Conditional Use Permit
The Hillside Crossing II Planned Unit Development (PUD) was established in 1996. The applicant is
requesting an amendment to the PUD agreement to allow freestanding signage for the Samaritan Way
Thrift Store to span the width of the existing freestanding Menards sign and ensure compliance for the
existing sign. The applicant is proposing to update the PUD agreement to allow additional signage on
the Menards sign to be 15-feet wide and a maximum height of 35 feet.
Staff proposes updating Attachment A of Exhibit F,which includes the sign regulations, specific to the
Menards freestanding sign to the following:

2. One freestanding development sign identifying the HILLSIDE CROSSING II PROJECT.
This sign is permitted within the triangular corner of Outlot G, HILLSIDE CROSSING H
Lot 1 Block 1, HARLEY ADDITION.
3. This sign may have a maximum height of thirty-five (35� feet and width
of thirty-four (34) feet. Multiple tenants may be identified on this sign; as illustrated on
Attachment A.

The proposed amendment will provide additional space between the Menards and additional tenant
signs,while also providing a uniform look for the sign. The proposed amendment will not impact
freestanding signs, other than Menards.
Staff supports the amendment to improve consistency with other commercial properties located along
Preliminary and Final Plat
The applicant is requesting a Preliminary Plat to combine the two adjacent parcels that Menards currently
occupies. The parcels are located on different plats,which require a formal platting process. Menards is
taking ownership of this portion of land and is asking to add this portion to the Menards Addition plat in
order to have one contiguous lot.
The proposal meets the design standards for lot size and frontage.
Park Dedication
Park Dedication is not required as no additional lots are created and Park Dedication was already paid.
The proposed change satisfies the request from Menards,while maintaining the intent of previous
amendments to the Hillside Crossing PUD as they relate to freestanding signs along Highway 169.
Planning Commission Meeting
No one spoke for or against the request and staff has not received any comments from the public. The
Planning Commission unanimously recommended approval.

RE: Menards Sign PUD Amendment & Plat
Dear BrieAnna,
Menard, Inc. is submitting a PUD amendment for the highway sign facing 169. The sign was designed as
part of the original PUD and while the Menards panel on that sign matches that PUD the panel below
Menards does not match the PUD regulations. Menards plans to move the Samaritan Way Thrift Store
panel down three feet below the bottom of the Menards panel to separate the signs. Today the sign
looks like it is advertising a Menards thrift store and that does not help either of our businesses.
The PUD in place limits the width of a sign panel below the Menards panel to 13 feet wide. However the
distance between the poles is 15 feet. Menards is requesting the PUD is amended to allow the
additional foot on each side of the sign to cover the full 15 foot width between the poles to avoid
unsightly brackets holding the panel in place. It should be noted that the existing sign was installed at
some point at a width of 15 feet wide and has not caused any issues. There are no plans to add
additional panels below the Samaritan Way panel so the overall surface area on the sign will stay the
same.
Menards has also submitted a preliminary and final plat for review. A small portion of the paved yard on
the south side of the property is owned by the neighbor and through an agreement set up many years
ago has stayed in his ownership. Menards is going to take over ownership of that property and add it to
the overall Menards store lot. The plats add that parcel to the Menards store lot making it one
contiguous lot. No other changes were made to the plats beyond adding that property.

I. SI N REQUIREMENTS
a. Sreneral Qui elines
All signs within HILLSIDE CROSSING II Planned Unit Development
(PUD) must consist of materials and a design which compliments the
architectural elements of the principle building and character of the project.
2. All free standing signs shall have a minimum ten (10) foot setback from all
property lines.
3. Prior to installing any signs, a sign permit must be obtained from the City
of Elk River Planning Department.
b. Development Sign (Along Highway 169)
1. One freestanding development sign identifying the HILLSIDE CROSSING
II PROJECT. This sign is permitted within the triangular comer of Outlot
C, HILLSIDE CROSSING II.
2. This sign may have a maximum height of Twenty -Seven (27) feet and
width of Thirty -Four (34) feet. Multiple tenants may be identified on this
sign; as illustrated on Attachment A.
C. Monument Sign for Freectar, ing Sites
Each of the freestanding buildings, other than Menards, within
HILLSIDE CROSSING II will be allowed to have a freestanding
sign. The freestanding sign must be of a monument style with a
maximum height of Ten (10) feet and a maximum area of One Sign
Hundred (100) square feet, as shown on Attachment C.

