Background/Discussion Case No. P 16-18 The property is on the east side of Elk Lake Rd NW across from the intersection of 2091h Ave and zoned R-1a Single Family Residential with a minimum lot size of 2.5 acres and 160 feet of public street frontage. The applicant is proposing to split the property into two parcels, one new buildable lot, and one lot for the existing home. The proposed lot,with the existing home,is 2.62 acres and the buildable lot is 3.96 acres. The remaining 2.16 acres will be dedicated as public right-of-way. Analysis Comprehensive Plan The property has a Rural Residential Land Use and the chief land use in this area is single family detached homes without public utilities. Parks and Recreation The Parks and Recreation Master Plan provides guidance for trails along arterial roadways (e.g., Elk Lake Road), specifically"prioritize trails or other safety measures in places with low visibility or other POWERED 6T A IR dangerous conditions (curves, topographic change,build entrances, difficult intersections, etc.). Aim for a trail on one side of the street on all collector and arterial streets." Trail Connectivity, as indicated in the Master Plan on exhibit 5.6, shows a trail corridor along Elk Lake Rd NW. Staff recommends locating the trail on the west side of Elk Lake Rd. Parks and Recreation Commission - October 12, 2016 The Parks and Recreation Commission, on October 12, 2016,recommended Park Dedication be paid for one dwelling unit. The current rate is $1,425.93 per dwelling unit. Staff will determine the final amount when the plat is released for recording. On October 12, 2016, the Parks and Recreation Commission was made aware of the topography, curves, and other physical features along this area. The Commission recommended (7-0) that a trail easement be required along the western side of the subject property (i.e., east side of Elk Lake Rd NW). No direction on easement width was provided. The City Council approved the plat on October 17, 2016,with the Park and Recreation Commission recommendation to include a trail easement, again no easement width was specified. City Council Meeting- November 21, 2016 During the Open Forum at the November 21, 2016, City Council meeting, the applicant spoke, stating they were confused about the approved trail easement. As they interpret the tail location of the Parks Master Plan to be along the west side of the road, the applicant questioned why an easement was required when their property is on the east side of the road. The City Council directed the applicant to reapply for the plat requesting the trail easement on the property to be removed. Parks and Recreation Commission - December 14, 2016 On December 14, 2016, the Parks and Recreation Commission re-reviewed the application. The applicants spoke during the public hearing and questioned how the city can require an easement on the east side of Elk Lake Road when the Master Plan shows a future trail that appears to be on the west side of Elk Lake Road. They stated that if the intent was to leave opportunities for interpretation of a future trail location, the map is unclear and misleading to the public. They also questioned how the city can require a cash dedication for Park Dedication, as well as an easement for public use. They understand they own the land under the easement but when a trail is constructed on their property for the public,it becomes "public land" and not just their land. They feel it is two forms of dedication. The Commission recommended (4-3) that a 10-foot trail easement be required along the western side of Lot 2 Block 1 of the proposed plat (i.e., east side of Elk Lake Rd NW). Applicable Regulation Approval of a plat may only be ordered if the following findings have been made, as outlined in Section 30-375: 1. On November 21, 2016, Deb and Roger Whiteoak spoke during the City Council Open Forum indicating they were confused why an easement was being required when the Master Plan does not contain trails on their side of the road? They asked if it could be amended because they did not want to provide the easement for the following reasons: • The Council approved Parks and Recreation Master Plan clearly indicates “Other Future Trails” along the west side of Elk Lake Road. • Providing a 20-foot wide easement along the entire western property line would be providing about 1 acre of additional land above and beyond the cash dedication. • A trail installed in this area would take out all of the trees that provide the buffer from County Road 1. The subject property does not meet this requirement. Therefore, staff recommends the Parks and Recreation Commission recommend Park Dedication be in the form of cash. Trail Connectivity, as indicated in the master plan, indicates “Other Future Trails” are desired along the west side of Elk Lake Rd NW. The subject property is on the east side of Elk Lake Rd so the trail connectively plan does not apply in this case, therefore no easement is needed for a trail. During the October 12, 2016, a Parks and Recreation commission member stated the trail would be best on the east side