Action Requested
Recommend,by motion,park dedication for the Whiteoak Plat as cash for one dwelling unit at the City
Council-established rate when the subdivision is released for recording.
Background/Discussion
On October 12,2016,the Parks and Recreation Commission reviewed this preliminary plat and
recommended Park Dedication be paid in the form of cash as well as provide an unspecified width of
land along the western side of the subject property.
On October 17,2016,the City Council approved the Final Plat with the following conditions:
1. Park Dedication Fee shall be paid for one dwelling unit at the rate applicable when the
subdivision is released for recording. The current rate for low density residential is $1,425.93 per
dwelling unit.
2. Surface Water Management Impact Fee shall be paid for one dwelling unit at the rate applicable
when the subdivision is released for recording. The current rate is $113 per lot.
3. The plat shall not be released until the wetland delineation is approved by the Technical
Evaluation Panel and updated as directed.
4. Submittal of written approval from Sherburne County permitting an additional driveway for the
new parcel.
5. Staff approval of all required development and grading plans.
6. A trail easement shall be required along the entire western side of the subject property.
On November 21,2016,Deb and Roger Whiteoak spoke during the City Council Open Forum indicating
they were confused why an easement was being required when the Master Plan does not contain trails on
their side of the road? They asked if it could be amended because they did not want to provide the
easement for the following reasons:
• The Council approved Parks and Recreation Master Plan clearly indicates "Other Future Trails"
along the west side of Elk Lake Road.
• Providing a 20-foot wide easement along the entire western property line would be providing
about 1 acre of additional land above and beyond the cash dedication.
• A trail installed in this area would take out all of the trees that provide the buffer from County
Road 1.

NATURE
Parks and Recreation Master Plan
The Neighborhood Parks Service Area text in Chapter 5 of the master plan states, recreation facilities should
be developed when 300 or more households within cluster developments or on lots less than 2 acres are located within 1.5
miles of the park.The subject property does not meet this requirement. Therefore,staff recommends the
Parks and Recreation Commission recommend Park Dedication be in the form of cash.
Trail Connectivity,as indicated in the master plan,indicates "Other Future Trails" are desired along the
west side of Elk Lake Rd NW. The subject property is on the east side of Elk Lake Rd so the trail
connectively plan does not apply in this case,therefore no easement is needed for a trail.
During the October 12,2016,a Parks and Recreation commission member stated the trail would be best
on the east side of the County Road 1 because of an existing trail and proximity to a regional park in the
area. Another commission member asked if the Master Plan (trail plan) was side specific? The trail
connectivity exhibit clearly shows the trail on the west side of County Road 1.
The tools city staff uses to communicate with and to make recommendations to the various public bodies
are the City Council approved plans. These plans include,but not limited to,the Land Use Map,Zoning
Map,Parks and Recreation Master Plan,Mississippi's Connections,FAST,and the Gravel Mining Area
Land Use,Transportation,and Utility Plan. The intention of these plans is to create a comprehensive
plan of the city while taking out the guess work for individual properties and analyzing them case by case.
On all of these plans,graphics are utilized extensively. If, for instance,the zoning map shows a property
is zoned residential,it cannot arbitrarily be recommended to be commercial for various reasons. Those
decisions have already been previously made and approved by the City Council.
Staff continues to recommend that park dedication be in the form of cash and no easement be
recommended as the approved Parks and Recreation Master Plan does not indicate"Other Future Trails"
along the east side of Elk Lake Road adjacent to the subject property.

and the trail connectively plan should not apply, the Parks and Recreation Commission
recommended that a trail easement be required along the entire western side of the subject property.
A width of the easement was not recommended. The Commission was also informed of the steep
slopes along the western side of the subject property. Without doing design and engineering of the
area,it will be difficult to determine a suitable width of an easement.
