
M-Vale Addition for a street connection. It is my understanding that has now been
accomplished.
2. We have reviewed the revised grading, drainage, and erosion control plan. We
have several minor comments but nothing significant enough to hold up approval
of the final plat. We will be working with the Developer'S engineer to iron out the
last few issues so that a final approved grading plan can be accomplished. There
will need to be some additional easements added to the final plat for cross lot
drainage.
3. The drainage calculations that were submitted have been reviewed and are
generally acceptable. We are going to ask the Developer's engineer to provide
additional information to further clarify a couple of assumptions in his drainage
calculations.

4. There are several other issues that staff will be working through with the Developer
and his engineer as the plat moves forward. These include items such as the
requirement for snow storage easements in the cul-de-sac areas. These
easements, I believe, are of the type that cannot be shown on the final plat and
must be a separate recordable document. Another issue that we will be working
with the Developer and his engineer on is the looping of the watermain. As you are
aware, this plat is in the extreme northwest comer of the Urban Service District;
therefore, it will be difficult, but essential, to provide some looping of the water
system through the plat.
5. The seal coat impact fee for this plat is $4,900.
In conclusion, we see no major issues that should hold up the approval of the final plat.
Therefore, we would recommend approval of the first phase of the Windsor Oak Hill final
plat.

A RESOLUTION GRANTING FINAL PLAT APPROVAL FOR:
Windsor Oak Hill
Case No. P 99-9

WHEREAS, application has been made for final plat approval, pursuant to
Section 1008.08 (l)(c) of the Elk River City Code of Ordinances, of the property
legally described on attached Exhibit A and hereinafter referred to as "the
Property"; and
WHEREAS, the application for preliminary plat approval has been referred
to the Planning Commission which has given its advice and recommendation to the
City Council; and
WHEREAS, a preliminary plat of the Property was approved by the City
Council on October 18, 1999; and
WHEREAS, the proposed final plat is consistent with the preliminary plat as
approved by the City Council; and
WHEREAS, the proposed final plat complies with each of the conditions set
forth by the City Council in its approval of the preliminary plat of the Property;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF ELK RIVER, as follows:
1. It is hereby determined by the City Council for the City of Elk River as
follows:
A. The prpposed subdivision is consistent with the Zoning Ordinance
and conforms to all of its requirements.
B. The proposed subdivision is consistent with all applicable general
and specialized city, county, and regional plans including, but not
limited to, the City's Comprehensive Development Plan.
C. The physical characteristics of the site, including, but not limited
to, topography, soils, vegetation, susceptibility to erosion and
siltation, susceptibility to flooding, and drainage are suitable for the
type and density of development and uses contemplated.

D.
The proposed subdivision makes adequate provision for water
supply, storm drainage, sewage transportation, erosion control and
all other services, facilities and improvements otherwise required
herein.
E. The proposed subdivision will not cause substantial environmental
damage.
F. The proposed subdivision will not conflict with easements of record
or with easements established by judgment of a court.
G. The proposed subdivision will not have an undue or adverse impact
on the reasonable development of neighboring land.
2. Final plat approval is hereby granted for the Property, subject to the
conditions set forth in attached Exhibit B.
3. The officers of the City are hereby authorized, once the conditions set forth in
Exhibit B are met and complied with, to sign the final plat for the Property
and to issue a certified copy of this Resolution giving final approval of the
plat.
4.
The owner of the Property is authorized to record the final plat as required
by law and shall file proof of said recording with the City. No building
permits will be issued for the Property until the final plat is recorded.

5. This final plat approval shall expire one year from the date of this resolution
if the final plat is not recorded within that time.

PLAN BE SUBMITTED AND APPROVED BY THE CITY ENGINEER PRIOR TO
ISSUANCE OF BUILDING PERMITS.
16. THAT LANDSCAPING PLAN BE SUBMITTED THAT SHOWS THE REQUIRED
STREET AND YARD TREES AND SCREENING ALONG COUNTY ROAD 1.
17. THAT ALL THE MAIL BOXES IN THE CUL-DE-SACS BE CLUSTERED.