d. Wall Signs (Freestanding Sites)
Wall signage for each freestanding building, other than Menards,
must consist of individual letters and shall not have more than One
(1) wall sign for each principle building.
The gross surface area of a wall sign for freestanding buildings shall
not exceed Ten (10) percent of the area of the building wall,
including doors and windows, to which the sign is to be affixed.
3. Menards will have a principle wall sign (MENARDS) that will have
the letters be collectively a maximum of Fifty - Two (52) feet in
width and Six (6) feet in height. Menards will have Eight (8)
Product Signs (10.3 s.f. - 20 s.f.), a 60 s.f. Welcome Sign, and In
& Out Entrances signs, as shown on Attachment D 1, D2, and D3.
4. No wall signage will be permitted on a building wall facing a
residential district on the east side of Highway #169.
e. Wall Signs (Multi Tenant Building)
1. Fascia signs for individual retail tenants shall be for store identity
only.
2. Capital letters shall be no larger than 32" high, lower case letters
shall be no larger than 24" high. Signs shall be located on west and
south sides of the freestanding buildings in a symmetrical manner,
but in no case shall extend closer than 3'- 4' from the projected
lease line.
3. These signs may be internally illuminated, individual letters placed
on a 4" square electrical raceway, painted to match the building
facia.
4. No signage shall be permitted on the north or east side of the
buildings, other than that required for delivery identification or
traffic control.

All other signage that may occur within HILLSIDE CROSSING II
PUD and not specifically mentioned herein shall comply with
Section 900.22 of the Elk River City Code.
2. Requests for signage shall be consistent with the conditions,
character, and intent of the HILLSIDE CROSSING II PUD
development.
3. Signage not consistent with the HILLSIDE CROSSING II
Commercial PUD may be denied unless approved by the City
Council.

A Resolution of the City of Elk River Granting Final Plat for
Menards Second Addition

WHEREAS, application has been made for final plat,pursuant to Section 30-374 of the
Elk River City Code of Ordinances, of the property legally described on attached Exhibit A
and hereinafter referred to as "the Property"; and
WHEREAS, a preliminary plat of the Property was approved by the City Council on
December 19, 2016; and
WHEREAS, the proposed final plat is consistent with the preliminary plat as approved by
the City Council; and
WHEREAS, the proposed final plat complies with each of the conditions set forth by the
City Council in its approval of the preliminary plat of the Property;
NOW, THEREFORE, BE IT RESOLVED
1. It is hereby determined by the City Council for the City of Elk River as follows:
A. The proposed subdivision is consistent with Chapter of 30 of the City Code
of Ordinances and conforms with all of its requirements.
B. The proposed subdivision is consistent with all applicable general and
specialized city, county, and regional plans including,but not limited to, the
City's Comprehensive Plan.
C. The physical characteristics of the site,including,but not limited to,
topography, soils,vegetation, susceptibility to erosion and siltation,
susceptibility to flooding, and drainage are suitable for the type and density
of development and uses contemplated.
D. The proposed subdivision makes adequate provision for water supply, storm
drainage, sewage transportation, erosion control and all other services,
facilities and improvements otherwise required herein.
E. The proposed subdivision will not cause substantial environmental

easements established by judgment of a court.
G. The proposed subdivision will not have an undue or adverse impact on the
reasonable development of neighboring land.
2. Final plat approval is hereby granted for the Property.
3. The officers of the City are hereby authorized to sign the final plat for the Property
and to issue a certified copy of this Resolution giving final approval of the plat.
4. The owner of the Property is authorized to record the final plat as required by law
and shall file proof of said recording with the City. No building permits will be
issued for the Property until the final plat is recorded.
5. This final plat approval shall expire two years from the date of this resolution if the
final plat is not recorded within that time.
