Aerial Photo of site Overview: The applicant is requesting a conditional use permit to keep horses in the RIa zoning district. The keeping of horses is a conditional use in the RIa zoning district if the property is less than 5 acres in size. The subject property is 4.2 acres in size. . 13065 Orono Parkway. P.O. Box 490. Memo to the City Council/CD 00-40 November 20, 2000 Page 2 The applicant intends to enclose a 160 FT x 730 FT area (2.68 acres) with a fence to use as a pasture. The area proposed for the pasture is a mostly wooded area with a mix of wetland and upland forest. The area had no standing water at the time staff visited the site, however there is evidence of standing water on the aerial photo and by an analysis of plant species that occur on the site. With a 2.68-acre pasture, City Ordinance allows the keeping of two horses. Countv Ditch #28 County Ditch #28 crosses the rear of the property. To protect water quality in the City and to maintain the ditch easement free of structures, staff recommends that the pasture area be shortened to exclude the ditch area with a 20 FT buffer strip. With the ditch and buffer excluded from the pasture, the pasture will be approximately 160 FT x 640 FT, (over 2 acres in size) . Accessory Structures The applicant intends to construct a 22 FT x 27 FT horse barn to provide shelter for the horses. With the horse barn, the property will have less than the maximum 3000 SF of allowed accessory structure area allowed by City Ordinance. Setbacks The proposed barn and fence conform to the setback requirements. Planninl! Commission At the November 14, 2000 Public Hearing, there was no public opposition. Recommendation Staff and the Planning Commission recommends that the City Council approve the conditional use permit to keep horses with the following conditions: 1. THAT THE ANIMAL WASTE BE DISPOSED OF PROPERLY AS REQUIRED BY CITY ORDINANCE. 2. THAT A BUILDING PERMIT BE OBTAINED FOR THE PROPOSED HORSE BARN. 3.