of the County Road 1 because of an existing trail and proximity to a regional park in the area. Another commission member asked if the Master Plan (trail plan) was side specific? The trail connectivity exhibit clearly shows the trail on the west side of County Road 1. The tools city staff uses to communicate with and to make recommendations to the various public bodies are the City Council approved plans. These plans include, but not limited to, the Land Use Map, Zoning Map, Parks and Recreation Master Plan, Mississippi’s Connections, FAST, and the Gravel Mining Area Land Use, Transportation, and Utility Plan. The intention of these plans is to create a comprehensive plan of the city while taking out the guess work for individual properties and analyzing them case by case. On all of these plans, graphics are utilized extensively. If, for instance, the zoning map shows a property is zoned residential, it cannot arbitrarily be recommended to be commercial for various reasons. Those decisions have already been previously made and approved by the City Council. Staff continues to recommend that park dedication be in the form of cash and no easement be recommended as the approved Parks and Recreation Master Plan does not indicate “Other Future Trails” along the east side of Elk Lake Road adjacent to the subject property. Master plans developed by the city are intended to evaluate a comprehensive system and establish plans to guide city decisions, thus taking out the guess work for individual properties and analyzing them case by case. These types of plans typically include graphics which are utilized extensively to make decisions. Staff's interpretation of the Parks Master Plan,based on text and the map graphics,is the trail along Elk Lake Road is located on the west side and that an easement should not be required on the subject property. Without direction, Commission Chair, Dave Anderson, contacted Hoisington Koegler Group Inc. (HKGi),who drafted the Master Plan, and requested clarification on the intention of the Master Plan graphics. Attached is a memo from Paul Paige of HKGi with his interpretation of the Master Plan Exhibit 5.6. However, decisions cannot be made based on intent but rather all decisions must be made based on plans approved by the City Council. N:APublic Bodies\Agenda Packets\12-19-2016\Final\7.4 ot8 P&R Memo.docx                                                    MEMORANDUM  .   TO:   Michael Hecker, Elk River Parks and Recreation Director   FROM:  Paul Paige, PLA  DATE: December 14, 2016  SUBJECT:   Parks and Recreation Master Plan interpretation request        In response to a request today from PRC Chair Dave Anderson, I have reviewed the 2015 Parks  and Recreation Master Plan completed by HKGi and offer the following interpretation related  to Figure 5.6 Trail Connectivity on page 56 of the document:    The intent of the Trail Connectivity Map is to identify existing trails in Elk River and show  conceptual connections for future trails in support of Initiative 3 in the Master Plan – to  “Strengthen Trail Connections”.  The map is to identify future connectivity opportunities.   Specific trail alignments, and whether they end up being a widened shoulder, or separated  from the roadway and on one or both sides of a particular corridor will need to be evaluated  independently at the time of roadway construction/reconstruction and will be driven by many  potential constraints including physical features (topography, wetlands, existing trees) available  easements and/or right of way, and available funding for new trail facilities.    The map is diagrammatic and is not intended to be read literally as it relates to precise  alignment or location of existing or proposed trails within a connection corridor or alongside  existing roadways.  For example, the existing trail shown in solid green on the map for the  southern portion of County Road 1 is illustrated to show that there is a trail existing, however it  is not shown offset from the existing road line on the map.  Any graphic offsets shown on the  map where a future path is shown on a specific side of a roadway are due to complexities of  drafting a map at a scale where the entire City is shown on a single 8.5 x 11 page of the report.     The Master Plan does identify more specific recommendations about some future trails, for  example there is language on page 55 that states “Provide trail access along south side of Hwy  10 from Proctor to Orono Park when the Hwy 10 bridge is replaced”    I hope that this clarification is helpful as you continue to use the Master Plan to direct decisions  related to parks and trail investments and opportunities in Elk River.  I am available if additional  clarification is needed.    Simple PlatWhiteoak BackgroundLot 1, Block 1 RightLot 2, Block 1 -of-Way –––2.16 acres2.62 acres (Existing Lot)3.96 acres (New Lot) Parks and RecreationCash dedication for one lotTrail easement Preliminary PlatFinal Plat Action Requested Approve, by motion, the preliminary plat and the conditions in the memo.resolution granting final plat for Whiteoakwith the
