Action Requested
Recommend,by motion, approval of the Conditional Use Permit with the following conditions:
1. The Conditional Use Permit shall not be recorded until all conditions have been completed.
2. The Environmental Assessment Worksheet (EAW) shall be complied with.
3. The applicant must apply for and receive approval for all required permits before any
construction may begin.
4. The city's Building Official and Fire Marshal shall inspect the building for compliance with all
state and local building codes.
5. Hours of operation shall be limited to Monday through Saturday 7:00 a.m. — 10:00 p.m. and
Sunday 8:00 a.m. — 8:00 p.m.
6. An amendment to this CUP will be required for future expansions/additions not shown on the
site plan dated January 17, 2017.
7. Staff approval of a spectator safety plan.
8. Staff approval of an on-site traffic/ distribution plan that demonstrates:
a. Logical on-site distribution of participants, spectators, and public safety.
b. Adequate on-site stacking for admission and egress.
c. Adequate off-site stacking for access and egress without impacting U.S. Highway 169.
9. Except for team and sponsor vehicles/trailers, no overnight parking shall be allowed.
10. No more than two Special Event Recreational Camping events per year shall occur.
11. All sources of artificial lights shall be so fixed, directed, designed or sized that the minimum
subtotal of their illumination will not increase the level of illumination on any nearby residential
property by more than 0.1 footcandle in or within 25 feet of a dwelling or by more than 0.5
footcandle on any part of the property.
12. All comments in the Engineering Division memo dated November 8, 2016, shall be addressed.
13. All comments in the Stormwater Coordinators Memo dated November 9,2016, shall be
addressed.
14. All comments in the Environmental Technician memo dated November 7, 2016, shall be
addressed.
15. The approved Conditional Use Permit (CU 16-15) will become void.

Background/Discussion
Case No. CU 16-30
The property is zoned Extreme Commercial Recreation (XCR) where Off-Road Racing Facilities require
a Conditional Use Permit (CUP). The applicant is seeking a CUP to combine and operate three Off-
Road Racing Facilities (ERX track,TORC track, and go-kart track) into one 42.48 acre parcel.
A preliminary plat application (Case # P 16-19), to allow the operation of Off-Road Racing Facilities,was
reviewed by the Planning Commission on November 22, 2016.
The applicant received a CUP for the ERX track (CU 16-15) on June 20, 2016,with eight conditions.
This new CUP application will include the ERX Track and the eight approved conditions from CU 16-15
are being included in the current CUP conditions (1-8). With an approval of this CUP request, the
previous approved CUP (CU 16-15) will become void.
The applicant also received a CUP (CU 16-18) for Active Use Storage but that is located on a separate
plat and is not included in this proposal.
Analysis
Comprehensive Plan
The property currently has a land use designation of Highway Business/Mining. The Highway Business
land use ranges from moderate to high intensity forms of commercial development in Elk River.
Businesses in this category may be the largest both in terms of size and traffic generation while also
providing services and convenience types of business. Market orientation tends to be regional in nature.
Development orientation tends to be toward regional highways. Examples of Highway Business uses
include discount retailers,grocery,restaurants, automotive sales and service,general merchandise, and
professional services.
The Gravel Mining Area Land Use,Transportation,and Utility Plan identifies the subject property as
Highway Business and Low Density Residential.
The proposed use is consistent with the Comprehensive Plan.
The Site
There are currently several buildings/structures on the 42.48 acre site:
■ 624 square foot office
■ 2,400 square foot shop
■ 1,320 storage facility
■ 3,250 square foot facility
■ 240 square foot shed
■ Pedestrian catwalk/bridge
■ Two sets of spectator bleachers
■ ERX Track
■ TORC Track
■ Go-kart Track

