West, Fire Chief DATE: December 11, 2000 SUBJECT: Consider Resolution Authorizing Use of City Equipment and Services in Emergency Situations . The attached resolution represents the use of city equipment and services in an emergency situation. Many times in the past, incidents have occurred outside the territorial limits of the city where services have been dispatched to assist other communities. This resolution is formally authorizing the city administrator or his/her designee to dispatch city equipment and personnel as deemed necessary within or outside of city boundaries. The Federal Emergency Management Agency (FEMA) requires all communities to have a formal resolution authorizing the use of city equipment in emergency situations. This resolution simply formalizes a practice that has occurred in the past in anticipation of instances in the future where city equipment may be needed outside of our city limits. I will be in attendance at the December 11, 2000, City Council meeting to address any questions the mayor and council may have in regard to this Issue. A RESOLUTION OF THE CITY OF ELK RIVER A RESOLUTION GRANTING THE CITY ADMINISTRATOR THE AUTHORITY TO DISPATCH CITY EQUIPMENT AND PERSONNEL IN EMERGENCY SITUATIONS WHEREAS, The City Council finds that instances have occurred in the past and can be anticipated in the future wherein there is a danger, by fire, hazard, casualty or other similar occurrences taking place or occurring outside the territorial limits of the City of Elk River: and by the suddenness thereof it would be impossible or impractical for the City Council to meet and authorize the dispatch and use of City equipment and personnel to combat such fire, hazard, casualty or other similar occurrence: therefore, . BE IT RESOLVED that the City of Elk River finds it desirable and necessary to authorize the City Administrator or his/her designee to exercise discretion, considering at all times and in each case the internal needs of the City of Elk River and its inhabitants to dispatch City Equipment and personnel as deemed necessary to combat such occurrence whether it takes place within or without the City boundaries. BE IT FURTHER RESOLVED that such dispatch and use as directed by the City Administrator or his/her designee shall be fully authorized as an act of the City of Elk River and all provisions for compensation of personnel, rental of equipment, liability insurance coverage, workers' compensation insurance and all other safeguards and matters pertaining to the City its equipment and personnel, shall apply in each case as if specifically authorized and directed by this City Council at such time, whether or not the governing body or authority of the place in which the fire, hazard, casualty or other similar occurrence exists, has previously requested and provided for assistance and the use of the equipment and personnel under a mutual protection agreement or other type protection agreement with the City of Elk River. FURTHER, the City Administrator or his/her designee shall recall, order, and terminate the use of such equipment and personnel when the need for their use no longer exists, or earlier, when at his/her discretion it appears in the best interest of the City of Elk River.
