Background/Discussion
Case No. CU 16-30
The property is zoned Extreme Commercial Recreation (XCR) where Off-road Racing Facilities require a
Conditional Use Permit (CUP). The applicant is seeking a CUP to combine and operate three Off-road
Racing Facilities (ERX track,TORC track, and go-kart track) into one 42.48 acre parcel.
State statute limits municipal approvals when a property is undergoing an Environmental Assessment
Worksheet (EAW) review. This property is currently under such a review for the off-road racing
facilities, specifically the anticipated attendance for their larger events. The comment period for the EAW
has closed, and staff is working with ERX to finalize the document and bring it forward to the City
Council for approval in early January.
Planning Commission Meeting Summary
Staff presented the plat and CUP to the Planning Commission on November 29, 2016, to ensure
comments could be addressed prior to Council action in January. No one spoke for or against the request
during the public hearing, and staff has not received any comments since the Planning Commission
meeting.
The Planning Commission had no comments or concerns and the applicant has no issues with the
recommended conditions. The Planning Commission unanimously recommended approval of the
request.

Statutory Review Period
Per State Statute 15.99 the required 60-day review period was extended to January 24, 2017.