ERX Track
Future track expansion plans include an addition to the existing chalet which would include bathrooms
and concessions, as well as an additional storage shed.
TORC Track
Future track improvements include a two level announcing tower and a concession stand. A scoring
shelter,grandstand bleachers,viewing structures on the east and south sides of the track, and storage shed
will also be added to the TORC track area. In the meantime, the applicant will continue to utilize
temporary/portable bleacher units.
Go-kart Track
Future track improvements include lighting and storage shed.
An amendment to this CUP will be required for future expansions/additions not shown on the site plan
dated January 17, 2017.
Special Event Recreational Camping Area
As part of this CUP request, the applicant, directed by city staff,is including a portion of Outlot A (75-
825-0010) as a special events recreation camping area. Special Event Recreational Camping Area means a
recreational camping area which operates no more than two times annually and for no more than 14
consecutive days. The applicant is requesting that the area shown on the site plan dated January 17, 2017,
be allowed for Special Event Recreational Camping for no more than two times per year. This area has
received the proper grading permits.
Parking
There are 260 parking stalls in the southern paved lot and 200 parking stalls in gravel lot south of the
chalet. A total of 460 parking stalls are located on the subject property for spectators and participants/
sponsors. Parking requirements are one parking space per four expected patrons at capacity. With the
site parking, this would only allow 1,840 patrons on the site at one time.
There are over 500 parking spots located directly north adjacent to the subject property owned by the
applicant (Carlson Motor Sports). Over 1,000 additional spots are also available approximately.25 miles
to the northeast on property owned by Plaisted Companies (PID 75-110-1105).
The site plan indicates the various paving types throughout the subject property, all of which are
acceptable materials for paving.
Section 30-901(a) states all driving areas and parking areas shall be bounded by B612 concrete curb and
gutter. Due to past discussion and direction from the city council with CUP (CU 16-15), staff is not
recommending curb and gutter for this application.
Transportation/ Circulation
The site has two access points from Highway 169. All access before and during events for spectators and
participants/sponsors will occur at the 217th access. The southern access will only be for emergency
purposes and exiting at the end of an event.

Utilities
The subject property is not located in the Urban Service District. Although the current project does not
require city services, some of the proposed permitted and conditional uses in the XCR district will require
city services and this will have to be addressed in the future. This area, as shown in the Comprehensive
Plan,is not anticipated to have city services until beyond 20 years.

Monday through Saturday 7:00 a.m. — 10:00 p.m.
Sunday 8:00 a.m. — 8:00 p.m.
Grading/Drainage
Current grading of the TORC track does not meet proposed Wetland Setback requirements and the
proposed Drainage and Utility Easement. The track will need to be moved to meet the setback
requirements or a variance approved for the encroachment.
Landscaping
Per ordinance, 170 trees are required for the subject property. The total number of required new trees
may be offset by the retention of existing trees on the lot,provided that such trees satisfy the
requirements of Section 30-934:

Staff visited the site and credit for 170 trees can apply to satisfying the landscaping requirements with
existing trees.
Signage
There are two permanent signs on the property. One is approximately 4'x4' and 14' tall and the other
sign is approximately 8'x8' and 15' tall. The XCR ordinance allows only one freestanding sign,not to
exceed 150 square feet with a maximum height of 30 feet. One of the existing signs is a legal non-
conforming sign.
In the future, the applicant anticipates constructing a single monument sign on the subject property that
would exceed 30 square feet of changeable copy. They are including a changeable copy sign exceeding 30
square feet with this CUP application. The sign is proposed to be 150 square feet in size and 30 feet tall.
I will replace their existing ERX sign.
Wetland
In 2008, the city indicated the current pond on the ERX track is an incidental pond created from mining.

If denied, denial shall accompany recommendations or determinations by findings or a report stating how
the proposed use does not comply with the standards set forth in Section 30-654.
Planning Commission Meeting Summary
No one spoke for or against the request. Since the meeting, a property owner on 219th Avenue
contacted staff indicating that 219th is a private road (once the road turns east) and that she wanted to
know how she may revoke the easement. She said people will use that road as access to the ERX facility.
For the TORC race in 2016, she placed barriers prevent through traffic although some drove through her
yard to get around them anyway. She said that ERX has been good to work with and that they do not
encourage people to use 219th Avenue.
The Planning Commission had no comments or concerns and the applicant has no issues with the
recommended conditions.
The Planning Commission unanimously recommended approval of the request.
Environmental Assessment Worksheet (EAW)
The mandatory Environmental Assessment Worksheet (EAW) for ERX Motor Park was completed on
January 3, 2017,with a resolution from Council. No additional environmental review is necessary at this
time unless major changes are to take place and an amendment to the EAW is required.

Per State Statute 15.99 the required 60-day review period was extended to January 24, 2017.

timepowersportsenthusiasts.PlaistedandCarlsonbothenjoyparticipatinginpowersports
activitieswiththeirfamilies.Theysawanopportunitytocreateafacilitywhichwouldaddress
thisopportunityandprovidevaluefortheElkRivercommunity.Theiroriginalintentwasto
provideafacilityforsnocrossracingandtraining.TodayERXisayearͲroundcomplexhosting

ISOC,thenationalsnocrossseries.RiderswhowereintroducedtothesportofsnocrossatERX
arenowwinningnationalchampionshipsandarerecognizedassomeofthebestemerging
racersintheworld.Asadirectresult,ERXisquicklyacquiringareputationasafacilitywhich
developsandbuildsfuturechampions.
Inthespringof2016,theERXteambuiltanoffͲroadtrucktrackwhich,inJulyof2016,ERX
hostedstops7and8onthenationalTORC(TheOffͲRoadChampionship)circuit.Inthefuture,
wewouldliketoholdtwooffͲroadtruckeventsperyearandhaveteamscomeoutfor
occasionaltesting.

BecauseofthesuccessofthateventweareapplyingforaCUPfortheoffͲroadtrucktracktocontinueoperationsatthislocation,inconjunctionwithallotherapplicablelanduseapplicationsdeemedapplicablebycitystaffatourmeetingonJuly28,2016(i.e.:PreliminaryPlat,FinalPlat,etc.).Inadditionprovidingasafe,yetchallengingtrackfortestingandtraining,ERXprovidesthefollowingeventsonaregularbasis:
1. ERXGrassrootsSnocrossSeries
Thisserieswillbeenteringits9thyearthisyear,andishostedonThursdaynights,
focusingonfirstͲtime,amateurandyouthracers.Thelargestclassesareyouth
oriented,andthelargestspecificgroupsofracersarethe120ccclass,whichfeatures
ridersfromages4to12yearsold.Competitorsfollowthesixraceserieswithhopesof
capturingtheERXSeasonPointsChampionship.WehaveracerstravelingfromOntario,
Manitoba,NorthDakota,Wisconsin,Michigan,IowaandOhio.Averageattendancefor
thisraceisapproximately1,000people;wedon’tanticipateattendancetoeverexceed
1,500people.
2. SummerBeaterͲXSeries
Thisseriesfeaturescompactcars,lighttrucks,ATVsandUTVscompetingonanallͲdirt
track.Thetracklayoutconsistsofrollingjumps,elevationchanges,tightcornersand
providesanexcitingandchallengingextremeformofracing,withafocusonlowͲ
budgetracingforamateursandfirstͲtimeracers.
3. FridayNightGoͲKartRaces
Thisisthe2ndyearofgoͲkartracing.Thistrackisasmallovaltrack,directlytotheeast
ofthemainERXtrack,whichisrentedby169Speedwayandoffersfamiliesachanceto
experiencethefirststepsofracing.
FutureoffͲroadracingeventsatERXcouldincludegrassrootsoffͲroadtruckracing,regionaloffͲ
roadtruckracing,andmotocrossracing.
WearecurrentlyworkinginconjunctionwithCitystaffandAndersonEngineeringontheEAW
processasrequiredbythecity;thisisinparttriggeredbyouranticipationofhostingeventin
thefuturewhichwouldexceed5,000participants.
Todate,thelargestattendanceatanyofoureventswasapproximately4,500peekattendance.
WeanticipatefutureoffͲroadtruckracesandlargerextremesnocrossracestoexceed5,000
participantsandspectators.Intheeventweweretoconsiderhostinganeventonthissite
whichwouldexceed19,999peekparticipantandspectatorattendance,wewillworkwiththe
citytoensureallnecessaryrequirementsareputintoplacepriortotheevent.

In2010,AndersonEngineeringperformedaWetlandDelineationonthegoͲkarttrack,atthat
timeRebeccaHaugwascopiedonthedocumentationofthereportthatstatedthiswasan
incidentalpondandnotregulatedbyMinnesotaWetlandConservationAct.

In2016,AndersonEngineeringperformedwetlanddelineationontherestofthisproperty.AllwetlandshavebeenpreservedinbuildingtheoffͲroadtrucktrack.GradingWiththeexceptionoftheoffͲroadtrucktrackandthespecialeventcampingare,therewillbenogradingchangesfromthecurrentstate,atwhichtime,ERXwillapplyfornecessarypermit(s).

individualstravelhereforERX,theElkRiverareaexperiencesasignificantpositivefinancial
impact.Theimpactsaremostsignificantduringthewintersnocrossseasonsasteamsand
athletescontinuetocallElkRiver“home”intheirattemptstolocateneartheERXtrack.Teams
supportlocalbusinessesbyutilizinglocalrestaurants,hotels,municipalliquorstores,grocery
storesandgasstations.DuringlargeERXevents,theElkRivercommunityisfilledwithteams,
familiesandspectatorsastheyspendmultipledaysintheareaparticipatingineventsatERX.
Sinceourinception,there’sbeenahandfuloffamilieswhohavepurchasedlandintheElkRiver
areatobeclosertoERX,thus:
1)providingpartͲtimehousingfortheirfamilyandteam,
2)operatingtheirrespectivebusiness(es)andracingteamoperations),
